    3. The following is the meaning of partition as it applies to wills. This is from Black's law dictionary. It is a helpful source to have on hand when trying to read old legal documents. Partition of a succession. The partition of a succession is a division of the effects of which the succession is composed, among all the co-heirs, according to their respective rights. Partition is voluntary or judicial. It is voluntary when it is made among all the co-heirs present and of age, and by their mutual consent. It is judicial when it is made by the authority of the court, and according to the formalities prescribed by law. Every partition is either definitive of provisional. Definitive partition is that which is made in a permanent and irrevocable manner.     3. Dear List, I was reading through my latest edition of the Cornerstone Clues and remembered a list member asking for a definition of a term. Since this edition contains some that may be of interest to members on the list, I thought I'd type them out and share them with the list. Note that the definitions are from Black's Law Dictionary. Administrations: A process which involved the collection, management and distribution of an estate. Bounty Land: Land awarded as a bonus to attract soldiers to sign up or as payment in addition to or in lieu of wages for military service. Codicil: A supplement to a will. Collateral: Descended from a common ancestor but through a different line. Dower: Widow's life estate in her husband's property. Estate: The sum total of person's real and personal property. Et Al: And others. Folio: Page Liber: Book Grantee: Buyer of land Grantor: Seller of land Freeman: Unmarried taxable Inmate: married, non landowner Indenture: 1) a deed; 2) an agreement of apprenticeship; 3) an agreement by which a person sold his labor for passage Intestate: A person, who dies without leaving a will Partition: Division of property owned by two or more persons in common Quit Claim: Release of all title, interest or claim to ownership in specific property; may transfer title to someone else. Probate: Originally the process of proving a will was valid. In American law, inclusive term to describe all matters over which a court of probate has jurisdiction.
