Hi As I read the material in your message, this is the story I get: Benjamin Tompkins died sometime before April 1929. His wife's name was Sarah. They had five children: Margaret, Edward, Lewis, Sarah and Benjamin. The last four children were all minors. After Benjamin died, the court appointed William Coffee to act as the legal guardian for the minor children. [He could be a relative or family friend. There may have been some legal reason for a male to be the legal guardian or Sarah may have declined to be the guardian of the minor children. It should be in the Chancery Court Records when the guardian was appointed.] Any property owned by the deceased (assuming that he died without a will, which is called intestate) would be sold and the proceeds would be divided as follows. The wife, Sarah is entitled to her dower rights, which is probably one third of the estate. Each of the five children would share the remainder in equal portions. Where property is involved, one approach used was for one heir (or the administrator) to file a suit called a Petition For Partition, which is a request for the court to give permission for the administrator to proceed with the property sale and an inventory of all assets involved with the estate. This is a standard legal procedure used to settle an estate where there is no will. According to the petition Benjamin owned a lot in the town of Belmont. The lot needs to be sold and the proceeds divided between the heirs (his wife and children). Margaret was evidently the oldest and married to Daniel McVicker. She and her husband may also have been the administrator appointed by the court. They were the ones who filed the Petition For Partition court suit to get the estate settlement under way. Hopefully this gives you some insight into what the information is in the Petition For Partition. In a lot of cases of early settlers, it is the only instrument available to identify the children of someone who died without a will. He removed to Ohio in the fall of 1799, and settled at west end of what is now St. Clairsville. Only one house - a cabin - in St. Clairsville at that time. Here he farmed and worked at his trade. He went a few years after coming to Ohio, to Owl creek, in Tuscarawas Co., I think, with a view of buying land and moving his family there. He bought some land - entered it, perhaps - but never moved there. The whole company, for there were several of them, got the ague, and were glad to get back. Father's horse while on the way home, got mired in a swamp. They made a track with bark, etc. for father to get out, but the horse had to be abandoned. It was never rescued, but perished in the deep mud. When they started to Owl Creek they took their camp-kettles and depended on killing game for food. Plenty to live on. When father first came to Wheeling, he arrived with family on Saturday night and could buy no food. Old Ebenezer ZANE would sell no meat on Sunday, so father crossed the river into Ohio and killed four nice wild turkeys. ZANE had reproved him for not laying in a supply of meat on Saturday. When father had killed the turkeys he dressed one and sent it to ZANE, who accepted it, and after that had nothing to say to him about violating the Sabbath. He was reproved also by some Scotch Presbyterians who insisted on keeping the Sunday strictly. Father a few years after his return from Owl Creek, began keeping store in St. Clairsville. It was now called St. Clairsville. Father and old James CALDWELL, who had moved over from Wheeling, were in partnership. They started together in the store; it was started before I was born, which was Sept. 25th, 1806. Don't know how long before. Kept dry-goods, groceries, hardware, etc. They brought goods from Baltimore and other eastern cities. They bought in ginseng, snake-root, homemade linen in large quantities. Many came from Sunfish and Woodsfield country. The produce gathered in took up a large amount of room. "Sang-noes and little sacks." Father was elected to the Legislature while yet living in St. Clairsville. I recollect he brought me a doll from Chillicothe. He was in the Ohio Constitutional Convention. Father had blue eyes, was of fair complexion, with light, darkish colored hair, not a Roman nose, but thin, and only of moderate size. He went smoothly shaven. Height six feet. He was not corpulent, or "fleshly." Would weigh over 200 lbs. stout, and capable of much endurance. Was of plain dress. His father and mother were Quakers, and also his wife. All Quakers full blood. Father would say "thee" and "thou." Was a Free Mason. Was of a cordial, friendly disposition, which made him popular. Was a man of great hospitality. He had been a Democrat, but became a Whig prior to Jackson's being a candidate for President. Became a Whig, I think, before the war.

David Grimes born 1818 in Md., married Mehaly (?) b. 1821 in Ohio children: Noah b.1844, Helen b. 1846, Thomas b.1849 all in Ohio Does any one have any connection to any of these people. Hi, Saw your post on the Huff's. I have been looking at Samuel as a possible son of my Phillip Hoff ( b. Circa 1743 d. 1796 ) of Loudoun Co., VA. Another Hoff/Huff in Belmont that is possibly Samuel's brother is Lowry Huff. The names came from the census that had anglicized the name to the English Hough and from court records. Here are some notes I have on the two from those records. Lowry Hough b. circa 1778/1782, d. after 1820, possibly in Belmont Co, OH where he had been residing. The relation ship is based on a lawsuit by Mary Miller against Philip and Lowry jointly. Lowry had previously been sued in 1806 by the French Flowerie. In 1810, he was in Loudoun Co with an apparent wife and four probable sons. In 1820, he was in Belmont Co, OH. It is possible that Rosanna (Rosina) was with this family in 1820 as a female over 45. Mary Miller who in 1807 sued Henry and Lowry Huff jointly might have been a sister to Lowry and Phillip, who was by that time deceased, being sued via his estate. Lowry might have been his executor. Samuel, b. between 1780 and 1790, d. after 1820, was in 1820 in Belmont Co, OH, along with Lowry Hough. The census for that year showed 011101-10001. He was not identified as Huff earlier in Loudoun Co, VA, so may not be related but it may have been a similar mistake as that of Lowry in Belmont Co., OH. He also may be a cousin as there are other Hoff families in Loudoun at that time besides Phillip. I know the evidence tying Samuel to Phillip is pretty slim and based on their being a relationship between Samuel and Lowry and then a lawsuit relating Phillip to Lowry but I am looking for anything that will prove or disprove it. This virus is a very common one, and has been making the rounds for months......because of the genealogical lists that I am on, and the various addressbooks I'm in, I would suppose that I received it 60 or so times, before doing something about it. Here's what to do to keep from ever receiving it again. Go to your tool options, on your email page. There may be a difference in options, but select the one that allows you to make "rules" that govern your incoming mail.....this is the same way in which you can block certain incoming emails. In my toolbox it is called the Inbox Assistant, but mine is an older computer.......regardless, when you get the form , place in the >From Box HaHaHa...then check the box that says "delete from server". This will keep ANY email from HaHaHa from EVER being allowed into your inbox, and you'll never see it again. Whenever I hear of an actual virus going around (such as the one last month about the Olympic gymnast), I make the same kind of "rule" in my Inbox assistant, and prevent it from ever getting to my inbox. It's not difficult to do, and sure saves headaches. Augusta Pequignot They had 5 children, and my dad was one of them Eugene August Lingo We do not know anything about Almira, Satira,,,,,,, or the Elizabeth listed here. I am descended from Stewart and Minerva Tonguet who were living in Belmont County, Richland Township, and were last found in the 1900 Census. Stewart was 79 and Minerva was 66. In particular, I am looking for the Date of Death and Place of Burial for Stewart Tonguet. I have quite a bit of information and would be happy to exchange information on this family.
