    3. Hello This is turning out to be rather long. I don't know if this is actually an Ulster County query. I've taken long breaks when it comes to researching the SIMMONS surname. So, this time I thought that I would give Ulster County a try. (I'm writing from Europe.) (Jackie Towner, I sympathize with you. We're stuck in the same time period. I don't have a Sarah Simmons, though. Maybe we should compare notes anyway? You never know, something might click!) This is what I have: Coonrod Simmons b. 1768, NY wife: Catherine_________ b. 1778, NY (maybe second wife?) According to the 1840 & 1850 census they were living, in Walton, Del. Co. NY, among the household of Andrew Simmons (below). Andrew Simmons b. 1808, NY - d. bet. 1880-1890, Walton, NY 1st wife: __________ d. bet. 1846-1849 children: Lucinda, William, Albert, Eliza**, (son) 2nd wife: Catherine Rosa** b. 1833, Troy, NY children: Charles, James, Alonzo, Martha, Nelson, George, Julia, William, Clarence and three Mary Ann's. (**Catherine is listed as "Kate" on pg. 367 in the "Roosa" books from the UCGS. Eliza is listed as "Ellen" on pg. 366**.) I have more information on each of the 17 children. I've been trying to go back a couple of generations. I keep hitting thick walls. 1) I don't know where Coonrod or Andrew lived prior to 1840 or when they moved to Walton? (Lucinda was born in 1837, Walton??) 2) I have a copy of the deed to Andrew's farm. (Andrew and his immediate family were the only Simmons' in Walton at the time.) The farm was purchased by Henry and Charles Simmons in 1858. At this point, I have no idea who Henry and Charles are? 3) I don't know if this is the same Henry as in #2? A Henry and Catherine Van Valkenburg Simmons had a son named Andrew. According to the LDS site, THIS Andrew was "christened on April 11, 1809, in Kingston". The church is not listed. I know that it's a stretch, but would it be possible for someone to see if "My" Andrew was baptised in the same church in 1808? (Henry and Catherine's last name might be spelled "Semon".) 4) I have information about a Conrad Simon b. 1768, Rhinebeck, Dutchess Co. NY. His wife's name is Maria Kellerhaus. They were married in St. John's Lutheran, Manorton, Columbia Co., in 1796. I have five children listed for them with the youngest born in 1803. (The second child was sponsored by Andreas & Margaretha Pulver Simon.) It's possible that he could be "My" Coonrod. I haven't been able to prove or disprove this theory. I've seen Conrad's name spelled: Coonrad O Siemon and Conrad Simmon. (Andreas also went by the name of Andrew Simmons.) I hope that I've given enough information to grasp some new leads. The Surrogate Court is a good source if the decedant left any property. The death record in such files is highly unlikely to contain any information on parentage, but a will file can have very useful information on children and maybe siblings (if the decedant died with no children or a sibling might have been named executor, particularly if children were young). Establishing someone as a sibling to your ancestor then finding a death certificate for that sibling (if he/she died after 1880) can be very helpful in establishing parentage. Recent death records, those that are less than 50 years old, have access restrictions.   The Ulster County Hall of Records might be able to give you some direction as to gaining access to these records.  A will file, even without the parentage information, can be invaluable in stringing together clues. Even if something is in the public domain and not copyrighted, or out of copyright, and you would not be breaking the copyright laws (other laws? . . . perhaps) to say, . . . post extensive parts of it here, you still have a fair use question. At such times it is easy and safe to stick with the fair use rule - which is similar to Margaret Bailey's excellent copyright rule-of-thumb . . . "Fair use is when such use does not interfere with the sales the publisher can reasonably expect." For the non-profit publisher of genealogy, proceeds of their book sales go to further genealogical research, research which benefits many people and may not get done if unfunded. When a specific sale also benefits a bookseller (say, . . . me) the proceeds go to fund my bookshop and the extensive website of New York State history and genealogy books, and both the Ulster and Greene County NYGenWeb pages I maintain, as-well-as the books I publish on NYS history/genealogy. So, if the purpose of this list is to further our genealogical knowledge and to help us all with our genealogical research, then, in the long run, we are best served by observing the fair use rule to insure the well-being of the profit and not-for-profit organizations that help us.     3. I recently found a newspaper clipping about my grandfather, John Adam Grismer. Between the years 1878 and 1925, he made a trip to Germany for several months and upon his return "...His stay in Newburgh upon his return was very short, as he has several teams doing work in Kingston, and went to that place yesterday afternoon." I have no date when this occurred and was wondering if anyone would have any idea of projects that were occurring in Kingston, my guess is between 1878 and 1906 that a person would have 'several teams doing work'? I have no idea what projects would fit into this description. I guess I am asking for an educated guess. Does anyone have any ideas of how I could find this information? My research for him has concentrated in Newburgh and Germany. This article has come as a complete surprise. Thank you for any ideas or assistance you could give me. Marge

I just recently happened to find this wonderful website that included a lot of Dumond and Dumont (sometimes also DuMond and duMont) as well as my surname, Yeaple. Sometimes I am protective of the rights of those not represented on this list, and for the feathers I might ruffle . . . I meant no harm either. But it is a delicate balance to maintain fair use versus excessive use. It would be a shame if you never posted information to the list again. You could, for instance, post the information for, say - a specific Terwilliger query with no qualms. The Ulster County Genealogical Society would answer that inquiry with the same information. But, I believe to just post all the Terwilligers (and the other surnames) was excessive. And, yes - please assure everyone that the publishers of all the books I sell are fairly compensated.     2. Richard - Probably a "shame on me" for not checking your home page - - - But how are we researchers to know that a book is still in print from someone? If Genealogical Publ Co or Clearfield do it - and we are on their list - we will hear about it. Otherwise - with a 1934 Publ date - and a status of Clearfield reprint - unknown date - it is reasonable to guess that it might well be out of print - and full public domain. I am one of those who asked about Gravestones book availability - and now know that it is available. I wonder what other books are out there - ? ? Would it be prohibitive for you to occasionally post your catalog on the Orange and Ulster listservs - using that as occasion for a caution re extensive copying/posting. As for myself - I will probably not buy - but rather go to DAR or LC if I want specific reference. Since Gravestones is organized by cemetery - a current researcher who extracts all listings for a particular Surname IS adding something to the body of knowledge for that surname - and I feel that he/she should be allowed to share that with other surname researchers freely.     3. This post is meant only as general information, not as a comment on any posts which have been made. Over the years as a public librarian, I needed to come up with a very simple rule of thumb to illustrate copyright for my staff (and for my own use): "Copyright is being infringed when content is used in a way which would interfere with sales the copyright owner might otherwise make ." Copyright is very complicated, but as a starting point, this has served me well. It's not always an easy call to make, but sales are, after all, what copyright is about.
