I am really confused now about this Joseph Schmerbach who arrived in America in 1879. By 1880 there was a liquor dealer with the name of Joseph Schmerbach located in Brooklyn, could that have been the same person and part of my family? Why does the family not appear in the 1880 Census, only the widow Margret Schmerbach appears in the 1870 Census, running a boardinghouse and living in Hastings-on-Hudson. What is irrefutable is the fact that in 1882 Joseph Schmerbach jun, born March 1856 in NY and baptized in May 1856 at the Roman Catholic Church of St. John the Baptist, was back in the village of Struth which is located in the present-day state of Thuringia, in the district of Unstrut-Hainich in Germany, where he got married and his first child, my grandmother, was born there in February 1883. Here is a short summary of what I have found so far: Joseph Schmerbach (originally Schmerbauch) emigrated to America in 1848; Naturalization in 1854 in the City Court of Brooklyn; He owned a boardinghouse in 66 Beekman Street NY; His 2. son Joseph jun was born in 1856 in NY; He moved with his family to Hastings-on-Hudson; He appeared in the U.S. IRS Tax Assessment Lists 1862-1866 as a retail Liquor Dealer; He died in April 1867; His children were: John b. 1852; Joseph jun. b. 1856; Louisa b. 1860; August b. 1862; I wonder now if there was more than one Joseph Schmerbach. Was there something else that you were looking for? I happen to have some folks in my tree that spelled the name as Birdsell but I do believe that they are all related and that Birdsell was just a variant spelling of the name. One of the people on my tree is Ellwood Birdsell Lowden and I believe he was named after his father's boss Ellwood Birdsell rather than being related to a Birdsell. But I could be wrong about that. One was born in 1876 and returned to Brooklyn in 1902. Born a US citizen. Notation says he was meeting his uncle Louis Fels (Fels could be short for a longer German name). This could mean that his mother did the notary thing to give her son's birth as a US citizen credence since the document mentioned that the priest who baptized him was affirming his US citizenship. The document might have everything to do with getting her son US legitimacy as a citizen. You didn't mention what year the son was born in. There is also a Joseph Schmerbach, born in 1860, who is returnng to the US but listed as a German. There is no notation of family members other than the fact that he was returning in 1879. This was before Ellis Island and they didn't ask the name of who the person was meeting in the US. If you know the son's birth year, it may help to narrow it down since this is an unusual name. There is also a naturalization index card for a Joseph Schmerbach dated Oct. 19, 1854 in Brooklyn. The witness for this card is Egnert Holzer. There is also a passport application for a Sophie Schmerbach on ancestry. This would mean she was a US citizen traveling to Europe or other countries. "Grandpa" Joseph was involved in the European Revolutions of 1848 and I have read that many Germans who fought for the Union during the War were 1848s. Joseph jun was born in 1856 in NY and 21 at the time of the affidavit.I don't know when he was send back to Germany, but I know for certain that his 3 boys, all born in Germany, were not called up in 1914 as the German law prefers "jus sanguine" and classified his male heirs as Americans. If the son was a minor at the time the father naturalized or born after the father naturalized, then he would have been a US citizen. This is a Federal Government web site as opposed to state or county web sites. If you don't find him there, check Google Books for "Annual Report of the Adjutant-General of the State of New York for the Year..." for the various rosters published by New York State for all of the various state regiments. One roster for the Sixth Heavy Artillery can be seen at the following web site. http://www.rootsweb.ancestry.com/~nywestch/military/sixth-artillery/index.htm On a county level, you should also check any history of the county of Westchester (i.e., Scharf's History has a chapter on the Civil War) or the surrounding counties and also look at any history written for the town.
