NY Wills Board URL: http://cgi.rootsweb.com/~genbbs/genbbs.cgi/USA/NY/NiagaraWill?read=12 Surname: BRITTON ------------------------- From Niagra Co, NY- BRITTON, Samuel E- Lewiston 52-307 On the 6 of July A.D 1896; I Samuel Britton, of Lewiston County of Niagra and State of New York, do make ordain, publish and declare this to be my last will and testament, in manner and form following that is to say: First- I direct the payment of my just debts,if any. Seond- I direct my executors having after named, to pay my funeral expenses out of my estate as soon as possible after my decease. Third- Whereas I have already given financial assistance to my eldest son, Earl Z. Britton, whereas he married against my wishes, and whereas I have not heard from him in over one year I bequeth One Hundred ($100) Dollars to him personally if he survive me, And I bequeath One ($1.) Dollar to each surviving child of said son. Fourth- Whereas my daughter, Grace D. Britton is now seriously ill and under the care of a physician who gives no hope of her ultimate recovery, I direct that she be supported and cared for in the family as long as she may live after my decease. Fifth- The residue of my estate, both real and personal, I deviseand bequeth to my beloved wife, Catherine A. Britton, in whose wisdom, judgement and discretion I have the utmost confidence. It is my desire, however, that no part of the property herein willed to her shall be used outside of our family, but that all of it shall be used for the benefit of herself and our children, viz: Joseph E. Britton; Frank H. Britton; and Alice C. Britton. Sixth- If my wife Catherine A. Britton, shall not survive me, I devise and bequeth the residue of my estate both real and personal to our children, share and share alike, and in case of the death of one of our children with issue before my death, the share of such child shall descend to such issue. Seventh- I hereby make constitute and appoint my wife Catherine A. Britton; and my son Jospeh E. Britton, to be the joint executors of this my last Will and Testament; I direct that my said executors shall not be required to give bond or security to the Surrogate Court for the faithful performance of their duties; and I authorize and empower my said executors or the survivor of them to sell and dispose at public or private sale at times in such manner and for such sum as to them, in the exercise of their good judgement, may seem most expedient and to convey all or any part of my real and personal estate as they may consider necessary for the payment of my debts and legacies, or for any other purpose. In witness where of, I have hereto subscribed my name and affixed my seal, the eighth day of October in the year of our Lord one thousand eight-hundred and ninety-four. The above party type-written and partly printed instrument was subscribed by the said Samuel E. Britton of the Village of Lewiston, Niagra County, New York, in our presence and acknowledged by him to each of us; and he at the same time declared the above instrument, so subscribed by him to be his last Will and testament, and we a his presence and in the presence of each other, and write opposite our names our respective places of residence.
