Ex County Auditor L. M. Hipsher, one of the party defendants in the injunction proceedings brought several months ago by Prosecutor John H. Clark to stop payment on a steel bookcase ordered by the county commissioners of B. F. Wade of Toledo, filed an amended answer and cross-petition Saturday through his attorneys, Crissinger & Guthery. Hipsher admits that B. F. Wade and the commissioners entered into a contract, May 13, 1905 for this purchase of a steel bookcase for $1,249, and asserts that Clark had full knowledge of the contract within a few days after it had been made, yet he permitted Wade to complete the contract, and the commissioners to accept the bookcase and to pay for it without a word of protest until after the voucher had been issued. If the bookcase was unnecessary now, Hipsher asserts that it was unnecessary at the time the contract was made. If the price was excessive, Hipsher states, Clark knew of the fact, and despite the fact that he was the legal adviser of the commissioners he permitted them to consummate the contract. If the controversary is not soon settled Marion County taxpayers will have more court costs to pay than the original bill for this case amounted to. Being left an orphan in early youth, he endured hardships and made a brave struggle for an honorable livlihood. After spending a short time on the farm with an uncle in Iowa, he returned to Ohio and by hard work earned a sufficient amount of money to enable him to get an education. He went to Oberlin College and took a business course. Being thus equipped, he entered the service of the hocking Valley R. R. Company in 1881, and soon became a trusted employee of that corporation. He had charge of the station at Prospect for 24 years, and with painstaking care discharged every duty and responsibility of his office. No discredit mark was ever charged against Ray Gilmore during all those years of hard and honorable service. A record of devotion to duty and exact fulfilment of obligation, of which any man has reason to be proud. In 1878 he was united in holy wedlock with Mary Reese of Delaware Ohio who was to him a devoted and beloved wife, "the good angel," as he told me once, "that hover about his fireside." About a year ago the first serious signs of sickness -- anurism of the heart -- showed itself, and he was compelled to relinquish his work, absolute rest being enjoined upon him. It was during this period that the Lord laid his hand upon him mercifully and graciously, Being shut in to himself, he saw, more than ever before, the need of his own heart, which cried for the living God. Then began the struggle and triumph of faith -- that faith which rejoiced in the exultant exclamation: I know that my Redeemer liveth; and because He lived, I shall live also. On March 5, 1905, he made a public proffession of his faith and was baptized and received into the membership of the Reformed Church. We have many reasons to believe that to his end he steadfastly grew in grace and in the knowledge and love of God in Christ Jesus. he died November 8, 1905, aged 47 years, 10 months and 21 days, leaving besides his wife, one brother, Frank Gilmore of Columbus, Ohio and a sister, Mrs. Durban of Fredricktown, Ohio, and a large circle of friends who mourn his untimely departure. His earthly remains were laid away in the beautiful cemetery near Prospect, the funeral service being conducted by his pastor, Rev. C. M. Schaaf D. D., assisted by other ministers of the town. C. M. SMITH, prominent physician and former society favorite, charged with the first-degree murder of his first wife, Florence Cavileer SMITH, will be called Wednesday. It promises to rank with the RICHESON case and the HYDE sensation. The central point of dispute now is for an analysis of the organs of the dead woman by a neutral expert in the presence of representatives of both the state and the defense. Experts for the state show the presence of deadly cyanide. So far the defense has lost every skirmish, including the motion for a change of venue on the ground that the 70,000 people of Clark county are so prejudiced against the defendant that a fair trial is impossible. There seems to be a disposition on the part of the new judge, Francis M. HAGAN, to try the case at once. SMITH has paled under his imprisonment and has lost some flesh. The pitiful sight of his aged invalid mother visiting the jail to see her only son is witnessed frequently here. She is accompanied by SMITH's second wife, whom he married six months after the sudden and tragic death of his first. When Florence Cavileer SMITH died suddenly March 18, 1912, the community was shocked, for she was said to have been in excellent health. No suspicion was aroused until Dr. SMITH, October 1, married Miss Mabel MERCHANT at her former home in Newton, Mass. Miss MERCHANT for several years was a nurse in the local hospital, and she was called in many cases by Dr. SMITH. They were intimate friends before the first Mrs. SMITH died. October 16 the county officials ordered an examination into the cause of the death of Mrs. Florence Cavileer SMITH, and the body was exhumed. Dr. COONS, pathologist, reported that death was not caused by organic heart trouble, as stated by her husband, and also stated in the death certificate. A chemical analysis of the stomach is said to have revealed unmistakable traces of cyanide. ~ ~ ~ ~ ~ ~ ~ OH-Old-News ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ NewspaperAbstracts.com - Finding our ancestors in the news!
