Y., May 1 – Argument will be heard in the Appellate Court next week on the appeal from the order of Judge KOOGH setting aside the verdict and granting a new trial in the will fight for the $5,000,000 estate left by BAILEY, the circus man, of Barnum & Bailey. When Mrs. Ruth L. BAILEY, the widow, died a few years ago, her will was contested by her sister, Mrs. Anna J. HITCHINSON, who claimed that her brothers, Joseph T. and Theo McCADDEN, influence Mrs.BAILEY , their sister, to leave her an annuity of $10,000 a year while they inherited the major part of the millions.
