HUDSON and Robert HUDSON, her husband, Agnes PATE and William PATE, her husband, Elizabeth PATTON and James PATTON, her husband, John T. BELL and Ritta D. BELL, Josephene B. BELL and Delilah J. BELL and the unknown heirs of Samuel BELL, and the unknown heirs of Thomas BELL, defendant. At this day comes the plaintiff herein, by Attorney, W.H.H. THOMAS, and files his petition and affidavit, alleging among other things that Defendants, Mary W. HUDSON and Robert HUDSON, her husband, Agnes PATE and William PATE, her husband, Elizabeth PATTON and James PATTON, her husband, John T. BELL and Ritta D. BELL, and Delilah J. BELL are not residents of the State of Missouri, and the names of the heirs of Thomas BELL and Samuel BELL are not known to Plaintiff, hence cannot be named in the petition; whereupon, it is ordered by the clerk that said Defendants be notified by publication that Plaintiff has commenced a suit against them in this court, the object and general natrue of which is to obtain a decree of partition of the following described real estate situate in Jefferson county, State of Missouri, viz: The southwest quarter of section 19, in township 41, range 5 east of the 5th princiapl meridian, containing 60 & 76-100 acres, and if the said real estate can! not be divided, then for an order of sale thereof and division of the proceeds; Plaintiff further states in his petition that Samuel BELL and Thomas BELL have departed this life and the names of their heirs are unknown, thence cannot be inserted in the petition as aforesaid; that the unknown heirs of Samuel BELL, deceased, own one-fifth of said real estate; that the unknown heirs of Thomas BELL own one-fifth of said real estate; that Mary W. HUDSON, wife of Robert HUDSON, Agnes PATE, wife of William PATE, Elizabeth PATTON, wife of James PATTON, James T. BELL and Ritta D. BELL, Josephene B. BELL and Delilah J. BELL are each the owner of the one undivided thirty-fifth part of said real estate; and that unless the said Mary W. HUDSON and Robert HUDSON her husband, Agnes PATE and William PATE, her husband, Elizabeth PATTON and James PATTON her husband, John T. BELL and Ritta D. BELL, Josephene B. BELL and DElillah J. BELL and the unknown heirs of Samuel BELL and the unknown heirs of Thomas BELL shall be and appear atthis court at the next term thereof, to be begun and holden at the Court House in the town of Hillsboro in said county, on the second Monday of September next, and on or before the sixth day of said term, if the term shall so long continue--and if not, then on or before the last day of said term -- answer or plead to the petition in said cause the same will be taken as confessed and judgment will be rendered accordingly.
