Tioga County Wills Vol. 3; pgs. 8,9,10 S.S.) The People of the State of New York by the Grace of God Free and Independent. To all to whom these Presents shall come or may concern- Send Greetings. Know Ye that in the Town of Elmira in the County of Tioga the Twenty Second day of May in the Year of [our] Lord, one Thousand Eight Hundred and Nine before Robert Lawrence Esq. Surrogate of the County of Tioga aforesaid, the last Will and Testament of Rachel Washburn late of the town of Owego, in the County aforesaid deceased, ( a copy of which is hereto annexed) was proved and is now approved and allowed of by us- And the said deceased having while she lived and at the time of her Death Goods, Chattels and Credits within the State by means whereof the proving and Registarery (Registry) the said Will the granting Administration of all and singular the Goods Chattels and Credits; and also the auditing, allowing and final discharging the account thereof doth belong to us.- The Administration of all and Singular the Goods, Chattels and Credits of the said Deceased any way concerning her will is granted unto Emanuel Coryell and Nicholas Munday Executors in said Will named they being by me first duly Sworn, well and faithfully to administer the same, and also to render a Just and true account of administration when thereunto legally requested---- In Testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed Witnesses Robert Lawrence Esq. Surrogate of said County at the town of Elmira in said County. The Twenty Second Day of May in the Year of our Lord one Thousand Eight Hundred and Nine and the Thirty Third year of the Independence of the United States. Robert Lawrence Surrogate [Annexed Will] I, Rachel Washburn, considering the uncertainty of this mortal life and being in sound and perfect mind and memory, blessed be Almighty God for the same. Do make and Publish this my last Will and Testament in manner and form following ( that is to say ) First I give and bequeath and devise unto my Daughter Elizabeth the wife of Henry Van dermark, and to my said son-in-law Henry Van dermark Ninety acres of the Land lying in the Town of Owego which I Purchased of Aaron D. Woodruff, Esquire to be held by them during their natural Lives; and after their decease I devise the said Ninety acres of Land to the children of my said Daughter Elizabeth and to their Heirs and assigns forever, And the residue of the said piece of Land which I purchased of the said Aaron D. Woodruff consisting of Seventy One Acres (over and above the ninety above devised) I give to my son, Henry Washburn during his natural life and at his Decease to his Children, and to their Heirs and assigns forever, And in order that there shall be no dispute relative to the division of the above lot of Land between my above named Son in Law and Son; It is my will and I do hereby direct that my above named Son in Law, Henry Van dermark shall take the ninety acres devised to him from the East or West side of said Lot which ever he many elect and his choice when made shall bind him and his Heirs, as well as my son Henry and his Heirs.- And I do hereby further direct and it is my will that my negro Girl Deborah, in three weeks after the expiration of my decease shall be set free and manumitted by my executors hereafter named, and I will and bequeath to my said negro girl Deb. the Bed and Bedding which she Sleeps on, to her and her heirs and assigns forever. And I further Will and bequeath to said negro Girl Deb. her Heirs and assigns a milch cow or the value thereof together with her wearing apparel. And Lastly as to all the residue and remainder of my personal Estate Goods and Chattels of what nature and kind soever I give and bequeath the same to Four of my children that is to Nicholas Schoonover Henry S. Washburn Catherine Munday and Elizabeth Vandermark to be equally divided between them and I hereby appoint my friend Emanuel Coryell and my grandson Nicholas Munday Executors of this my last will and testament, hereby revoking all former wills by me made. Tioga County SS- Be it Remembered that on the Twenty Second day of May in the Year of our Lord one Thousand Eight Hundred and nine, Personally appeared before me Robert Lawrence Surrogate of the County of Tioga, Hetty Coryell one of the Subscribed Witnesses to the foregoing Instrument of writing purporting to be the last Will and Testament of Rachel Washburn late of the town of Owego in said County Deceased, Who being by me duly sworn did depose and Say that she was present and did see the said Rachel Washburn Sign and Seal the said Instrument of writing and at the Same time heard her publish and pronounce the same to be her Will and Testament in the presence also of Willard Hunt, Charles Coryell the other subscribing Witnesses to the said Will and that they together with the said Willard Hunt and Charles Coryell Subscribed their names as Witnesses thereto in the presence of the testator and of each other- and that the said Testator at the time of the Execution thereof appeared to her to be of sound mind and memory- Robert Lawrence, Surrogate
