FYI Carol Van Buren _____ TOWN OF MINISINK ORANGE COUNTY, NEW YORK LOCAL LAW NO. 2 OF THE YEAR 2002 LOCAL LAW PROVIDING FOR THE PROTECTION OF CEMETERIES IN THE TOWN OF MINISINK BE IN ENACTED by the Town Board of the Town of Minisink, Orange County, New York as follows: Section 1. Purpose: The Town of Minisink is adopting a "Cemetery Protection Law" to protect the cemeteries and burial sites located within its borders from enroachment of commercial and/or residential structures, preserve the integrity of such burial sites and protect the health, safety and welfare of its residents by establishing enroachment requirements for all commercial and/or residential structures located near such burial sites such that no structure shall be less than one hundred (100) feet from any cemetery and/or burial site. Section 2. Definitions: a. Cemetery. The term "cemetery" shall include any and all public, private, religious, historic and/or family cemeteries where deceased persons are buried. b. Burial site. The term "burial site" refers to and shall include any piece of land where a person is buried, notwithstanding that the site may not be recognized as a traditional cemetery. Section 3. Identification and Locations of Cemeteries in the Town of Minisink: Cemetery Location of Cemetery Clark Cemetery Pine Hill Road DeWitt Cemetery Marvelle Lane Halstead Cemetery County Route 22 & South Plank Road Hill Cemetery Route 284 Loree Cemetery Lower Road Millsburgh Cemetery County Route 22 Minisink Cemetery Route 284 Monell Cemetery Ridge Road Neely Cemetery Horton Road Reeve Cemetery Route 284 Ridge Cemetery Ridge Road & County Route 1 Rome Cemetery South Plank Road Unionville Cemetery Jersey Avenue Van Ness Cemetery South Plank Road Westtown Presbyterian Church Cemetery Route 284 Wilcox Cemetery Minisink Turnpike a. More exact locations of each cemetery identified herein can be found on a map prepared by McGoey, Hauser and Edsall and filed in the Town Clerk's office of the Town of Minisink. b. Notwithstanding the identification of cemeteries and/or burial sites herein above, this list shall no be deemed exhaustive such that any cemeteries and/or burial sites not identified on said list are subject to the provisions herein. Section 4. Enroachment Requirements: a. No commercial and/or residential structure shall be erected within 100 feet of a cemetery or burial site as identified herein and no soil shall be disturbed more than three feet below ground within 25 feet of a cemetery or burial site. b. The Planning Board, in its sole discretion, as part of any subdivision site plan or conditional use permit application, may require a residential or commercial developer to erect fencing, install plantings or otherwise erect a visual and/or physical barrier between developable areas of land, which are adjacent or contiguous to a cemetery and/or burial site. c. The Building Inspector shall not issue a building permit for any structure that is located within two hundred (200) feet from any cemetery and/or burial site without first referring the matter to the Planning Board for review consistent with the above noted provisions. d. The Planning Board, in its sole discretion, may apply the provisions of this section to protect other cemeteries and/or burial plots, which are included and/or referred to in the Town of Minisink's Master Plan or which the Board otherwise deems to be of historical significance. e. Notwithstanding the requirements contained in this Section, the Planning Board may grant relief and allow structures may be erected closer than 100 feet of a Cemetery or burial site on any lot which has previously received subdivision approval by the Planning Board if said lot complies with the other laws of the Town of Minisink. Section 5. Penalty for Violation of Provisions Herein: Any violation of the provision herein shall be prosecuted to the fullest extent of the law by the Town of Minisink pursuant to the laws of the State of New York, including but not limited to sections 145.22 and/or 145.23 of the New York State Penal Code and/or sections 4216, 4217 and/or 4218 of the New York State Public Health Law and shall be subject to the fines and penalties associated therewith and upon conviction of a violation of the Town Law, a fine not to exceed the sum of $250 and/or 15 days imprisonment. In addition, anyone violating the law must correct the violation by removing the structure and restoring the premises to its original condition. Each day that such violation exists shall constitute a separate violation of this law. Upon the failure to remove the violation and restore the premises, as described herein, within 30 days after order of a court