He married Elizabeth Beard in Frederick County MD on February 22, 1848. They had the following children: John Daniel Payne born 12/2/1848 Lewis Henry Payne born May 4, 1852 Charles B. Payne born March 8, 1854 Lydia Ann Payne born April 1856 Elizabeth Lucinda born April 12, 1856 ? (twins?) Emma Payne born 1859.
