    3. >From the Kokomo tribune Kokomo, Indiana Publication date: January 28, 2003 JOSEPH PATE Jan. 20, 1933 - Jan. 21, 2003 Joseph Elvin "Cowboy" Pate, 70, Kokomo, died Tuesday, Jan. 21, 2003, at his home. He was born Jan. 20, 1933, in Centerville of Faulkner County, Ark., the son of Nellie (Chance) and Nath Pate. On June 24, 1981, in Conway, Ark., he married Mary Joann (Milligan) Bagby and she survives. He retired from Button Motors as a service manager, working there for nine years. He was a member of the Church of Christ in Arkansas and a former member of the Eagles. He loved his dog, "Macabee", and enjoyed working in the yard, C.B. radios, camping and fishing. He is survived by his wife, Mary Joann Pate; one son and daughter-in-law, Jack E. and Teresa Pate, Kokomo; one daughter and son-in-law, Linda D. (Pate) and Roger Johnson, Kokomo; a stepson, James T. Bagby Jr., Kokomo; a stepdaughter, Stacey L. (Bagby) and husband Robert Hjelmeland, Kempton; five sisters and two brothers-in-law, Martha Pearce, Annie Atkisson, Bracy (Owens) Kleczka, Zell and Arthur Tindall, and Bertha and Lewis Warren, all of Arkansas; 16 grandchildren; and two great-grandchildren. He was preceded in death by his parents, one brother and four sisters. Services are 1 p.m. Thursday at Ellers Mortuary Webster Street Chapel, 3400 S. Webster St., with Pastor James Ball officiating. Burial will be in Crown Point Cemetery. Friends may call 2 to 4 p.m. and 6 to 8 p.m. Wednesday at the mortuary.

Just a few additions to Sharon & Joel's posting: Louisa A Pate is in my direct line, dau of John Pate & Francis (Hobbs) Pate - she md (1) to Henry D Woodworth on 29 Jan 1839 - and (2) to James McKnight (the date of 29 Jan 1839 for second marriage is wrong), as near as I can figure it would have been around 1859 and she would have been Louisa Pate Woodworth -- Joseph T Pate, who md Mary Fitzgerald, is the son of William Pate & Elizabeth (Shaw) Pate from AL Elizabeth Pate listed in the 1870 mortality schedule is PROBABLY from the NC Pate's - Elizabeth (Brock) Pate, wife of Richard Pate Edgar Pate was b. ca 1906, son of Thomas J & Edna Pate. Edgar is descendant of David Coonrod Pate & Sarah Straughter Peter Pate, of course, is Peterson Pate - and I SUSPECT he fits in with the Sussex Co, VA line of Pate's Mrs S E Pate is Sarah Emily (Talton) Pate, widow of George Jefferson Pate.     3. I recently spent a day in San Augustine doing genealogy research. My main goal was to verify the FITZGERALD information that I had been provided by a helpful researcher. Mary FITZGERALD, daughter of Jackson FITZGERALD, married Joseph T. PATE in San Augustine County, TX in 1856. There were no records to indicate that they stayed in San Augustine after the marriage. They were in Anderson County, Texas at the time of the 1860 census. I did take notes on other PATEs whom I found in the library and courthouse. I will post them in the hope that they will help someone on the list. 1) Adaline PATE - resided in San Augustine County in 1837 according to the "Texas 1830-1839 Census" by Ronald Vern Jackson. She is also listed in the "San Augustine County TX Marriage Records Vol 1 1837-1858". She married Dwight Spencer 11 Nov 1837. 2) Louisa H. PATE - resided in Nacogdoches County, TX in 1839 (same reference as above). 3) Elizabeth PATE of Fayette County, TX is listed in the "Texas 1870 Mortality Schedule" by Ronald Vern Jackson (NOTE: she is the only PATE listed). She was born in Georgia, died in April, and (I think) was age 37. 4) Audrey, Birha (?) and Blanch PATE (minors) show up in the "1828 - 1940 Probate Cases of San Augustine County TX" (published by the San Augustine Public Library). The date was 14 Nov 1919 and the case was a Guardianship of Person and Property. The guardian was L. B. PATE. 5) Kennon PATE - in a scrapbook in very bad shape in the San Augustine Library labeled Pictures from the Past, there is a photo of the singing class at the old Denning School, taken about 1916. Carolyn Moore >From THE KOKOMO TRIBUNE.................KOKOMO, INDIANA Suspect caught in Arizona Publication date: Thursday, January 23, 2003 By MIKE FLETCHER Tribune staff writer A convicted killer wanted for