I have a question: If someone acquires information and even if it has been published by a gen soc........is there a problem with it being shared? If that person acquired the information from public records??

I really don't know the answer to your specific question, but I do know that Muskogee Gen Soc gave permission to LDS to publish "some" of our publications. I would think that LDS might have a problem with it too, this is posting their information also. Like I said before, MCGS, doesn't have a problem doing any kinds of lookups in any of our indexes, at all! But, at least for the society's sake, please don't post these, our publications is our biggest source for funds so that we might educate and promote genealogy through workshops, programs, seminars and meetings. A public record is a census record, marriage records, birth records, cemetery records when you survey the cemetery. A book or a film of a book is not public records. So when you are posting information that is a public record but when it is word for word from a book that was published then is stops becoming public records and becomes copyrighted. Did you know that if you post an obit that was printed in the newspaper, the newspaper has the copyright to the obit and you need permission to post it. This copyright situation is very serious. If you are transcribing from microfilm, you can post anywhere you want. Just because some else also has the same microfilm roll, does not mean they have copyright! I imagine that your postings are parallel or the same as what the society has printed off for sale. So they may have assumed you have taken your material from their phamplets or books. Same original material, same information. Maybe someone should have asked first eh?
