Baldwin, Surrogate In the matter of proving the Last Will and Testament of Robert McAleer, dec.d This being the return of the citation hereforeto issued in this matter, Alice McAleer Executrix and Michael Hamill executor named on the Last Will and Testament of Robert McAleer late of Hammond, St. Law. Co., deceased, appear and prove to the satisfaction of the Court by affidavits on file that said citation was duly personally served more than eight days before on John, James, Thomas and Andrew McAleer, and Abel P. The deceased was there quite sick, he conversed freely both times wit. (witness) Was there, word was left at wit. (witness) store by Michael Hamill, the brother-in-law of the widow for wit. (witness) to call at McAleer' house to draw his will, wit. (witness) went up for that purpose and several were there, wit. (witness) stopt in the field before he got to house, Michael Hamill was near the house and told wit. (witness) that the deceased wished to have his will drawn, not much was said, wit. (witness) went into the house and to the bedroom where deceased was lying, but wit. (witness) did not speak to him about the will, they conversed together but as deceased did not mention the subject of the will, wit. (witness) thought he would not and did not, wit. (witness) remained with him about half an! hour, nothing was said by the widow about the will, in two or three or four days after wit. (witness) went there again and Mr. Charles Forrester was at work at McAleer's and towards night he called at wit. (witness) store and told wit. (witness) that McAleer called him into his room and told him he wished to have wit. and Mr. Rattigan come up and draw his will, wit. (witness) and Rattigan went together to McAleer's and the deceased then spoke and asked if Mr. Butterfield was in the room, someone said yes, he then wished the others would leave the room, all then went out but wit. (witness) and deceased, deceased spoke and asked wit. (witness) if he understood drawing a will, wit. (witness) told him he thought he could draw one as he had a book of forms there, deceased expressed a wish to have one drawn, he did not say that his wife or Mr. Hamill wished him to make his will, he asked if it was necessary to make his will good to have something willed to all his heirs. Wit. (w! itness) told him he could not tell but if he willed something to each it would probably be good. Wit. (witness) took paper and pencil and took some notes of what he wanted drawn for a will. Wit. (witness) then drew up a will as now presented in Court. Wit. (witness then read it to him and said it was right, wit. (witness called in Mr. Rattigan and read it again in his presence , Mr. McAleer said it was right, Mr Donald was then called in and McAleer was raised up in bed and made his mark, after the will was signed he said that was his will and was right and he requested the witnesses all sign it, it was signed by the witnesses near the bed upon a stand and he could see them all sign, wit. (witness) is not sure whether deceased spoke to Donald or Rattigan about signing it, he asked wit. (witness) to ask them to come in and sign the will as witnesses, there was some conversation afterwards between James McAleer and his father, wit. (witness) says the will was drawn and executed he thinks on day later than the date he did not remember the day of ! the month then, wit. (witness) is acquainted with the widow does not know whether she is an alien or citizen. Sworn this 30th day of December 1852 before me Benjamin G. Baldwin Surrogate. (Signed) William W. John Donald of the town of Hammond being sworn says that he was acquainted with Robert McAleer late of Hammond in said County, discussed that he was present as a witness and did see him subscribe his name by making his mark at the end thereof to the instrument now produced and shown to witness dated August 25th 1852, purporting to be his last will and testament, that wit. (witness) was at deceased house and William W. Butterfield opened the door from deceased room and standing in the doorway spoke to wit. (witness) so that he thinks deceased heard and said that McAleer wished him witness to come in and witness his will. Wit. (witness) went in and saw said McAleer make his mark to the said will and his son James spoke and said he his father was always opposed to making his will, whereupon said McAleer replied that it was his will and it was all right, thereupon witness and said Butterfield and Rattigan all three signed their names to said paper as witnesses upon a stand abou! t the middle of the front side of the bed, and he believes said McAleer saw them all sign it, wit. (witness) supposed at the time was the request if McAleer that he should sign as such witness, and at the time wit. (witness) believes said McAleer was of sound mind and memory, not under restraint and in all respects competent to make his will. Sworn this 30th day of December, A. Baldwin, Surrogate (signed) John Donald The said witness John Donald being cross-examined by Mr. Morris, Counsel for the heirs, says he went to see Mr. McAleer and happened at the house when the will was executed, deceased did not request wit. (witness) to sign his will by saying anything to him. McAleer did not tell wit. (witness) that it was his will. McAleer was pretty sick but not very low, wit. (witness) think he died the next day, he was lying on his back, could speak well, thinks he could see the witnesses sign the will, but don't know as he did, when James McAleer spoke to his father, he said he thought he was forced to make his will, his father said no he was not. Sworn this 30th day of December A. D. 1852 before me (signed) Benjamin G.     3. I am looking for the following information. Any birth information other than date for Oliver Isaac Conner b. Sept. 8, 1843, St. Lawrence Co. Parents for Oliver were Charles M. Conner and Joanna Todd or Johnston. Does anybody have any marriage information for these two? I believe the Parents of Charles M. Conner may have been William and Sally Conner. Feb. 17, 1899 South Edwards Feb. 10, 1899- Last Saturday Mr. and Mrs. Judson J. Rice started for Newton Falls with expectations with expectations of a good visit with children and grandchildren, Mr. Joseph Ritz and family. Arriving just at dark or about 6 they found little Frank very sick. At ten o'clock Dr. Wilsey of Benson Mines came and told them he could not live. At 2 in the morning Dr. O.C. Hammond, of Fine, arrived. He gave them very little hope and at half past nine Sunday morning, Feb. 5th, 1899, he passed away. He was taken sick Thursday, in the night. The Dr.'s pronounced it Laryngitis. Monday morning, Mr. McLeod the undertaker of Fine, accompanied by the father, mother, babysister and grandmother and Mr. King, a liveryman, started for South Edwards, the home of the grandparents, 28 miles distant. Tuesday other friends gathered there at 9 a.m.. After a prayer and a few remarks by Rev. Warren of Fine, and singing by the Choir of South Edwards, we bore him to the cemetery, where we had to s! ay, "Farewell Little Frankie". He was 3 years old last September. Mrs. Ira A. Hammond, was staying with her grand-daughter, Miss Bertel Rice, while Mr. and Mrs. Rice went to the Falls, but the sudden news of the death of her great-grandson prostated her and for 3 days she was not able to sit up. The little one was carried in his coffin to her room, that she might see him for the last time. She has gone to her home now, but is far from well. The afternoon of the funeral the baby sister was taken sick and Dr. Taylor, of Edwards, was called. Her disease was pronounced Tonsilities. The Dr. was here 5 times but she is now pronouced out of danger.

