Marcus Lyon, County Judge and Surrogate of said County The petition of George Miller of the town of Lansing in said county respectfully showeth: That Marada W. Miller of the said town of Lansing departed this life in the said town on the 8th day of July 1875 having previously duly made and executed her last will and testament. That your petitioner is the sole executor named in the said will. That the said deceased was a citizen of the United States. That she was at and immediately previous to the time of her death an inhabitant of the county of Tompkins and that the said last will and testament relates to both real property and personal estate. Your petitioner further shows that the said Marada W. Miller was at the time of her death the wife of your petitioner and that Frank Miller, Eugene Miller, Nellie Miller, Alice Miller and Willie Miller are children of the said Marada W.Miller and all of her children are all residents of the said town of Lansing and are all under the age of twenty-one years and that she left her surviving no other heirs or descendents. Your petitioner Further shows that he is informed and believes that the Surrogate of the said county of Tompkins has jurisdiction to take the proof of the said last will and testament and over the Executors thereof and powers granted letters testamentary thereof with all powers incidental thereof and that he desire that such proof should be taken and such letters granted and that such further or other proceedings in the premises should be had as may be legal and proper. Your petitioner therefore prays that a citation may issue out and under the seal of the court to be directed to the proper persons pursuant to the statue in such case made and provided requiring them and each of them at such time and place as shall be in said citation mentioned to appear and attend the probate of the said last will and testament and that such further or other proceedings in the premises should be duly had as may be requisite to the proving and said recording of the said last will and testament and the granting probate and letters testamentary thereof And your petitioner will so pray. Dated October 13 1875 George Miller (signed) AT A SURROGATE COURT, held in and for the county of Tompkins, at the office of the County Judge, on the 25th day of October 1875 Present Marcus Lyon County Judge and Surrogate In the Matter of Proving the Last Will and Testament of Marada W. Miller (deceased) An instrument purporting to be the last Will and Testament of Marada W. Miller bearing the date of the 25th day of June 1875 was produced in open court, and shown to each of the persons sworn as witnesses, as hereinafter mentioned. Tompkins County, ss: Gardner C. Gifford and Nianetta Ives being first duly and severally sworn, in open court, and being severally and duly examined, upon their several corporal oaths, each for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of Marada W. Miller, late of the Town of Lansing in the County of Tompkins, and State of New York, deceased. That the said Marada W. Miller deceased, did, in the presence of each of these deponents, subscribe her name at the end of the instrument in writing, which is now here shown to this deponent, and which purports to be the last Will and Testament of the said deceased, and which bears the date on the 25th day of June 1875. That the deceased, at the time of subscribing her name to the said instrument as aforesaid, declare the same to be her last will and testament and this deponent did thereupon subscribe his own name at the end of said instrument, as an attesting witness to the execution thereof, at the request of the said deceased, and in her presence. That the said deceased at the time of so subscribing her name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States; that she appeared to be, and deponent believes she was, of sound mind and memory and understanding, and not under any restraint, and as deponent verity believes, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument in the presence of the said deceased. Sworn before me, Garndner C. Gifford Marcus Lyon (sign) Surrogate Nianette Ives Which said Will is in the words and figures following, to–wit: I, Marada W. Miller, of Lansing, Tompkins Co. NY do make publish and declare this to be my last Will and Testament, that is to say- 1st I duly make nominate, constitute and appoint my husband George Miller sole executor thereof- 2nd- After payment of all my just debts and obligations I direct my said executor to purchase with rest residue and remainder of my estate, a farm which said farm is to be a house for my husband and children. My husband to have the use of the same until the youngest of my said children shall attain the age of twenty-one years where the same shall be sold by my executor and avails thereof divided as follows: My said husband to have one share, each of my children then living to have one share, and if any of my children shall have died leaving children then the children so left shall have one share. The above named share to my said husband, he is to have the use of during his life and at his death it is to be distributed according to the laws of the State of New York regulating the distribution of estates. My executor is to have the power to sell and turn into money any of my personnel property, the money to be invested as above directed except that my household furniture is to be kept for the use of my family so long as any of them may need the use of the same. The forgoing instrument was at the date thereof signed published and declared by the said Marada W.
