This was sent to me by a researcher in Fluvanna co. who has done work for me in the past. It is quite long. I will try to post the highlights. Fluvanna County Order Book 1811-1815 pg.242,243-april 1813 In Chancery Tarlton Pace and Benjamin Pace, heirs of John Pace deceased. Sarah B. Magruder administratix (?) of John B. Magruder deceased, Abraham Shepherd and David Higginbotham Surviving partner and obligee of McCredie Higginbothan & Co. -----------------Plaintiffs against William Pace, William Wilkerson and Susanna his wife late Susanna Pace which said William Pace and Susanna are also heirs of said John Pace deceased and Polley Pace,Salley Pace, Nancy Pace, Valentine Pace and Tarlton Pace, heirs of Jesse Pace,. deceased, who was also an heir of said Jon Pace, deceased, Nancy Pace,widow and relict of said John Pace deceased and David L. Gillaspy-------- defendants This court doth appoint James Payne Guardian to the infant defendants, Polley Pace, Salley Pace, Nancy Pace, Valentine Pace, and Tarlton Pace to defend them in this suit and thereupon the bill and answer in this cause being filed. On hearing the same it is decreed and ordered that James Richardson, Horace Timberlake, Dennis Reiley, James T. Jones and John Omohundro or any three of them as commissioners for that purpose appointed do lay off and assign to the defendant Nancy Pace. widow of said John Pace, deceased husband and having first advertised the time and place of sale at the front door of the court house and at such other public places in this county and at such other public places in this county as they shall think proper for at least two weeks proceed to sell the said tract of land in the bill mentioned subject to the dower of the said defendant, Nancy, therein containing by estimation Sixty Three and three fourths acres at public auction for ready money and out of the proceeds arising there from that they pay to the defendant David L. Gillaspy, one seventh part thereof, an amount of his interest in right of one of the heirs therein and out of the balance of such proceeds pay to the plaintiffs, Sarah B.Magruder, administratrix of John B. Magruder, deceased Abraham Shepherd and David Higginbotham, surviving partners and obligee of McCredie Higginbotham & Co, the amount of their claims against the heirs of the said John Pace, deceased and costs of suits and pay the overflow, if any to the different claimants in said land being the Children of the said John Pace, deceased and render the proportion therof if any to which the heirs of Jesse Pace are entitled into come and that they also make and return to this court a report of their proceedings therein in order to a final decree. I did type the entire thing. Would Jack, Gordon, or anyone else familiar with this family decipher for me the connections between these persons and perhaps what they think this suit may be about. I Have seen a Gillaspy married to a descendent of William Moment Pace . Will post that information later.