of proper jurisdiction, the Town Board is authorized to perform the necessary work and all necessary costs including attorneys and engineering fees incurred by the Town shall be assessed as a lien on the property and added to the next Town Tax Bill which is assessed against the property. Section 6. Separability: Each separate provision of this local law shall be deemed independent of all other provisions herein, and if any provision shall be deemed invalid, all other provisions hereof shall remain valid and enforceable. Section 7. Repealer: This local law shall supercede all prior laws, ordinances, rules and regulations relative to the Zoning Law and Building Code of the Town of Minisink and it shall be, upon the effective date of this law, null and void. Section 8. Effective Date: This local law shall take effect upon its being duly filed in office of the Secretary of State of the State of New York as provided in Section 27 of the Municipal Home Rule Law. fyi Carol Van Buren _____ TOWN OF MINISINK CULTURAL RESOURCES MANAGEMENT LAW Legislative Findings: The Town of Minisink, by and through the Town Board, hereby finds and declares that recognizing the unique historical and archeological artifacts, sites and features within the Town to preserve such artifacts for future generations is in furtherance of our fundamental duty to protect the welfare of the people of the Town of Minisink. The Town therefore enacts this Act in an effort to manage and maintain the cultural and historical significance within the Town. Section 1. Definitions. For the purposes of this law, the following terms shall have the following meaning: A) "Cultural Resources" shall mean and include archaeological sites and historic resources. B) "Artifacts" shall mean objects, specimens, and other physical evidence that are excavated or removed in connection with efforts to locate, evaluate, document, study, preserve or recover prehistoric or historic resources. C) "Archaeological Site" shall mean any location that contains artifacts, and/or structural or landscape features resulting from human use. D) "Historic Resources" shall mean and include any building or landscape determined by the Town Historian to be historically significant or otherwise listed on a list of historic places maintained by the State of New York or the United States of America or any agency or assignee thereof. E) "Significance" shall mean any cultural resource that is determined to have value in representing or furthering the understanding of the Town's historical (including prehistoric) heritage. F) "Burial Sites" shall mean sites where human remains are buried. G) "Phase 1 Cultural Resource Investigation" shall mean a Phase 1 investigation by a Certified Registered Archeologist will be the first step in determining whether a proposed project contains any potentially significant cultural resources. Specific tasks include Phase 1A (literature and document review and sensitivity assessment) and Phase 1B (field investigations). For the purposes of this Law, the term "Certified Registered Archeologist" shall mean: The minimum professional qualifications in archeology are a graduate degree in archeology, anthropology, or closely related field plus: (1) At least one year of full-time professional experience or equivalent specialized training in archeological research, administration or management; (2) At least four months of supervised field and analytic experience in general North American archeology; and (3) Demonstrated ability to carry research to completion. In addition, to these minimum qualifications, a professional in prehistoric archeology shall have at least one year of full-time professional experience at a supervisory level in the study of archeological resources of the prehistoric period. A professional in historic archeology shall have at least one year of full-time professional experience at a supervisory level in the study of archeological resources of the historic period. (1) "Phase 1A Literature Review and Sensitivity Assessment" shall mean Phase 1A investigations are intended to gather information concerning the environmental/physical setting of a specific project area as well as its cultural setting. It is the interrelationship of the physical environment and cultural/historical setting that provides the basis for the sensitivity assessment. (2) "Phase 1B Field Investigation" shall mean appropriate field investigations comprising a systematic, on-site field inspection designed to assess archaeologically sensitive areas and environmental characteristics relevant to site locations and formation processes. Such investigation may include: (a) Systematic Surface Survey (b) Subsurface Testing (c) Remote Sensing (d) Laboratory Processing (e) Report H) "Phase 2 Site Evaluation" shall mean an evaluation involving additional research, which may include excavation, to collect the data necessary for evaluating a site's data potential and research significance. A Phase 2 evaluation obtains detailed data on the boundaries, age, function, integrity, and significance in support of data which may be used to make a recommendation for listing on a list of historic places maintained by the State of New York or the United States of America or any agency or assignee thereof. I) "Phase 3 Mitigation Act" shall mean a process which lessens the impacts on a site or historic structure. It shall not authorize a taking of the property. Section 2. Determination. A) Planning Board. Prior to granting site plan approval or any other approval the Planning Board shall make an on the Record finding whether the property is likely to contain Cultural Resources. If such Board finds in the affirmative, it shall order a phase 1A Cultural Resource Investigation. A recommendation from the Town Historian that the property is likely to contain Cultural Resources shall create a rebuttable presumption that the property contains cultural resources. If such a phase 1A Cultural Resource Investigation is required, the Planning Board shall review the results of such Investigation and determine whether a Phase 1B Field Investigation shall be required. Upon reviewing findings of such study or studies, the Planning Board may order a Site Evaluation Phase 2 Study and subsequently, if deemed necessary after reviewing the Site Evaluation Phase 2 Study, a Phase 3 Mitigation act. Upon acceptance of the study and process results, the Planning Board shall notify the Building Inspector of such acceptance. In no way does this act authorize the Planning Board to commence condemnation proceedings or effect a condemnation or taking of the property, real or personal. Section 3. Burial Sites. Burial sites (i.e. human remains) shall be subject to both this law and to the Town of Minisink's cemetery law. Section 4. Violations. Any violation of the Town of Minisink Cultural Resources Management Law shall be punishable by a fine of not more than $500 per day. An appearance ticket or citation shall be issued by the Town Building Inspector or other authorized individual. In addition, unless otherwise required by law, no permit shall be issued or approval granted with respect to the property while the property is determined to be in violation of this Law by the Building Inspector or Court of Competent Jurisdiction. Any disturbance, removal, concealment of cultural resources to circumvent the application of this law shall be deemed a violation also. Section 5. Separability. If any word, phrase, sentence, section, paragraph, subdivision or provision of this Law shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Law as a whole or any part or provision thereof other than the part as declared to be invalid or unconstitutional. Section 6. Effective date. This Local Law shall take effect upon filing with the New York State Secretary of State. Amendment Adopted: June 9, 2004.

Carol, the MI births & marriages for this time period are online thru the LDS pilot search lab. There is a Harry B. Clapp born 19 DEC 1885 in White Pigeon, father H.A and mother Eugene. There is a Mary Clapp born 10/11/1888 in Detroit, parents Harry and Agnes. He married 15 Sep 1785 probably in or near Goshen, Orange NY Julia SWARTOUT born 18 Nov 1769 daughter of Jacobus SWARTOUT who before and during the Revolution lived in Sugar Loaf which is now in town of Chester, Orange Co., NY but then in town of Warwick, Orange Co., NY. Following children born to John and Julia: Michael 1786 in Orange Co; migrated to Steuben Co William 1788; migrated to Steuben Co Jesse 1790; migrated to Steuben Co James 1791; migrated to Cuba, Allegany Co John 1792; migrated to Cuba, Allegany Co Andrew; 1795; migrated to Wirt, Allegany Co Betsey 1797; Isaiah 1799; migrated to Wirt, Allegany Co Sally (Patty) 1801; JACOB 1803; migrated to Wirt, Allegany Co Julia Margaret 1805; Unnamed son 1807 at which time Julia probably died because she does not appear in 1810 census. Julia Margaret married Charles PHELPS, migrated to Pike, Wyoming Co. and it was at her home that JOHN died in 1850. In 1840, JOHN JORDAN is still residing at Cherry Valley but by 1848 has migrated town of Pike, Wyoming Co, NY to live with youngest daughter and her family. He died there 1/26/1850 and body taken to Friendship in Allegany Co, NY and buried in Mount Hope Cemetery ANY help would be appreciated on these above mentioned families....
