In the 18th Century the "English common law rule" was that each man was taxed on all of the land that he owned, wherever it might be situate, in the Township or Tax District in which he lived. The New York "quirk" to this general rule seems to be that the names of the members of the wealthy Dutch Patroon might be found on the tax lists of districts in which they had LARGE holdings as well as the tax district in which they also lived. >2. if someone is on that 1779 Cambridge district tax list as owning real estate is it common to not find any deeds in Albany or Ft Edward for them back to that year? > NO ONE IN NEW YORK STATE OWNS THEIR LAND UNTIL 1841, when the New York Legislature FINALLY abolished the medieval Dutch Patroon system. The people on the 1779 Cambridge District Tax List were all tenant farmers. Most to them possessed freehold leases, i.e. a lease for an indefinite time period, and therefore were legally capable of being recorded. However, because these instruments were leases and not fee simple deeds as the New Englanders were used to, they simply did not bother to record their leases. You will find some early conveyancing instruments that read like English common law deeds, but the legal effect of these documents is still a medieval Dutch freehold lease dressed up in English common law terms of art. Whether a tenant was required to pay the real estate taxes on the farm which he occupied depended solely on the terms of his lease. Very few of the leases from before the Revolution survive. Leases do not leave the paper trail that a deed does even though a tenant farmer could legally sell his lease to another settler. Howard Swain of the "Dutch Colonies mailing list" sent me the following e-mail after I had volunteered to do look ups in my newly acquired book, "Calendar of New York Colonial Manuscripts - Indorsed Land Papers (1643-1803)". Howard wrote: > I have never understood what these "Indorsed Land Papers" are and > how they relate or compare to other land records, such as those cited > by Stokes in his Iconography or those in account books GG, HH, II, > which were published as New York Historical Mss.: Dutch -- Land Papers. > > I have had good luck finding people I research in Stokes or the > GG, HH, II book, but not in this Indorsed Land Papers book. I have never seen, let alone used the books to which Howard refers. Has anyone on the Washington County mailing list had experience with the books that Howard cites? I am always looking for more potential sources of freehold leases for the Saratoga Tax District of Albany County, NY. Hope that this helps some. Leslie Potter

Just for general information, this was not the case here in Virginia. A person was taxed on land or personal property in the county in which it was located -- if he owned land or other personal property (e.g., in the south, slaves) in several counties he would be taxed separately in each place. The tax record would contain a note that he lived elsewhere. He would, however, only pay the poll tax in the county in which he resided. Kathy Liston

    1. deeds in cambridge
    2. Michael McAlonie
    3. Thank you Mike and Rose for clearing that up. I just found a site through google about a Col Lewis van Woert and it listed some early persons on the Cambridge patent, one of whom is also listed in the grantees section of one of the Abraham Lansingh deeds I was looking at. A Goldsbrow Banyer. In the below clip from that Van Woert site I found there is a Goldsboro Bangor listed as original settler on the cambridge patent. Must be the same guy. Recorded 25 May 1763. Noted:" 1/2 part of land as laid down for highways; also (illegible fraction) of land purchased by Goldsbrow Banyer" I guess this is the previous owner of the lots I am looking at. Thanks again, Mike "Cambridge embraces a part of the Hoosick Patent, <http://millennium.fortunecity.com/tulip/561/hoosac.html>which was granted on both sides of that stream in 1688, the principal portion being in Rensselaer county. About four thousand acres are included in Cambridge. The remainder of the town was a part of the Cambridge patent, granted in 1761 to Isaac Sawyer, Edmund Wells, Jacob Lansing, Wm. Smith, Alexander Colden, Goldsboro Bangor, and others, on condition that immediate settlements be made. The tract included thirty-one thousands five hundred acres, north of the Hoosick patent and extending up the valley, which took the name of the patent. "

    3. Based on the South Bay reference, my first guess would be on the east side of the Town of Hampton (in northern Washington/Charlotte Co.), near the state line with Rutland Co. (close to present-day Rte. 22). - So quite a ways north of Cambridge, even in the 1770s sense of the town boundaries. - Mike H. -----Original Message----- From: Michael McAlonie [mailto:[email protected]] Sent: Tuesday, May 24, 2005 1:43 PM To: [email protected] Subject: [NYWASHIN] deeds in Cambridge/ South Bay Charlotte County I have followed some Cambridge deeds (Cambridge lots 44 and 66) back to land sold by an Abraham J Lansingh (and wife Catherine) in the 1770-80s to some Mushets and separately to an Elisha Brewer. I am descended from John Rogers and Mehibitable Tefft Rogers through their son James Rogers and Amy Bronson and through their son Solomon Rogers and Aner Curtis. I have a question though....for those of you familiar with the area. I will have my laptop with me, and I have something I need to take care of on Wednesday--a responsiblity for which I need internet access and I have to be able to do it through my laptop since I have the program I use for this responsiblity is on my laptop. Since we'll be staying in a campground (any suggestions welcomed, but Fort Ann Campground is the one I'm planning now) I need to find someplace, like a public library, that will allow my laptop to connect to the internet. Is there such capability somewhere in the area? Our public library in my area of Springfield, MO has wireless internet access within the building. Right now we have high speed internet through a microwave tower and so I don't even have an access number to dial for modem, although I think I will investigate that possiblity. Thanks for any help. 3. I thought maybe I ought to also tell about my other WAshington County line. Amey L. Rogers married William L. Hunt in Washington County, NY. William Hunt's parents were Wiliam Hunt and Sycha Leigh. Both of them were supposedly born in Albany (1768 and 1770 respectively), but died in Washington County. All of my information from before Henry Harrison Hunt is from a Hunt cousin and I don't have any sources. I'd like to confirm what I have and learn more of course!
