Joel - I worked with a lady here in Shreveport on this line - she is a descendant and has done a tremendous job of research -- Fleming's wife is supposedly Elizabeth Jane Hammons, which would explain the different names in the census. Also it is debatable if Fleming is the son of Daniel & Laura or son of Jacob & Frances (Fanny) -- notice Fleming says he was born in VA and in the 1810 Montgomery Co, VA census, there is an unnamed male age 0-10 (b. 1800-1810) in the family of Jacob & Fanny Pate. I found Arminta (Pate) Yarbrough in the 1900 Logan Co, AR census - she is age 45, a widow; b. Sep 1854 - AR/TN/TN with 4 children, one of which is a Daniel Yarbrough. The marriage record of Daniel Pate (age 18) to Mary Jane Totty (age 16) recorded 29 Dec 1870 in Bk C, p 463, Independence Co, AR shows the marriage was by verbal consent of Parents & Guardian - just wonder if a copy of this marriage might show the names of the parents and guardians, if anyone has access to the original record. Jinks: Upon reflection and research, I THINK that Fleming Pate b ca 1805 in TN d ca 1866 in Independence Co AR married only one time. My error in suggesting that Fleming Pate married twice arises from this GedCom (bbrown72527) at World Connect, which offers: [Byron Brown (bbrown71527@aol.com)] Fleming Pate b ca 1805 in VA d 1866 in Independence Co, AR Father: Daniel Pate b ca 1779 in VA Mother: Laura Cook Jacobs b ca 1775 in VA Marriage 1 Elizabeth b ca 1817 in TN Married bef 1836 Children: 1. Stephen F Pate b ca 1837 in AR 2. James D Pate b ca 1839 3. Andrew P Pate b ca 1847 Marriage 2 Jane HAMMONS b 27 Oct 1835 in Jefferson Co TN Married VA 1853 in AR Children 1. Assemantha PATE b ca 1854 2. Marge PATE b ca 1854 LDS has this marriage-Fleming Pate md Jane Hammonds 27 Oct 1835 in Jefferson Co TN The 1850, 1860 and 1870 censuses of Independence Co AR lead me conclude that Fleming Pate married only once to Elizabeth Jane Hammonds who was b ca 1818 in TN. The 27 Oct 1835 marriage date seems to be valid and reliable . The odd spelling of Alice as ALLIS or ALLUS shows up in this line. I find no evidence that Fleming Pate had a son named Daniel b ca 1855. Our grave and marriage data for Independence and surrounding counties in AR needs some work and enhancement. Joel

This is my family. My computer at home is down, but I hope to have it up and running soon. I'll check and let you know when I'm up and going again. William Bruen Pate was my Grandmother's father. Her mother died. He married Miss Minnie later. They are buried together in the Oaklawn Cemetery in Batesville, AR. I was there last week. Miss Minnie is not someone we discuss in a friendly way. I recognize the Martha Howerton Pate name too. -----Original Message----- From: Jinks Lee [mailto:jinksp@juno.com] Sent: Tuesday, July 12, 2005 7:32 AM To: PATE-L@rootsweb.com Subject: Re: [PATE GENEALOGY] Daniel Pate md Mary Jane Totty in Independence Co AR 29 Dec 1870 Joel - I have the following differences in what you posted - can you (or anyone) verify which is correct?? Jinks: I agree: The Daniel Pate who md Mary Jane Totty was not the son of Calvin Pate. Was he the son of Jacob Astor Pate and Martha Howerton? The 1900 Conway Co AR has Martha Howerton Pate as head of household living with a g/dau Margaret Baker. Margaret Baker probably was the dau of Anna Jane Pate and David Leonidas Baker. The best I can come up with is a list (see following) of 10 of perhaps 11 children of Jacob Astor Pate and Martha Howerton. Jacob Astor PATE 18 MAR 1822-23 AUG 1885 md Martha HOWERTON 22 MAR 1820 - 17 JAN 1908 Children: (10) 1. Mary Lou PATE 28 Dec 1843-2 Nov 1905 md -William John Fenner Milliken 8 Jan 1840-8 Mar 1924 2. So this would seem to eliminate Calvin as the father of Daniel Pate. Calvin had a brother, Jacob Astor Pate, b. 18 Mar 1822, d. 23 Aug 1885 who md Martha Howerton. The Adm Bond by Henry James on the estate of Jacob A Pate was recorded 28 Sep 1885 in Bk E, p 47, Conway Co, AR -- Does anyone have access to this record?? It could list his children or heirs - and he COULD POSSIBLY be Daniel's father. The 1900 Conway Co, AR census shows they had 11 children, only 3 still living. Does anyone have the children of Jacob & Martha Pate?? I am trying to find DANIEL PATE. I think he was born around 1855, either in Tennessee or Arkansas. According to marriage records, in Independence Co Arkansas, DANIEL PATE (age 18) married MARY J TOTTY (age 16), December 29, 1870. I don't think the ages listed for DANIEL or MARY are correct. Their parents or guardians may have stated their ages as 18 for DANIEL and 16 for MARY, since that was legal marrying age. I have found this DANIEL PATE family in the 1880 ( June 10, 1880) Arkansas: Independence Co: Greenbrier Twsp: census, as follows: Pate Dan'l, age 25, born Ark (?), Father born Tenn, Mother born Tenn Pate Mary J, age 24, wife, born Ark (?), Father born Vir, Mother born Arkansas Pate John, age 6, son, born Ark, Father born Tenn (?), Mother born Tenn (?) Pate Mary J, age 9, dau, born Ark, Father born Tenn (?), Mother born Tenn (?) Pate Sarah, age 3, dau, born Ark, Father born Tenn (?), Mother born Tenn (?) (as you can see DANIEL and MARY are listed as born in Ark, but their children's Father (DANIEL) and Mother (MARY) were listed as born in Tenn). I can't find DANIEL in any earlier or later census. I should be able to find him in the 1860 and 1870 census, with his parents or guardians. Possibly, he was called by a name other than DANIEL and since I'm not sure of his age, I'm unable to find him. DANIEL PATE paid taxes in Independence County Arkansas 1871 through 1891. I think DANIEL and MARY must have died, before the 1900 census. I'm making this assumption because in the 1900, Ark, Independence Co, Salado Twp census, I find the following: Nash, John H (Husband of Mary J Pate) Nash, Mary J (daughter of DANIEL & MARY) and living with them: Pate, Sarah, age 22, (daughter of DANIEL & MARY) and Pate, Myrtle (daughter of DANIEL & MARY), age 7, this would place her birth date as 1883) Sarah Pate (daughter of DANIEL and MARY) married Elisha Marion Presley, June 18, 1900, in Independence County Arkansas. Sarah and Elisha are my Great Grandparents. I know this is very sketchy information, but it's all I have, other than the probably, that the Pate family, who came to Arkansas, by wagon-train, in the 1830's, and settled in White and Independence Counties, was from Tennessee (probably Jefferson County) and before that from Virginia (probably Montgomery County). Any help you can give me, in tracking down DANIEL PATE, will be very much appreciated. Carolyn Matthews McClure
