    3. I still haven't found that summary article on them. It wasn't published in the NEHGS Register as I thought. Shall keep looking. What was published there was: "Records of Carey Cemetery, Canterbury, Connecticut" in vol. 70 of the Register, various pages. This is only one of several cemeteries in the town.     3. The phrase In the Will of Thomas Payne, Jr. of Franklin Co. GA 1786, " all my brothers, stepbrothers and sisters" continues to cause problems. WWWEBSTER DICTIONARY on line defines stepbrother as a son of one's stepparent by a former marriage . Now that would really make for problems! but The 1755 DICTIONARY OF SAMUEL JOHNSON defines the useage of " Step" as one related only by marriage, and WEBSTER'S 1828 DICTIONARY defines "step-brother" as a brother in law or by marriage There are, I'm sure, dictionaries from 1786, but these are the two closest ones I have access to. I do not believe the terminology of the will shows Thomas Payne, Jr. was referring to brothers, HALF brothers and sisters. I believe he was referring to his sister's husbands. This in no way precludes the possibility that some siblings were "of the whole blood" and others "of the half blood." But the will simply does not speak to that, and can not be used to prove it. That is something that will have to be proven in some other way. In addition, the wide range of birth dates listed for Thomas Payne, Jr.'s mother, Yanaka Ayers Payne (everywhere from 1722 to 1744) does not preclude the possibility that she is the mother of all the children. This issue is very important to those striving to get the correct ancestors I suggest we curtail the speculation, stay open-minded on the subject, and keep watching for evidence that Thomas Payne, Sr. did/did not have a wife previous to Yanaka, and for evidence that Yanaka was/was not mother of all of husband Thomas' children.     2. Hi again, Cousin Carol-- A distant cousin began working on our genealogy many years ago while our grandparents were still with us. I have been privy to some of her notes but what I have for your William R. is scant. I have that he came to Indian Territory and married Mandy Baine. They had seven children: Emma, Ellen, Minnie, Luther, Otha, Frank, and Oscar. Oscar died. Emma married Jim Peters (children: Berlie died. Hettie married and lived in CA). Ella married Solomon and lived in CA. She had died. Luther had not married and lived at Altus, OK. Frank married but separated and also lived at Altus, OK. Minnie married Burnside and lived in Albuquerque, NM. Otha lived in CA. By a deed dated 8 Oct 1887 the children of William B. Payne sold a piece of property in Wise Co, TX. On the deed William R. Payne was listed as living in Sharp Co, AR. William B. Payne married in 1839 to Nancy Ann Kizer who was one of ten children of Francis Kizer and Susan (Moore?). Nancy Ann died between 1859 and 1865. William B. married a Catherine C. in 1865 but she did not make the move to TX. William B. and Nancy Ann's oldest daughter, Sarah, also elected to stay in MS. I believe the rest of the children and their families moved. Some interesting tidbits: In Nov 1836 John and William Payne, with John Reeves as surety, were granted license to open an inn and tavern in the town of Jacinto [MS--a newly formed town], as was also Benj. J. Kizer [brother of Nancy Ann] and James Harris, with Terrill B. Phillips as surety. At the December meeting of the board of police . . . .William Payne contracted to build a forty-foot bridge, sixteen feet wide, across Carrollville Creek, on the Jacinto and Pontotoc road for the sum of $98, to be paid one half in cash when the bridge was completed, and the remainder six months later. Nancy Ann's father Francis Kizer was charged [along with others] by the grand jury with violating the state gambling laws by unlawfully wagering and betting with and against one Robert Lowrey upon the result of the presidential election in the United States of America. He pleaded guilty and was fined $20 and cost. I have that the father of William B. Payne was Thomas D. Payne and there was a Thomas D. living in the same vicinity as all the other Paynes and Kizers. I also have that his mother was Sarah (Sallie) but someone told me that her last name was Chatham and that sent me many miles in what I now believe is the wrong direction. So, back to the books.     3. My gg-grandfather Charles E. (Emanuel?)Payne was b. in IN 1845-1846 according to his marriage lisence to Mary Catherine Waddle. They married 1-4-1874 in Marshall Co IN. The 1880 Marshall Co. In census lists Charles father born in VA and mother in KY. They named their first son Otho Andrew Payne. This is such an unusual name I am assuming that Charles father was Otho Payne. I find Otho Payne buying federal land in IL in 1838 and John Payne also bought land in 1838 both in Kankakee Il right on the border of Indiana. I find Otho W Payne in the Il census index from 1840-1849 and then in IA index from 1850 and 1852. Does anyone know anything about this Otho Payne? His wife, children or siblings? Charles E Payne and Mary Catherine Waddle had the following children 1. Otho Andrew Payne b. 8-7-1875 IN 2. John S. Payne b. 1878 IN 3. Issac Payne b. 1879 IN These children were listed in the 1880 census Marshall Co In In March of 1881 Charles and Mary moved to Pentwater, Oceana Co Michigan and then to Walkerville Oceana Co Michigan. They had the following children in Oceana Co. Mi. Ernest Edward Payne 2-16-1831 d. 2-12-1887 Daisy (Maude)Payne 5-21-1884 Charles C. Payne 3-1886 d. 6-8-1901 Harry (Harrison?) L. I've been criticized too... guess we all are by someone or another over time. To heck with that.. I'll continue to share with those who want to. Sorry that there are those who have gotten to you so badly. Wish it wasn't so. You have so much invested, it surely has to be hard to continue to put heart and soul when you feel some are so unappreciative. We appreciate you .. all you've done and all you will do. Don't stop! As i dig through my boxes, after this last move, I'm coming across some photocopies of articles on NE Paines. As I find them, I'll post them for the list's perusal. I can do limited look-ups using my libraries Cumulative Index and run of the Register. The first one I found is: "Seth Payn of Lebanon CT and Paine's Hollow, NY" This Seth is sixth generation descended from Moses. He is NOT one of the Canterbury Paines. Anyone have any more information??? ------------------- Supreme Court Records in Nashville, TN Copy of the Zebediah Payne's Pronouncement " Zebediah Payne, you are found guilty of the murder of William Coltart, in the county of Franklin, on the tenth day of June 1840. Your youth, just developing into manly beauty, your apparently ingenuous countenance, and your sensibility are all calculated to excite the sympathies of the court. They would seem to indicate that you were destined for better things. Unfortunately for you, and for the country, early discipline was wanting, by which to restrain the luxurious passions of youth, and industrious habits, by which to simplify its wants and furnish the means of enjoyment. Your dissolute habits required the expenditure of money and you were reckless enough to resolve upon obtaining it at every hazard. With this in view, you joined yourself to the deceased as a traveling companion. You found he had money and you determined to take his life, and make the treasure your own. While the journeying together, and on his part, doubtless in the full confidence of social companionship, you set upon him with the ferocity of a beast of prey, and with your knife, mangled his jaw, and finally succeeded in cutting his throat, so that he died. In the wilds of Texas, where you supposed the murderer would find a secure refuge, you sought to avoid detection. But justice overtook you. There are two references to a Mouse Paine I have not seen mentioned before unless it could be a Moses but as one is 1829 Knox Co and the other 1832 unspecified I would expect it is indeed Mouse.     2. Mary Ann I notice you are researching relatives in Kent England. My mother, Clarice Payne, Uncle Ronald Payne and Grandfather Lesley Charles Payne came from Brighton, Sussex which is the next county to Kent. I think my Uncle emigrated to Australia but he had a son called David. My grandfather died when my Mum was quite young and she is 81 years old now. I dont know if there is a connection.