questioning in the death of a 70-year-old Kokomo man and the disappearance of his wife was captured by police Wednesday in Arizona after a pursuit and a brief gunfight. Kokomo police said Jerry R. Brackett, 43, formerly of Cass County, went to the home of Joseph and Mary Jo Pate Monday, stole the couple's Chevrolet van and abducted Mary Jo Pate. Officers began searching for Brackett after they found Joseph Pate dead in his Kokomo home at 1508 E. Harris St. late Tuesday, and his 57-year-old wife missing, KPD Lt. Donald Whitehead said. Pate's death remains under investigation. As Kokomo detectives scoured Pate's one-story, southside home at the corner of Harris and Laguna streets for clues Wednesday, police in Arizona found Brackett and Mary Jo Pate and the Pates' Chevrolet van, Whitehead reported. Police in northern Arizona spotted the van Wednesday and initiated a traffic stop. Whitehead said Mary Jo Pate had been inside the van at one point and managed to escape at a rest stop in Arizona. She told police Brackett had come to her Kokomo home Monday and kidnapped her, the detective said. Her condition was not released. As police pursued the van, the driver and police exchanged gunfire. An Arizona officer was injured when he was struck by the van during the pursuit, Whitehead said. Michael Marizco, a police reporter for the Daily Sun in northern Arizona, said Wednesday the officer was not critically injured. The chase continued for a short time, then ended when the van slammed into a tree, Marizco said. Brackett ran and was shot in the upper torso and left arm by the officers before being captured, Marizco said. At 4:30 p.m. Wednesday, Brackett was captured and taken into custody. The Daily Sun said police transported Brackett by police helicopter to a Phoenix hospital for treatment. The newspaper also said Brackett most likely will be charged with attempted homicide for allegedly using a vehicle as a weapon against the officer. Kokomo police did not say what charges Brackett will face when he is returned. Calls made to the Yavapai County Sheriff Department in Arizona went unanswered Wednesday. Kokomo officers went to the Pates' home at 11 p.m. Tuesday at the request of family members, who called police after several days of failed attempts to contact the couple. Police said Brackett was a friend of the Pates, and they believed he had been in contact with the couple recently. An autopsy on Joseph Pate's body was conducted Wednesday, but a cause of death remains under investigation pending microscopic tissue examinations, Howard County Coroner Brad Bray said. Investigators are hoping the tests will shed some light on how Pate died. Results of the tests are expected in a day or two, Bray said. At the Kokomo home, police are not saying if there were signs of a struggle because the investigation is ongoing. Howard County/Kokomo Emergency Management officers kept a watch on the Harris Street house from late Tuesday to Wednesday afternoon to ensure no one entered. Detectives also searched the house for additional clues. Jerry Brackett's past According to the North Carolina Department of Corrections, Jerry Brackett was convicted in 1984 of second-degree murder in the slaying of his nephew. He was sentenced to 15 years in prison. Brackett escaped March 16, 1988, from Haywood Correctional Facility in North Carolina while serving his sentence. >From 1991 to 1997, Brackett resided in Galveston under the alias Roy Valentine, according to a 1997 Kokomo Tribune article about Brackett's arrest in Cass County. Before the 1988 escape, Brackett also had escaped in 1985 from Henderson Correctional Facility in North Carolina. Cass County police recaptured Brackett in 1997 on a warrant charge of perjury alleging he had made false written statements at the Bureau of Motor Vehicles. The Federal Bureau of Investigation determined Brackett's true identity after his fingerprints were taken at the Cass County Jail. Brackett was then extradited back to North Carolina to serve out his term. Brackett was released from prison Jan. 24, 2001, according to the NCDOC web site. The real Roy Valentine was murdered Dec. 25, 1975, in a Tennessee tavern. That