May 12, 1899 South Edwards- Tuesday morning May 2nd, Judson J. Rice started out to his work about 7. He was going to draw manure and have the garden plowed for his son-in-law, Joseph Ritz. Their two places were near each other. His brother Wade helped to remove the box and they arranged boards on the wagon. He then went home. The first load was taken to the top of the hill. It is very steep, and he went around the road. But he had an extra steady horse about driving down hill and had driven down before. He seemed to have crossed and got ready to descend. He was alone. But his brother-in-law, Wincent Hammond, from his house saw there was some trouble, either the horse was frightened or something had broken and she strated down the hill. After she started he sprang on to the wagon. The boards came forward onto her, and she ran. He came down the worst of the hill and had turned her across back of the house, when he seemed to fly from the wagon. He went with much force and struck an apple tree. Hammond was soon there. He was doubled in a heap lying in a furrow and against the tree. Friends soon bore him to his home, where he lived five hours after the accident at 9:30, and died at 2:30. The horse got loose from the wagon and stopped at the old Starch Factory, but a short distance from the scene, Dr. Merkly of Edwards, accompanied by a doctor from Montreal, and O.C. Hammond, brother of the bereaved wife from Fine, were there. His skull was fractured at the base of the brain and an artery cut, besides smaller injuries. He was buried from the Church in this place. There were 50 relatives at the funeral. The church was finely decorated with flowers and all that kind neighbors and friends could do was done. Mr. McLeod, Fine, undertaker; Rev. Gale, Edwards, pastor; Our Home Choir Text, Isaiah 26,3. Singing, Thy Will be Done, The Golden Shore, and Going Down the Valley. He was born in this town and he has lived in this place 24 years last April. Married H.D.E. Hammond of this place 25 years ago come September. He leaves a wife and two daughters, Mrs. Ina Ritz of Newton Falls and Bertel aged 15 with her mother, one grand-daughter Hazel, and has gone to join little Frank, a grand-son, who died 13 weeks before and whom he seemed to mourn whith his whole heart. They now lie near each other in the church yard, and we hope nearer in heaven. His age 46 years. He also leaves and aged father and mother in Canton, two sisters, Mrs. C. Lampson, Brown's Falls, and Mrs. J. Parkel, Canton. two brothers, Silas at Brown's Falls, and Wade of this place. He will be missed at the church and Sabbath school by neighbors and friends. He was a kind son and brother, and loving husband and father. Note: Judson was the s/o Silas P. Rice and Lydia Schuyler, and was married to Helen Hammond, d/o Ira A. Hammond and Mary Ann Stuart. His children were: Ina Rice who was married to Joseph Ritz and Iona Bertel Rice who was married to Fred Guiles. His brother Silas who was married to Alzina Cumber ( my great-grandparents)

    3. believe this is your family, below. Ida was a fairly common in name in Quebec but its pronounced as Eda in French. Many with this name, including my own mother, were called Edith by the anglophones. Also, the family next door is probably Edith's parents as Mary is a widow in 1860 and living with Louis and family in 1860. George HALL 1806, Keene, New Hampshire married Almira ROSETTE - DOB approx. 1806 Elizabethtown, New Jersey in 1834 in Essex, New Jersey. In the 1850 census they were living in Smithfield, Madison County, New York and he was a pastor at the Smithfield Presbyterian Church. They had 5 children, George F., Cornelia B.R., Charles A.R., Thomas C. and Susan C. I cannot locate George & Almira in any further census reports or anything else on Ancestry. Son, Thomas died in 1897 but I can trace his wife and son forward to the present as I am married to his great grandson. I am looking for anyone who may have information on this family. Did they die in a fire, of disease or what? Thanks for your help.
