NY Wills Reply Here: http://cgi.rootsweb.com/~genbbs/genbbs.cgi/USA/NY/NiagaraWill/39 Surname: Lines, Colby ------------------------- Niagara County, NY Wills Vol. 53 page 165 Mary Ann Lines of Lockport probated 25 July 1898 Daisy Colby, Elsie Colby, infants, William W. Storrs appointed guardian for them. Know all men by these presents that I, Mary Ann Lines of Lockport New York do make publish and declare this my last Will and testament in words following. First. I give and devise the use and income of the house and lot in said Lockport owned by me where I now reside to my daughter Emma Eliza Colby during her lifetime provided however that it shall be used for a residence and no business or trade of any kind shall be carried on therein by anyone during said time and provided further that she shall keep the same in good repair and pay the taxes thereon and keep the same insured in the sum of at least ten hundred dollars and in case she makes default in any of said matters for the space of three months and neglects to pay the taxes or insurance thereon or to keep the same in proper repair to prevent injury thereto or in case she cases to use the same exclusively as a dwelling then my executor hereinafter named shall immediately take possession thereof and rent the same and from the incme threof pay said taxes, insurance and repairs and the balance of said income he shall pay from time to time to my said daughter. Second. At the death of my said daughter Emma said house and lot shall go to my grandchildren son and daughters of my said daughter Emma and I hereby devise the same to them share and share alike, but in the case of the death of any such grandchildren leaving one or more children the share which such one would take if living shall go to her child or children. Third. All the rest residue and remainder of my property real or personal whereever situate I give and devise to my said executor in trust however with power to hold sell convey and invest the same and during the life of my said daughter to pay the net income to her from time to time and at her death to divide the same equally among my said grandchildren and then heirs or next of kin as provided for the house and lot the second clause hereof and in like propportions. Fourth. I make constitute and appoint Frank Shearer of said Lockport as the executor of this will. In Witness Whereof I have hereto set my hand and seal this eighth day of September 1896.
