Mind you, I have not seen anything that I wanted to use, but I am curious about the application of law here. As I see it, this material is a derived work originally belonging to the Athens Messenger. It is obvious how they would have legal right to the material. Paragraph 103 (b) of current copyright law states �The copyright in a compilation or derivative work extends only to the material contributed by the author of such work, as distinguished from the preexisting material employed in the work, and does not imply any exclusive right in the preexisting material. The copyright in such work is independent of, and does not affect or enlarge the scope, duration, ownership, or subsistence of, any copyright protection in the preexisting material.� Basically, I am curious about these entries that have been extracted from the Athens Messenger. How does the copyright lay with the OHGALLIA list and not with the Athens Messenger? Please understand, I am interested in your application of law and not the material. Thanks. [This article was transcribed without making changes to spelling or grammar.] Athens Messenger December 8, 1887 GALLIA Gallia county has 450 pensioners who received $52,000 from the Government. The houses of Hamilton Thomas, of Point Pleasant, was burglarized, on a recent night, for the fourth time in a year. P. T. Wall, one of the editors of the Gallipolis Journal, slipped on the pavement in front of his residence, one night last week, and broke his leg. The fact would seem to be fully established that tin ore of fine quality and in practicably inexhaustable (sic) quantity exists in a certain locality of Gallia county, in the Ohio river, were active operations for mining it have been entered upon. A little daughter of Mr. Jas. M. Mills, of Gallipolis, had a piece of candy lodged in her windpipe recently and in spite of all efforts to relieve her became so far suffocated as to be thought dead, her father however as a last desperate effort to save her thrust his finger down her throat and succeeded in removing the obstacle and restoring her breathing after the spark of life was supposed to have fled.     2. That Island now known as Blennerhassett Island was once known as Backus Island. And has ties to Gallia County History. From the Recollections of the First Settlement of Ohio: Joseph Baker page 38. "Elijah Backus Esq, a native of Norwich, Connecticut, brother in law to Mr. Woodbridge, he was a learge (sp) Land holder and principally engaged in that business. He established the first printing press in Marietta and Edited a paper for some time (he subsequently was a member of our State Legislature and appointed one of the first Trustees of the Ohio Univeristy) and removed to the West." Footnote: "Elijah Backus, 1759-1812; born Norwich, Connecticut; graduate Yale; to Marietta 1790; purchased island in Ohio River later known as Blennerhasset Island, 1798; editor and owner of Ohio Gazette and Virginia Herald, 1801-1808; removed to Illinois 1808." Article from Parkersburg Press: "The Island...first surveyed 297 acres. It was first entered by George Washington in 1771, in connection with the large tract now known as Wahington Bottom. Not surveyed at that time and the occurrence of the Revolution prevented his procuring the necessary patent. The first survey was made in 1784, although the first land warrant was issured in 1780. Patrick Henry, Gov. of Virginia, gave a patent for the island to Alexander Nelson, of Richmond, in 1786. Its ownership was obsure until 1792, when James Herron, of Norfolk, Virginia sold it to Elijah Backus, of Norwich, Connecticut, for 250 pounds, Virginia currency, or $883.33. From this owner it received the name of Backus Island, which it retained until 1798, when Harman Blennerhassett purchased 170 acres of the upper portion, for $4,500, and accompanied by his wife and one child, took up residence there, when it became known by the name it still retains." From History of Washington County: "In 1807, shortly after Elijah Backus went to Kaskaskia, Indiana Territority, he sold the lower island to Aaron Waldo Putnam of Washington County, Ohio. Giles himself has not been living there much. Last week he came home and deliberately nailed his wife and children in a room of the house. He then proceeded to dismantle the home of its furniture and carried it away. The father of Mrs. Sisson, followed him, and by the aid of such argument as is to be found at the mussle (sic) of a shot gun, persuaded him to return the goods and chattles (sic), and then Giles left for parts unknown, promising never again to tread the ??? in Gallia. One morning last week, Mr. Tobin, of that place, arose early and went to work, leaving his wife, Mrs. Lucinda Tobin, in bed. After the departure of Mr. Tobin, John Butcher entered the house, and got in bed with Mrs. Tobin, while she was yet asleep. It is called Raccoon Island. The Providence Baptist church, in Clay township, Gallia county, on the Swan Creek road about one mile from L??per Post-office was destroyed by fire on a recent night. The Gallipolis Journal of last week says: James Foster and Rufus Syres saw a snake out on Bullskin which they represent as being about the size and length of a wagon tongue.     3. Debra, You need to go back there to visit if at all possible. The State of West Virginia has made the area into a State Park and has been able to collect some of the originals. There is a museum there also. You take a boat to the island from Parkersburg. It is a great days trip. Around that area many people know about it. School children know about it also and use it for history projects. My granddaughter won first prize in state history projects with her Blennerhassett project. Much history to be gathered there. You can get a lot of web sites by typing in and searching Blennerhassett. More has been done since I was there a number of years ago.     3. What's weird, though, is that no will is listed for him. That's why I'm wondering if he may have left the area. Only one of his children appear in the census there in 1850. He is in the 1840 census, but seems to have dropped off the face of the earth after that. I know he was married just after the census was taken, but I can't even find his widow anywhere. He may have died before 1850. We did find some of his children, living other places with relatives. But I would really like to know what actually happened to him.     3. Would someone please tell me what happened to the Genealogy Society. There is a new address listed and a phone number at the bottom of my rootsweb. I called the number and reached a private residence, the Brown residence. I hope that this is corrected so that the Brown family does not have to change their phone number. I hope that this was not the work of a "hacker" to create a nuisance. Please advise how to relay this message to the list manager, he sent a very nice note during the holidays but I must have deleted it and do not have the address. Denise Ashleman

