Eighteen hundred and forty four between Samuel Ozment of the one part and G. S. Gibson of the other part both of the County of Hardeman and State of Tennessee. Witnesseth that the said Samuel Ozment for and in consideration of the sum of one dollar to him in hand paid the receipt whereof is hereby acknowledged hath given granted bargained and sold and these presents doth give grant bargain and sell align release convey and confirm unto the said G. S. Gibson his heirs and assigns three certain bay mares, thirty three head of stock hogs, one ____ & twenty one ________________ six head of cattle this conveyance is more or less made in trust and for the use and purposes hereinafter maintained and declared and none other that is to say whereas the said Samuel Ozment justly indebted to Daniel S. Offrens in the sum of one hundred and ten dollars and 61 cents in a judgment in Esq. T. M. Chadick office and William Comer has this day set his name attesting to the said Judgment as is also indebted to diverse other persons to an amount granted as he apprehends then he will be able to pay and being anxious to _____ the said William Comer in preference to his other creditors now therefor this indenture witnesseth that in case the said Samuel Ozment shall will and truly pay and satisfy the said debt and ______ when it shall come due and payable then this conveyance is to be void and of no effect otherwise the said G. S. GIbson shall take possession of the property hereby conveyed and after giving two days notice at the court house in the town of Bolivar and at the Election Ground and those other public places in the neighborhood of the time and place shall expose the same the sale to the highest bidder for cash and after having first paid the expenses of such sale and the other expenses attending the execution of this trust shall pay the balance the creditor above mentioned and the balance if any of said proceeds remain in his hands he shall pay over to the same Samuel Ozment or to his order it is expressly understood and agreed by the parties that untill default be made in the payment of said sum of money said Samuel Ozment is to remain in feasible and undisturbable possession and enjoyment of the property herein before mentioned and conveyed in witness whereof I have set my hand and seal this date above written. Casey Clerk of the County Court for said County Samuel Ozment with whom I personally acquainted and who acknowledged that he executed the foregoing deed of trust for the purposes therein expressed and upon the day it bears date Witness my hand at office this 18th day of Dec 1844.
