Judy Weller The lad Adam CROWE, who is age nine years, appeared at the S.M. Court yesterday morning charged with wilfully placing an obstruction, to wit, a large stone about 30 lb in weight, on the railway line near the gasworks. Mr KENNEDY appeared for the accused, who pleaded not guilty. Evidence was given by Robert DURANT, engine driver, Sydney SYKES, locomotive fireman, and Detective KIRBY as to the circumstance of the train colliding with the stone, and the boy's subsequent arrest on suspicion, similar to the details of which have already appeared in these columns. Evidence as to the good character of the boy was given by Mr C.H. EDWARDS, Manager of the Gas Company, Miss R. CHEGWIDDEN, school teacher, and Mr A.H. HERON, Sunday school superintendent. The former said boys were in the habit of throwing stones on the line. The accused, giving evidence on his own behalf, admitted that he had placed a stone on the line, but denied that the stone produced in Court was the one which he had put there. Mrs CROWE, the boy's mother, and Elizabeth CROWE, his sister, deposed that the boy went home on the night of the accident about 5 o'clock, and did not go outside again. After Mr KENNEDY had addressed the Bench, pointing out that the evidence for the prosecution lacked corroboration, that malice had not been proved, and that in all probability this particular stone had been placed on the line by some other boy, Mr TURNBULL said, taking into consideration the boy's truthfulness and good character, and the doubt which existed about the stone, he would dismiss the case. At the same time he hoped this case would prove a lesson to boys who were known to be in the habit of placing stones on the railway line.
