This caught my attention because a similar question was addressed on another list, and it was determined that the law in that state (MO) required "reasonable access" to cemeteries on private property. I just spent about 90 minutes combing through NY Code and using various law search engines as well as standard engines such as Dogpile and Google, and found nothing about this sort of situation. Perhaps there is a lawyer on the list or somone with better search skills than mine who could clarify what rights belong to the public and how they are balanced against private property rights in such cases. It does seem as though Erwin encountered someone who might not be moved--at least not in a helpful direction--by reference to the law, and it is true that private property owners do have legitimate concerns about their liability exposure, etc., when people enter their property, and of course we should treat property owners with the consideration we would want for ourselves (as Erwin clearly did). But does anyone know if it is legal in NY to bar access to a cemetery on private property?

    3. To all those on the list I thought I would share an genealogical experience that I had just outside of Rome, New York about 2 months ago. My 5th great grandparents, Gershom and Catherine Hinckley, are buried in an "abandoned" cemetery, sometimes refered to as the "Niles Cemetery", on route 69 near the Oriskany Battlefield Monument. I live in Grants Pass, Oregon and my wife and I elected to take a cross country drive into New York and surrounding states. We thought we would attempt researching some of the New England areas that we had not before been able to access, for one reason or another. In attempting to find the cemetery in question I stopped at a residence near route 69 and Monument Rd. It just so happened the cemetery in question is located in the back yard of this particular residence. Both before, and following my introducing myself and explaining my interest in this cemetery I was told, in a rather pointed, direct and mildly venomous fashion that the cemetery was "on private property", "hers", and that I would not be allowed acess. For those of you who may have it in mind in the future to visit ancestors' gravesites a word to the wise. Prepare for the eventuality that you may be rudely rebuffed without apparent reason. 3. Hi! I have a book in front of me titled "Cradle of the Middle Class, The Family in Oneida County, New York, 1790-1865" by Mary P. Ryan. I will quote from page 170: "By midcentury, however, the Oneida Institute had sold out to a more conventional boarding school called the Whitestown Seminary. This secondary school was a way station for youth, neatly tucked under the extended eaves of the parental roof. Parents, not students, most often arranged and financed secondary education midcentury. The staff of the Whitestown Seminary instructed mothers and fathers to 'state very frankly and fully your wishes in reference to the studies, the intellectual and moral training of children, so that the teachers may feel at liberty to give you all that information which an intelligent and considerate parent desires when entrusting a son or daughter to the authority of strangers.'" ( I will skip a little.) -"The classical programs at Whitestown Seminary and the Utica Free Academy provided little vocational education per se, and aspiring professionals were obliged to go on to college and postgraduat training in law, medicine, or the ministry" Names I am searching in Oneida County: WHEELER, BRYAN, UPSON, SPENCER, JOHNSON, PRESTON, Kathy Johnson----Original Message----- From: chris benson <makettle@dreamscape.com> To: NYONEIDA-L@rootsweb.com <NYONEIDA-L@rootsweb.com> Date: Monday, November 29, 1999 6:22 AM Subject: [NYONEIDA-L] Oneida Seminary >I have found reference to an Oneida Academy later being called the Oneida Institute >located in Whitesboro, for the preparation of poor young men in the ministry and was >started by George Washington Gale around the early 1800's. >This was later called the Whitestown Seminary. 3. My husband and I just visited the Rome area. We went up to the Westernville Cemetery. We had a really good experience. The man "Stewy Louie" who is care taker of the records lives in a house opposite the cemetery. He was very nice and we got to see all the records for the Growers buried in the cemetery. One of the Growers had even signed as sexton on all the records for like 30 years. We had a tougher time locating stones. The plotting of the cemetery is very old and difficult to read. If anyone has information on any of my families I would appreciate it. colette@mtaonline.net

    3. The Utica Brewery still exists. They produce Utica Club. They sell the steins in their store. You can take a tour which starts in a 1890 hotel lobby and ends with a ride in a red trolley to the pub where they serve root beer and beer. The primary stein characters were shultz and duelly. They later added Officer suds and the contessa. colette@mtaonline.net

    2. Joanne Garland
    3. BYMAN TUTTLE lived in Paris, Oneida County, NY, as of the 1830 census, apparently with seven children. Three of his four daughters were Mary Marinda (Tuttle) Huggins, Celinda (Tuttle) Tuttle (wife of Elam Tuttle's son Benajah), and Phebe Tuttle. His three sons may have been Abel (b.c. 1819 in Mass.), William (b.c. 1825), and John (b.c. 1828-30). Byman lived in Cambria, Niagara County, NY, in 1828, and was originally from Russell, Massachusetts. His wife (m. 1807) was Mary Henry, and she may later have married John Whitaker. Seek any information on Byman Tuttle's life, death, burial, descendants. Have pieced together his extensive New Haven ancestry. Willing to exchange information with other descendants. 3. I believe the original name of the brewery that made Utica Club beers was the West End Brewery, and evolved into the Matts Brewery. The name of the other stein was Schultzie. Another well known brewery, in the Utica area, was the Fort Schuyler Brewery. I had a girlfriend who used to like to go on the tour to get the free beer at the end. She went to college in Utica and she would go on the tour like 2-3 times a week and change her appearance so no one would recognize her!!! 3. I am searching for information on Joseph Hale who was born in Oneida Co. around 1795. He later moved to Cayuga Co. and married Sarah and had several children. I think that John and Alan were two of his children. In the 1855 census of Cayuga Co. it lists Louisa and Alzine as the two children at home and indicates he lived in this county for 30 yrs. Can anyone give me information about his parents? I've tried to find a death notice in Cayuga Co. for Joseph Hale who was 60 in 1855 but I have not been able to locate his burial place. He is not listed in the 1860 census for Cayuga Co. Any information would be appreciated! Joanne Hale Bartholomew

Then broke away to be in St. Lawrence County. I have been hunting for several years for the parents or siblings of my ggg grandfather, who was George B. Nelson, born 12 Sept. 1804 in Massena. His mother's maiden name was Boynton from VT. Father was from NY also. That is all I know. Would anyone be able to look in the Census records for around 1800 and 1810 to let me know if there were any Nelsons there at the time. Would be ever so grateful. Priscilla Varney, Waterville, Me.
