    3. From"Old Westmoreland, the History and Genealogy of Westmoreland County, Pennsylvania" Vol. 5, #2 06 Apr 1807. Deed. Samuel POOL of Hempfield Twp. and Mary (x) his wife to John MILLIRON, gunsmith, of Hempfield Twp. Price: $200 Pa currency. Land 150 perches in Hempfield Twp (including the mill pond or dam), bounded by John MILLIRON and said Samuel POOL; it being part of 422 acres 97 perches formerly held by Henry HOREBACH, against whom Rev James FINDLEY at the court of common pleas at Greensburg at June term 1793 obtained a judgement by said court and recovered against said Henry HOREBAUGH and Edward BOOK, esq. both of Westmoreland County, a debt of 450 pounds currency, plus 2 pounds 4s 9d damages. And whereas afterwards by Writ of Fiere Facias tested 14 Mar 1800 grounded upon a judgement (rendered upon a certain writ of Fiere Facias Quarexecutionan returnable to December term 1798 at the suit of the executors of Rev James FINDLEY dec'd) returnable to June term then next, John KUHNS Esq. then High Sheriff, returned to the court that he had levied the right, title and interest of the said HOREBAUGH to 422 acres 97 perches in Hempfield Twp., adjoining Jacob MILLIRON dec'd, Jacob PAINTER, Henry SNYDER, and others. And whereas John BRANDON Esq., High Sheriff by deed 02 Nov 1804, by virtue of writ of Venditioni Exponas, sold said plantation and tract to James BRADY, Esq. And whereas James BRADY Esq. by deed of release bearing date even herewith, conveyed to Jacob PAINTER Esq. all his interest to the one full, equal and undescribed moiety of the hereinafter described and bounded tract; the same being described above plantation as aforesaid seized and taken in execution as the property of Henry HOREBAUGH and afterward sold to James BRADY Esq. as before mentioned part whereof 142 acres was conveyed by said BRADY & Rachel his wife, and Jacob PAINTER and Catherine his wife 04 Nov 1805 to Samuel POOL (also POLL). Said POOL now also reserves the right to taking as much water out of the mill pond as necessary to water his meadow adjoining thereto at all times, but is not thereby to hinder or damage in any wise the said John MILLIRON in his occupation and mill works.
