Does anyone have any information about Susan Caviness Dunigan, born about 1830-35 in Tenn? She settled in Ark. about 1838-40. We are looking for her mother's first name, either, Sally or Sarah, we think. Her last name was Mrs.Mitchell on Susan's death certificate. Susan died in Waxahatchie (sp.) Texas. What makes the story even more interesting is that Malinda's father, James Martin is listed on 1851 Drennen Roll and Henderson (Tenn.) 1835 Rolls. We don't understand how Malinda was denied. James's sister, Martha Martin, married John Ross Daniel and their son is John M. Daniel and he and his decendents are on the Dawes Roll. However, if I wanted to track down more on a person who died in 1979 in OK, I would do two things. I would write the State Dept of Health and request his death certificate for %10. They want the county and the date of death, and you seem to have both. I would also contact the library at Tahlequah and ask if anyone has done an index of obituaries from the local paper (Henryetta Library in Okmulgee Co. has such an index, which I've used. For a fee of $1, they've copied the mf page of the newspaper for me). If the answer is no, I would ask if anyone at the library would be willing to do a search of obituaries for the month of April. Or if anyone at the local genealogy club would do such a thing? Good luck.

Sandra, I found your post of Malinda Martin's petition to the Dawes Commission quite interesting. What a treasure trove of information for you. Was she denied on the basis of not living continuously in the Nation? Don't do it just for me, but if anyone else should request that you post her supporting petitions, please do so. One thing I was particularly interested in was the note about her brother moving her to Rolla MO during the Civil War. Does anyone on this list have more information about this "practice" during the Civil War? I've heard of families moving to Kansas, Texas, and Missouri. I'm wondering if there could have been some intermarriage or just plain old friendship development while in these other states that then led to "whites" moving into Indian Territory after the war. Ginger, I would be happy to post the 2nd two affidavits and answer your questions. Noah, moved his family to Mo, to the fact of having other relatives in that area. They were only looking for refuge till the war settled down. I believe that Malinda was denied as to not having proof of her heritage. Jerry, can probably comment on that. I am in hopes that she reads the post and gives an opinion as she is very knowledgeable. I also, believe that my Malinda may have pressed it. However, it just seems that she gave up. I have been told that if any of her siblings applied and was accepted, that this case would be opened up again. I do not know if this is true. 2nd Affidavit By C.L. Martin Petitioner. 1890 By Notary Public to the Dawes Commission. C.L Martin being duly sworn deposes and says I am the same C.A. Martin who makes application in the annexed petition for admission and enrollment as a citizen of the Cherokee Nation of Indian territory. In addition to the allegations of such petition affidavit states that he is the son of Ezekial Martin who was the son of Hunting Jim Martin who was the grandfather of affidavit. I have always been taught by my father and relatives that my grandfather Hunting Jim Martin was a Cherokee Indian by blood and lived as a member of the tribe in the state of Tennessee previous to the removal of the tribe west. And at that his name should be on the rolls of 1835 at about the time of the emigration of the Cherokees to the West. He came west between 1835 and 1842 and settled in the Illinois District of the Cherokee Nation where he lived and died as a citizen of the Cherokee Nation. My father Ezekial Martin enlisted at Ft. Smith, and went to the Mexican war in the infantry of this affidavit. When he returned he did not go back to the Cherokee Nation before his death which occurred along about 1856 or 57. This affidavit was raised in Arkansas but in 1890 he made application to the Cherokee Council for readmission as a citizen of the nation which application has never been acted upon or finally determined. That in support of such affidavits and testimony copies of which he did not keep and has not been able to obtain or substitute and the originals of which should be on file with the archives of the Cherokee nation. We therefore ask your honorable commission to notify and require the said Principle Chief and National council of the Cherokee nation to have and produce all of such original affidavits and testimony at the hearing of this case before your honorable commission. Subscribed and sworn to before me this 2nd day of September 1896. He further ask that his wife and children be admitted, on a 2nd paper. C.L. Jefferies being duly sworn deposes and says I am 50 years old. My Post office address is Tahlequagh. I am a farmer by occupation. I reside near Tahlequagh in the Cherokee nation. I am a recognized citizen and member of said nation. I am personally acquainted with