COMMON PLEAS COURT Judge LOWRY held court Thursday, Friday and Saturday of last week and Monday and Tuesday of this week. The following cases were disposed of: In the case of Francis STORER et al vs Sullivan MAXWELL et al, verdict having been rendered April 30th sustaining the will, will come up for hearing Saturday the 17th on motion for a new trial. The case of William HELBER vs the H.V. Ry for damages, has been deferred until Monday, May 19 on account of the death of Attorney Clem WRIGHT's mother. In the order of the distribution of the proceeds of sale in the case of James M. MELDRIM vs Belle C. HYSON, leave was granted George FOX to withdraw his answer to the application of Belle C. HYSON for homestead. The balance for distribution was $836.38, distributed as follows: First, 6.36 additional cost to be paid to Clerk of court; second $500 to be paid to Mrs. Belle C. HYSON in lien of her homestead; third: the residence to be applied on the judgment lien of George FOX amounting to $330.02; fourth: that the sum of $201.35 be paid to H.M. WHITCRAFT on his mortgage clim out of the $500 herein set out to Mrs. HYSON. Hearing on demurrer in the case of Edith Alma WOLFE vs Katherine TOM will be argued today. The case of Henry FAUBLE vs William BRANDT, auditor, for injunction and equitable relief, will be heard on demurrer, Saturday, May 17. In the case of S.S. RUBLE vs Minnie McBROOM for money and foreclosure. The answer of Minnie McBROOM and Allen R. McBROOM was withdrawn. Judgment rendered and order of foreclosure and sale if judgment is not paid within five days. In the case of Christina DEFENBAUGH vs George HARTSOCK, for partition, rents _________ profits and conversion of timber partition was ordered and Harvy WAGNER, Joseph N. CAVE and Samuel EBERST were appointed commissioners and all questions as to rents and profits reserved for further considerations. In the case of Emaline STITT vs James STITT for partition etc, an order of partition was entered and J.S. BLOSSER, Thomas B. PARRY and J.W. TOM were appointed commissioners. Questions of rents for further consideration. Anna R. KINKADE was granted a decree for divorce from Frank KINKADE and defendant ordered to pay plaintiff $200 alimony. The bond of Mike JUBRIC indicted for carrying concealed weapons, was forfeited. The bond was for $100. D.M. SOLIDAY is surety but he loses nothing as JUBRIC put up the $100 to Dan for surety. Frances STORER was given $15 and the costs and to stand committed to the workhouse until fine and costs are paid or she is otherwise discharged. Wm. CALL indicted for keeping a disorderly house withdrew his plea of not guilty and entered a plea of guilty and was given a fine of $100 and costs of prosecution and the place ordered abated within ten days and stand committed until fine and costs are paid. Joe DECAPIO plead guilty to keeping place in violation of Township Local Option law, was fined $50 and given 60 days at workhouse. The workhouse sentence suspended on good behavior.
