Yesterday In the Argument Court Arguments were made in court yesterday on the plaintiff's motion for a new trial in the suit of W. L. Jacobs vs. Miss Bernadette Vallade. Defendant gave plaintiff the contract for the installation of a hot water heating system in her home on Eleventh street, Altoona. After the system was installed, the defendant alleged that her house was not properly heated. The jury allowed her a credit of $70 on the claim for unsatisfactory work. In pleaded for a new trial Attorney T. H. Greevy remarked: "We lost this case because defendant is a stunning beauty and plaintiff is an ugly man. The jury was influenced unduly by these facts. "Attorney J. F. Sullivan retorted: "We won out on the merits and not on our looks." Decision reserved. Maud G. Cupples and Oscar Cupples, her husband vs. the Altoona and Logan Valley Electric Railway company. In this case a jury had awarded plaintiffs a verdict of $240 for personal injuries sustained by Mrs. Cupples by reason of being thrown out of a pay as you enter car at Juniata. The woman was leaving the car, carrying a baby on one arm and bucket on the other. She testified that the motorman prematurely threw the lever which controlled the folding steps, causing her to fall from the steps. The defense was that it was an impossibility for the step to fold up with the woman's weight upon it and that Mrs. Cupples was feigning illness. W. C. Fletcher, esq., representing the plaintiffs and Greevy & Brotherlin the defendant company.
