If created before 1-1-1978 BUT published between that date and 12-31-2002, then it is life (of the author) plus 70 yrs OR 12-31-2047 whichever is greater. Now, that is how I read it, from a chart published by the Univ of NC - and understand it. I don't remember when you said your booklet was originally published.     3. A few more thoughts.... This is a 5.5"x8.5" paper booklet, 17.5 pages long, 18.5 pages if you want to count the introduction. Since Ralph Morse mentions his wife's death in 1947 in the introduction, it was written sometime after then. I can't remember how I got this booklet, probably off of ebay, but it is not in good shape. The pages are falling out and the back cover looks like someone tried to eat it. There is absolutely nothing in here that would qualify as a historical breakthrough. I would say 99% of what Ralph has written has been written elsewhere. Yet, because I did not write this, I cannot post it until I am sure that it is legal to do so. I am absolutely, 1000% positive that Ralph would be tickled to know that this little essay has sparked a discussion. Karen Eddy

    3. Karen You can put it on the internet for "educational purposes" and NOT be subject to litigation for copyright infringement in any way.. just don't charge for access or copies. This is from the FAIR USE part of copyrighting.... The copyright law regarding quotes does not cite a percentage, but rather that the quoted portion is not a "significant" amount. Finally, there is probably no significant monetary value in the pamphlet you have...( of course you could try to sell it on ebay and see what it's worth <s>) so even if you were a vile copyright claim jumper and published the document with your name on it... For example, did you know that in the 19th century, ladies wore their engagement rings on the first finger of the left hand? I sure didn't know this. There is a story about the Indians taking Nancy Wattles' baby that I have read elsewhere. Ralph goes on to say that this baby was his great-grandmother. I don't think I'll be breaking any laws by posting one paragraph from this booklet, just to show you what I mean: ~~~ In 1856 when my grandfather moved to the Dewey house (built in 1810) on the Ouleout, there was a camp of Delaware Indians on the Ouleout near his home. Game animals and fur bearing animals were plentiful. Buckskin was much used for clothing. A hunter knew that a deer head contained just enough of the brain to tan his skin. Cow hide was tanned with a hemlock bark solution. In curing rawhide no solution was used except a light wood ash solution to help remove the hair. There were no game laws at the middle of the century.     3. Copyright law is a bit tricky; however it seems to me that there is not sufficient material in 18 pages to make a lawsuit worthwhile. In general, the proponent (copyright holder) must prove his damages, usually by showing the revenue obtained by the defendant from the publication of the material (or the loss of such income to the proponent as he could obtain by selling it). It appears to me that 1) there is to be no damages and 2) there may not be any heirs to file suit. Even if there are, there is a reasonable likelihood that they will never learn of the infringement (if it is one). All litigation, especially copyright litigation, is expensive and the heirs, even if notified, may not have the funds to sue or the desire to do so. As in so many things, you weigh the facts as you know them and proceed with your own decision.
