    3. before you do, I think we should discuss duplication abit more. As I understand it, one can copy a percentage - can anyone comment on that? -----Original Message----- From: Karen Eddy [mailto:CapnScupsGGD@msn.com] Sent: Saturday, February 28, 2004 9:49 AM To: NYOTSEGO-L@rootsweb.com Subject: Re: [NYOTSEGO] advice needed Stella Rifenbark Morse died in 1947. Ralph mentions her but does not make any mention of children. I will probably end up donating this little booklet to the Gilbertsville Library. 3. Copyright law is a bit tricky; however it seems to me that there is not sufficient material in 18 pages to make a lawsuit worthwhile. In general, the proponent (copyright holder) must prove his damages, usually by showing the revenue obtained by the defendant from the publication of the material (or the loss of such income to the proponent as he could obtain by selling it). It appears to me that 1) there is to be no damages and 2) there may not be any heirs to file suit. Even if there are, there is a reasonable likelihood that they will never learn of the infringement (if it is one). All litigation, especially copyright litigation, is expensive and the heirs, even if notified, may not have the funds to sue or the desire to do so. As in so many things, you weigh the facts as you know them and proceed with your own decision. Consider: The Readers Digest buys the right to reprint articles from other magazines, etc. Reviewers are permitted to copy verbatim selections from books they are reviewing Cliff Hayes ----- Original Message ----- From: "Cindy Robinson" <cindy@cs.cornell.edu> To: <NYOTSEGO-L@rootsweb.com> Sent: Saturday, February 28, 2004 10:04 AM Subject: RE: [NYOTSEGO] advice needed > before you do, I think we should discuss duplication abit more. > As I understand it, one can copy a percentage - can anyone comment on that? > > -----Original Message----- > From: Karen Eddy [mailto:CapnScupsGGD@msn.com] > Sent: Saturday, February 28, 2004 9:49 AM > To: NYOTSEGO-L@rootsweb.com > Subject: Re: [NYOTSEGO] advice needed > > > Stella Rifenbark Morse died in 1947.