Malinda Howard. I have acquainted with her since she was a little child. She is now the wife of H.C.Howard and resides in the Tahlequagh district Cherokee nation. Her maiden name was Malinda Martin. She was the daughter of James Martin. I knew said James Martin many years ago on Lee's creek in the Cherokee Nation. He was a half breed Cherokee Indian and a recognized member of the tribe. It was before the war when I knew him. He lived on Lee's Creek with his family I knew the affidavit then as a little girl. I think her mother was a white women. According to the best belief and recollection about the matter. I believe Malinda Howard nee Martin was born on Lee's Creek. Affidavit went north during the war and did not come back until it ended. I do not know what became of James Martin, but think he died there in the Cherokee Nation. The rest of this affidavit only states the facts that have been stated by Malinda Howard. The information in this packet is very helpful and has opened new questions, Malinda Martin gave the following information in her notorized statement to the commission. Malinda E. Howard Petitioner states that she is part Cherokee Indian by blood and was born and raised in the present Cherokee nation as a citizen and ask to be enrolled and recognized as a member thereof, and that the grounds for such claim for such claim states as follows: I was born on Lees creek in the Cherokee Nation, Indian territory in or about 1851 or 1856. Our family bible was destroyed and I am not exactly sure of the birth date. My father James Martin who was a recognized Cherokee Indian and member of the nation at the time of my birth and a resident of the said nation, My mother was a white women married to James Martin my father and we lived there on Lee's creek in the Cherokee Nation. My father died when I was very small, just a child. My mother's name was Melton before she was married to my father. We lived on Lee's Creek until the war and owing to the troubles of that time went north. My Mother also died before the war and I was very small, when she died. Both my parents died around the same time. or not far apart. My brother Noah Martin took me north with his family at the beginning of the war in 1961. We lived in Rollo, MO, during the war and at its close returned to the Indian territory in March 1866. In June of 1869, I was married according to the laws of the Cherokee Nation to William Hurt a white man. in the Saline District in the Cherokee Nation. I have always been recognized as a member of the Cherokee Nation and my first husband Hurt and myself were married according to that law and in compliance with its provisions in order to confer citizenship upon him. After Hurt and petitioner were married they lived in the Cherokee Nation as recognized citizens until Hurt's death in 1872. We owned farms. One on Gilstraps ferry and one on cabin creek, My husband ran a blacksmith shop at Gilstraps ferry and also owned the ferry boat for about 2 years. No one ever questioned our right or could they do so as citizens of the nation. A full blooded Cherokee preacher by the name of Shinning Frog note (I am unable to read this name clearly.) It looks like this name? performed the marriage ceremony for my first husband and myself at his home in the Saline District. I was married to my present husband H.C. Howard in 1874 and he was also a white man. We were married at Seneca, MO in 1874. My present husband was engaged in the patent right business and traveled a great deal and took me with him from place to place. After petitioners last marriage she was out of the territory a considerable portion of the time until 1890 when she with her husband has since constantantly resided in the Cherokee nation. A part of the time the petitioner was out absent from the territory was on account of the sickness and old age of the mother of said H.C. Howard who desired petitioner to stay with her in MO and part of the time on account of business and part of the time for health but petitioner at no time ever comptemplated making her permanent home out of the territory, but always considered the Cherokee nation as her home. My family consists of the following named persons. My husband H.C. Howard age 40 William Scott Hurt age 20 Lora Susan Howard age 21 Sam Howard age 19 Nola Howard age 16 John Howard age 15 Howard age 14 Eddie Howard age 11 Mabel Howard age 9 I have also three grandchildren. The mother of one of them is dead. Her mother was my daughter and the child's name is Arita Jackson age 13. The other two grandchildren are the children of my daughter Lora Susan married to Fate Todd. And living in Muskogee. I.T. Myrtle Todd age 3 Vira Todd abt 15 months. My present post office is Wagoner IND. TER. Petitioner therefore asks that she and the above named children be enrolled and recognized as citizens of the Cherokee Nation and petitioner will pray for ever. I do not know what the connection is other then he is filing with her and somehow James Martin and this Hunting Jim Martin tie together. James Martin was born in VA though.
