This year s/he responded and I requested removal of the name. It did not happen and so I said I did not wish to turn the matter over to an attorney. That did not win any friends I can tell you, but within a day or so no family name of a living person appeared . It is my firm opinion that rootsweb and any other genealogy program ought to get with it and follow the pattern Leigh has referred to. Leigh has commented on a very important subject. >> Good for you for fighting for what you felt for your family. I want my deceased ancestors mentioned. My Mom died in 1996 and my Dad died in 1992. They are important names that I want mentioned in my genealogy. On a nice note, I was talking to a man in a nursing home today that is almost 100. He remembered my Mom, Dad and the name of my father's dog that Dad owned in 1930. He also remembered my grandparents and great grandparents. I was trying to get the ancient stories out of him but he kept talking about how beautiful my mother was. He introduced my Mom and Dad. I can't remember what happened this morning and yet this old gentleman remembers all those little details from all those years ago. He told me that he was sorry that he couldn't see me as he was blind. I told him that was OK-I was beautiful just like my mother. We both got a laugh out of that.
Further question. If the person has been dead at least a month, will anybody sue him if his identity is stolen? (Under a month conceivably the claim could be made it was done before death and dates were mixed, etc.) I don't believe we should put any living person's name on the internet for many reasons. Invasion of Privacy, possibility of connecting the person with parents and opening opportunity for identity theft, and others I do not think of offhand. Any other reason to keep it off for 70 years (that is the period the Census keeps individual records from publication, BUT it does not, I believe, search the records to remove those still living? Rhode Island has already put them up and people are very upset. Anyone in this state can go to the County Clerk's office and look through the tax books and see how much your neighbor pays for taxes and if they are behind. Then there are the newspaper postings of delinquent taxes. There is no more privacy in this country.
To add to this thread... I believe you should not publish information on any living person on the internet, in a book, or anywhere else unless you have that person's permission. If you want to publish information on living relatives, you should contact each of them individually for permission. For instance, I would not give permission for my sons to be published but would require you to contact each of them individually. We are living in an age when this is absolutely necessary. I am in the process of compiling a book on the Chilson family and I have decided to stop short of the living generations -- rather than having to contact hundreds of people for permission -- most of whom probably wouldn't grant permission anyway. It seems the easiest solution. Sue Susan M. Roe Seal Beach, CA SueMHR@aol.com If there must be trouble, let it be in my day, that my child may live in peace. Thomas Paine
Hi Leigh, I guess I should have clarified myself. I did mean those deceased for a very long time. I've found direct ancestors in older sections of active cemeteries which I'm sure is invaluable to other relatives, and have wondered the legality of putting this info online. You are soooooo right about identity theft. It is a huge problem right now due to the internet. Thanks for the reminder, so many people of us are very trusting, that we don't often think of the evil that comes from something good. Rene' -------Original Message------- From: NYOTSEGO-L@rootsweb.com Date: 08/23/04 09:31:16 To: NYOTSEGO-L@rootsweb.com Subject: [NYOTSEGO] Then 70 year guideline René- The presumption is, based on Confidentiality requirements, that a safe rule to follow is NOT to post any information concerning anyone who has been dead at less than 70 years. Family researchers may post a message that they will share their information concerning members of their family with other members of their family but need to be con- tacted off line. Remember, there are a lot of SCAM artists out there who are stealing identities based upon information that is readily available through public sources. They also watch all kinds of Chat Rooms and message lists and find Genealogy Lists a great source of "useful" information. While it is essential to share our information with legitimate researchers, it is not necessary to provide that same info to people who are going to use it for other, illegal, purposes.
