    3. Elaine, If it's the Independent you're referring to, I don't know what archives they have on line, but they refer all inquiries to the historical society, which has the paper on microfilm. They may have films themselves but not a reader - and they are not indexed. The other Thomas Bortree was born in Ireland in 1779 and died 1 Mar 1863. He was the son of Matthew Bortree and unknown female. He married Ann (Mary) Heazelton (Hazelton). They lived in the Sterling Township, Wayne County, PA in 1850. And coincidentally they each had a grandson named Thomas Bortree. Thanks to all who responded to my question on Thomas' death date. I think the will abstraction answered the question without a doubt. Carol

    3. Noticed the names of Jno. H. Williams & Lyman Ames in the Thomas Bortree will. Does anyone know anything further about these two men? My gggrandmother, Alice McFarland Stevens was the niece of a John H. Williams and ended up living with him after the death of her mother, Nancy Williams McFarland. Have found that Lyman Ames was living in the same house with John, his wife Lucy A. (Ames?) and Alice. Also curious as to what is meant by "Register for the probate of wills and letters of Lyman Ames, Administration..." Marilyn Smith

    2. Hi all, ---Been out of town and just catching up to your discussion on Thomas Bortree. There is a problem somewhere. The Thomas Bortree who was the son of Robert Bortree and Margaret Holland and who married Anna Killiam, died and was buried at: Old Paupack Cemetery Bortree Thomas d. Feb. 11, 1864 age 72 years He was born in February of 1792 in Killyman Parish, Co. Tyrone, Ireland The Will of Thomas Bortree that is recorded at Honesdale is his will of Jan. 1857. Is this the same Will that is referenced... "The Register of Thomas' will is dated 1864: 'Wayne County, ? this day before me M. Regan Jr., Jno. H. Williams, Register for the probate of wills and Letters of Lyman Ames, Administration....he was of sound mind, memory and understanding to the best of their knowledge and belief. Witness my hand and official seal in Honesdale this 9th day of March 1864.'" I am writing this without having been there or seeing it myself so I could be very wrong. Are there TWO WILLS for Thomas Bortree at the Honesdale Courthouse? If so, then I would guess they belong to two different men. ~Robin

    2. Elane, As a publisher, I can tell you that any piece of writing would be covered. Of course if it is over 100 years old it is in the public domain and you can use it freely. Garry Myers Columbus, Ohio Re: Does anyone know if obituaries are covered by copyright law? The papers are under copyright, and many see this as including the obits. To protect yourself, it may be wise to obtain permission from each paper whose obits you plan to use. Different papers have different requirements as do the web providers on whose space the obits would be posted. There is a copyright discussion list at RootsWeb which might help you sort it out. 3. Covered, yes, but prudent or not, some papers do not care if obits are reproduced. In some cases, the family member who wrote the obit retains the copyright. All the more reason to obtain permission. And while the composition itself is under copyright, the facts available to the public (such as those on a death certificate) are not. It is not a simple issue. --------------------------------- Do you Yahoo!? Yahoo! Photos: High-quality 4x6 digital prints for 25

    3. For informational purposes only: The GENWEB project through Rootsweb provides forums for volunteers to share data of all kinds. http://www.usgenweb.org/ There are specific data bases on the GENWEB project for obituaries, marriages, wills, etc. http://boards.ancestry.com/mbexec?htx=board&r=rw&p=localities.northam.usa.st ates.pennsylvania.counties.wayne&o=1&maxrows=25&dir=next In addition, the Wayne County Genweb site for which I am the volunteer Web master is at: http://www.rootsweb.com/~pawayne/ This Wayne county Discussion list is also housed and hosted by rootsweb/GENWEB. All of these data bases are run by volunteers like myself. These sites are also accessed by the best search engines. If the intent in sharing information is to share it then please consider adding data to the exisitng web site that goes hand in hand with this Discussion list. It will reach a far greater number of people then individual web sites. 1. Proposed Website
    2. Hi List, For quite a few years I have been building a database of obituaries that I have collected from several newspapers, such as the Wayne Independent and the Scranton Times.  I have been toying with the idea of setting up a webpage with an index of the names and links to the typed obituaries. I have several questions in connection with actually initiating this. 1.  Does anyone know if obituaries are covered by copyright law? 2.  Do you think such a database online would be useful? 3.  How would I get started doing this? 4.  Where would be the most useful place to locate the website? Thanks in advance for any and all input. Debbie

    2. Hi Fred, It would seem that if Mr. Bortree's will was probated in 1864, as someone else indicated, then he must have certainly died before the probate date. Carol