murder has been solved and is not connected to Brackett, Lt.     3. Margaret The Texas Death Index has an entry for a Noah W Pate who died in Lubbock Co 25 June 1937, cert # 42479. It is reasonable to conclude that this was Noah Willoughby Pate. I have an unproven, perhaps Texas, record of the death, 25 Aug 1937, of a man I believe to Nash Willoughby Pate. The source of this information is the LDS files: Batch Number: 5002301 Sheet: 29 Source Call No: 1396483 Type: Film. I've found no Texas record of a Pate man with a date of death of 25 Aug 1937 in the Texas Death index. Absence from the Texas Death Index by no means should be taken to indicate that the person did not die in Texas. I was able to spot this family in the various census records by searching on the names of his wife and children. The 1930 census has a searchable, all name index, on a commercial genealogy content site. A search of that site for Noah Willoughby Pate, and variants like N W Pate, Noah Pate, Willoby Pate etc failed to yield a record. I searched for Noah in Texas in 1930 on the premise of the 1937 death record. Parents of Noah Willoughby Pate? I'd suggest looking in Richmond Co NC. In 1958 a lady by the name of Julia Claire Pate published a book with the title: "Pate, Adams, Newton (and) allied families principally in Richmond, Scotland and Robeson counties North Carolina and Marlboro County, South Carolina". One of the primary families detailed in the book is that of Willoughby Pate (1790-1834) and his wife, Aseneath (Teney) Smith (1788-1855). The surname Covington occurs 64 times in the index of this book. I have scanned this book and I have not been able to locate a reference to Noah or Nash Pate. The several counties named above lie between two rivers, the Pee Dee and the Lesser or Little Pee Dee. Pate (Pait in Bladen Co) are often referred to as Pee Dee Pates. There is another major enclave of Pate families in the Neuse River Basin, particularly Wayne and Lenoir Counties, NC. The name Willoughby also occurs in these Pate lines. You would be wise to search for variant spellings of Willoughby, such as Williby, Willoby. Willaby, Wiloby etc. One document that MAY prove useful is the marriage license for Noah W Pate and Mary Jane Covington. Often the father or other male relative of the groom posted the surety bond for the license or witnessed the marriage. A native of Morganfield, he was a member of Irvington Baptist Church, a member of the Irvington Fire Department and a retired civil service worker from Fort Knox. He also worked part time for several years at Mitcham Petroleum in Irvington. He was preceded in death by his parents, James Atlee and Louise Hawkins Pate. Survivors include his wife, Shirley; a son, Lynn Pate of Evansville, Ind.; two daughters, Yvonne Kennedy of Irvington and Rhonda Richards of Elizabethtown; a brother, Marvin Pate of Cloverport; a sister, Marjorie Keenan of Owensboro; five grandchildren; and two great-grandchildren. The funeral is noon Monday at Irvington Baptist Church with the Rev. Jerry Shacklett officiating. Burial will be in Cloverport Cemetery. Pate 1819 and also that of Andrew Jackson Pate to Jane Milliken ((although it says Jany Milligan, all the family (grandchildren) seem to believe that it is Milliken)). ((Is Jane Milliken sister to James Milliken married to Polly Pate in the Stephen Pate will of 1817?) James bn 1778 (1860 Dyer Co Census)in Tn has a wife bn in 1850 Eliz W who is bn 1795 KY. (I wonder if there was a first wife for James?) (My Henderson Clark is also bn Ky 1797 but the Clarks are proven to be from the from the Washington Co TN area as I feel sure that Eliz Pate's family will be.) Children in the 1860 census with James Pate by 1778 TN are G. W. 1816, Jane 1822, Stephen 1826 bn AL (! and listed as an idiot in the census), Mathew 1827, E. 1830, Mary E 1832, R.A. 1834. (I would take all these dates as @ rather than for sure.) There is little doubt in my mind that this James Pate is the eldest son of Stephen Pate of the 1817 will. Note that in 1817 the wife is still alive and I forgot to say that there are 5 under aged children for the 1817 will. Willingham and Thompson are two of the names