This couple married in 1862 West Alexander, PA, but did not live there. They lived in Marshall Co. and Ohio Co., WV before moving to Belmont Co in the 1880's. Samuel B. SMITH was a CW Vet. Children of this couple: Anna - b 1864 Venora Henrietta "Nora" - b 1866 WV - m. Elsie CRISWELL Margaret - b 1868 Harriet - b 1869 Edward - b 1871 - m. ?Rose? ?surname? Effie - b 1873 Charles - b 1876 Alvin - b 1877 Mary Ethel - b 1882 OH - m. William EDWARDS Am still trying to find out the parents and siblings, if any, of Margaret Ann SCHOTT/SCHUTT/SHUTT SMITH. I've found a SHUTT family in Belmont Co on the 1850 Census with parents John and Catherine and these are the names I have as possibly the given names of Margaret's parents and there is a son, Henry, and a dau "Martha". I wonder if possibly this "Martha" is actually my Margaret - the age is right as is the birthplace, PA. I also have been coming up empty for additional information on the children other than "Nora" SMITH CRISWELL and Mary Ethel SMITH EDWARDS. I have a possibility for Edward SMITH on the 1910 and 1920 Belmont Co Census, but am not certain - nothing for the others. Any and all clues welcome. I don't know how long they lived there, but by 1840 at least they are in Belmont Co, OH. They are also in Pease Twp, Belmont Co. on the 1850 Census, and by 1860 they are in Marshall Co, WV.     3. My surnames connected to Belmont Co.,OH. are: Windham/Windom,Card,Bowie & Drake. George Windham & Mary Card moved to Belmont Co.from Loudoun Co.,VA. before 1813. They were orginally from MD. They had 11 children. I descend through their daughter Meriah"Maria" who married William Bowie on 30 June 1820 in Belmont Co. At this point I have no idea who Mary Card's parents were as well as William Bowie's parents. William Bowie was born in VA. in 1791-2. Those are brick walls for me. My Grandfather Drake's first cousin was William Garfield Drake. He died in Belmont Co. in 1971. He had 2 wives & 17 children. Anybody know these families please contact me. Thanks! The name is sometimes spelled McGaughy, and the family seems to have come from Harford Co, MD with a number of other settlers. There is a small cemetery for the family in section 10 of Smith Twp. on farm land that was originally theirs. William moved to Belmont Co., OH in 1810. He served in the War of 1812 from Ohio, private in Capt. John Howell's company of infantry, 1st regiment, Ohio militia, served 3 SEP 1813 until 2 MAR 1814. William's son James Gordon McGaughey b. 1828 d. 1900 m. 1848 Hannah Jane Street b. 1827 d. 1906. My great-grandfather is James' son Hiram Clark McGaughey b. 1858 Belmont Co., d. 1911 Chandler, OK. I am having trouble locating the family prior to moving Belmont Co., and also am not able to identify the parents of Ann Boyd, but she is likely the daughter of Cyrus Boyd, of Goshen Twp.     3. You might check with the recorder's office at the court house to see if they owned land. Often the family tried to keep the land so check for several years after the deaths, Often there was a fight and a partition action was filed, or if there was a guardian for minor children, they may have had to sell the farm to support the kids..     3. The death record ( one line across two pages of a large volume) would be in the county in which he died.. Since you have a date and wife was living in Cincinnati, you might check the Cincinnati paper, than back in Belmont Co. where they resided previously. Just some thoughts. Sometimes there are two different indexes for estates--testate (with a will) and intestate (without a will), but more often they are listed in a "General Index" along with guardianships and other types of cases presented to the Probate court (adoptions and insanity type of cases may be sealed but may be listed in the index) If you write and ask the clerk to check for a will, most of the time they will check the indexes--but if they find an estate without a will and you're asking for a will, they say "NO"--No will. So always ask to see if there was an estate filed and that if there is a will, and tell them that you'd like a copy, if not then you'd like the "next of kin" paper. (usually a next of kin is filed in both cases, but it appears from my research, that if the "next of kin" was not living in Ohio they were not required to be listed...actually saw several instances where they had been listed and crossed out).     3. When doing a roll call, or posting ANY query, we need to place the actual subject in the subject slot. Remember, the name of the game is to get those names of ours 'out there', anywhere we can. Many folks surf the rootsweb archives, reading those that catch their eye or have names of interest in the subjects.....anddon't bother with all those with 'non-subject' subjects like roll call, genealogy, or brick wall. Many are also on lots of these lists and delete all postings without specific subjects ..... the ideal subject line has a full name and date, even if an approximate one.

There is not reason to think that these two folks had wills and they were destroyed in some way.......it's just likely that they left no wills - many didn't - and there would be no probate if there was no will. There might have been administrative papers, in the case of the person who owned property/land and died intestate....in that case the estate was taken before the court and determination and distribution was made by that court. However, when a person didn't own a great deal, especially those that didn't own land, there was no real reason for a will. After all, if the wife and children agreed on and knew what 'Pa' wanted in the disposition of his personal possessions, there was no reason for a will...     3. Have you checked into Quaker records for this family? Looked for his death record and obituary? I think several of the County histories have MERCER articles in them. I also have MERCERS...from Va. to to Muskingum Co. Ohio abt. 1820 (this area later became Coshocton Co. I believe) Samuel Mercer married Eustacia/Stacy/Tacy Holloway in 1825 in Coshocton Co. Ohio. FYI--There was one of those "scams" r.e. the Mercers about 1920 and there was a lot of unproven genealogy gathered at that time. Carol My brick wall is William Mercer born in 1824 Washington Co. PA.