    3. The Gallia County Genealogical Society, OGS Chapter's monthly meeting will be held at the Society office at 412 Second Avenue, Thursday, March 10 at 7:00. There will be no program this month as we will be finalizing the plans for the "Gene Fest" to be held in June. We will also be working on plans for the First Family/Civil War Societies banquet to be held October 8, 2005 at the Grace United Methodist Church. A broken rail caused four cars to tumble from the trestle on the Columbus, Hocking Valley & Toledo railroad near Gallipolis last Saturday morning. The cars were badly broken up. Moses Baker, of Gallia county, is under bonds of $100 to appear before Common Pleas Court to answer to a charge of whipping his daughter, aged seventeen. The girl had a beau Moses did not like, but instead of threshing him he threshed the girl. The Gallipolis Journal says this: A Gallipolis gentleman going home discovered an infant's napkin hung in a conspicuous place to dry. Complaing (sic) to his wife for this want of propriety, he was silenced with the reply: "Hush up! this is the flag of our union." Transcribed by Joyce Robinson

    3. Robert H Houck was the son of John E Houck who was a brother of my gggrandfather, Gabriel Houck. John E and Gabriel were sons of Valentine "Felty" Houck and Prudence Pritchett (Prichard, Prichart, Prickett). Prudence was the great granddaugher of Jacob Prickett, Sr, a frontierman from what is present day Fairmont, West Virgina. You, being one of his descendents should visit the restoration of his home, "Prickett's Fort". Loss $1,200. The twenty-fifth anniversary of the signing of the proclamation of emancipation was celebrated at the camp grounds at Vinton, Gallia county, last Thursday with an immence (sic) gathering of colored people from Gallia and adjoining counties, notably the points along the Ohio river. Speeches were made by Governor Foraker and General Grosvenor.

It is to be composed of 177 delegates, or, one for every ten votes cast for John McBride for Secretary of State. There is one peculiarity about the ores discovered of late years in Southern Ohio, the metals can't be gotten out of them. Gallia county discovered the richest tin ore in the world, but for some reason no tin can be gotten out of it. Washington Swisher, aged 54, a farmer near Cheshire was attacked on his farm last Friday and so shockingly gored by a two-year-old Jersey bull that his death was anticipated as a result. The enraged animal pinned him to the ground, broke his collar bone twice, ripped him up the side from the hip to the shoulder, broke one rib and tore two others loose at the backbone, ran his horn in his side and forced it out six inches further up, and otherwise bruised him from head to foot.
