Ex County Auditor L. M. Hipsher, one of the party defendants in the injunction proceedings brought several months ago by Prosecutor John H. Clark to stop payment on a steel bookcase ordered by the county commissioners of B. F. Wade of Toledo, filed an amended answer and cross-petition Saturday through his attorneys, Crissinger & Guthery. Hipsher admits that B. F. Wade and the commissioners entered into a contract, May 13, 1905 for this purchase of a steel bookcase for $1,249, and asserts that Clark had full knowledge of the contract within a few days after it had been made, yet he permitted Wade to complete the contract, and the commissioners to accept the bookcase and to pay for it without a word of protest until after the voucher had been issued. If the bookcase was unnecessary now, Hipsher asserts that it was unnecessary at the time the contract was made. If the price was excessive, Hipsher states, Clark knew of the fact, and despite the fact that he was the legal adviser of the commissioners he permitted them to consummate the contract. If the controversary is not soon settled Marion County taxpayers will have more court costs to pay than the original bill for this case amounted to. Careless Hunter While Mrs. James Veley living north of Delaware, was attending to her household duties last Friday morning, she heard the report of a gun near the house and a lamp on the table she was working at was shattered, the charge of shot having came thru a screen door.
