Amber Lee Gandy, 26, and her three children, ages 2, 3 and six months, were rescued by two men after her 1999 Ford Explorer went off the road and landed upside down in Widow Creek at around 4 p.m. on Nov. 18. Lt. Dave Carey with the Lincoln County Sheriff's Office said deputies at the crash scene described Gandy as "very visibly intoxicated." Gandy and her two older children had been helped out of the vehicle, but their rescuers didn't discover until minutes later that there was a baby strapped in a car carrier in the front seat of the Explorer. After being pulled from the vehicle, the baby was not breathing and did not have a pulse. A medical team was able to revive the baby, but he was in critical condition and was later transported via Life Flight to Doernbecher Children's Hospital in Portland. On Thursday, Dec. 17, a grand jury indicted Gandy on a of charge of second degree assault, a Measure II crime that carries a mandatory sentence of 5 years, 10 months in prison if convicted. She was also indicted on three counts of third degree assault, three counts of recklessly endangering another, and charges of driving under the influence of intoxicants and reckless driving. A warrant was issued for Gandy's arrest, and she was taken into custody at her home in Grand Ronde. Gandy was transported to the Lincoln County Jail, where she is being held on $150,000 bail. Early Friday afternoon, Gandy appeared before Lincoln County Circuit Court Judge Charles Littlehales via closed circuit television from the jail. Attorney Alan Biedermann was appointed by the court to defend her, and she was arraigned on the indictment. Her next scheduled court hearing is an early resolution conference set for the morning of Jan. 4, 2010. Important Note: The author of this message may not be subscribed to this list.