who signed the document. You have my Eliz Ann Pate bn 1800 Tn and married to Henderson Clark in 1819, Madison Co TN. Later 1850, after the death of Jane Milliken Pate Pate and Mathew Pate (remember that she is known to have married the two brothers Stephen and Mathew 1830), the ONLY child of the Jane Mathew marriage is E. Cain Pate bn 1831 Dyer Co and he lives with my Clarks (Eliz Pate Clark). The Clarks also have with them E. Rucker who is identified as being the sister of Zach Rucker (md Madison Co) who married Susan Pate (who is considered by Dyersburg lore to be the sister of my Eliz Pate.) The Phillips and Fitzhughs are connected with the Ruckers. Henderson Clarks' son Charles P. has in 1850 with his G. F. Rucker age 26 Al (son of Zach and Susan Pate, Mary Rucker 21 NC; M PateKY and E. Pierce Ga. Andrew Jackson Pate son of Stephen Pate and Jane Milliken. Named for the Andrew Jackson who the family consistenly says was in the house returning from the Battle of New Orleans during the week of birth. They also says that Aj was a Cousin to the family. The Hermitage says that Andrew Jackson was in the Madison area that week. He married Susan Martha Thurman Bell who was a widow. She had had 4 children but only one lived. I believe this is Mary A. H. H. 1836, J. M. 1837 and M. F. 1834. Mariah Miller Pate is dead by 1839 and George B Pate dead by 1852. Then you have Margaret Pate Finley's Pate who she belives are more distant from the Andrew Jackson Pates although Analiza marries Richard Adams and are part of her family. Margaret's Pates are the John Pates. You have in 1852 Mathew Pate going to court in Gibson and Dyer saying that his father Stephen Pate is dead and that He and Mary Ann Pate Miller (although she is called the wife of Wm Miller of Dyer Co.) were two of the eight children of Stephen Pate. I think that the older generation is going (my Eliz Pate Clark dead 1848, Mariah Miller and her husband George B Pate are dead by 1852, Stephen Pate before 1830, Mathew Pate abt 1844, Zach Rucker and Susan Pate have come and gone to Beebe, Ark where she dies in 1870s, Andrew Jackson Pate is dead by 1855) and he wants to establish and protect his and Mary Ann rights to property. I think that property will solve this question. I know that Henderson Clark had land in all the surrounding counties. I wonder if some of it came through Elizabeth. In July 1823 Joannaer Rucker in Madison Co Al (per Nelson Co Va Deed Record Bk 4 p.520) Zachariah Phillips, Joseph Phillips, Joannaaer Rucker and Nacny Griffin, all of Madison Co Al appoints Willis Phillips their true and lawful attorney to collect all due from the estate of Frances Phillips, dec of Va. In 1830 Z. B. Phillips and Jesse H. Phillips both have homes (and Z. B. is the census taker) in Dyer CO, TN Record provided by Harold Davis On the ancestry board Pate there is a plat showing the division of Talleys land, mentioning John Pate dec. (also mention of J. M. (or W) Pate. On top there is a "J. F. Phillips". My computer and I do not see a date. I believe the message is 1094 Pates mentioned are Rebecca, Maria, Williamson B. John W. to have property. Her maiden name is Eula "Jeanette" PATE. When she was 15, she lived at 1101B Riverview Apts. in Phenix City, AL and gave birth to a son on 9/24/64 at Cobb Memorial Hospital. The father of her baby was in the military in Phenix City, AL at that time. Jeanette knew a family named THOMPSON that lived in Phenix City, and they adopted her son. The THOMPSONS gave him this information on Jeanette, and they have since passed on. He was told that his mom and dad later married and had more children. He would like to get a message to his mom, dad and siblings to ask if they would like contact with him. The THOMPSONS moved from that area right after the adoption was final and before his mom and dad married. They had a picture of Jeanette's mother (his grandmother) in their photo album so we feel they were at least all friends or possibly related to each other in some way (?). I believe the name Eula was probably passed on to his mom, and that's the only way I know to trace them. Is there any way you can help me with the information I have here?
