F. King appointed special guardian for them. The Last Will and Testament of William Lines of the City of Lockport in the County of Niagara & State of New York. Item 1. After the payment of all my just debts and funeral expenses, I give devise and bequeath all of my estate whether real personal or mixed to Mary Ann Lines my beloved wife, for and during the term of her life, with all power to her to use and enjoy both the principal and interest thereof, or so much thereof as she shall desire or deem necessary for her comfortable maintainance and to that end to mortgage, sell or sums upon such terms and conditions, to such person or persons, by such conveyances containing such covenants as to ttitle as she may find or by her counsel learned in the law be advised re proper expidient or necessary in order to elect such mortgage, sale or conveyance, and said sale may be for cash or upon credit or part cash and part credit as she may choose hereby giving to her generally full power to invest, invest or keep invested the said estate or so much thereof as may remain unconsumedfrom time to time in such manner as she may deem proper. Item 2. Upon the decease of my said wife if my portio nof my said estate shall remain unexpended I direct it as it shall be invested and kept invested so long as may be necessary therefor and the income and profits thereof be annually paid to my daughter Emma Eliza colby during her life and to that end I give to my executors full power to sell and convey the same and from time to time as they shall deem it necessary to change the form or securities thereof. Item 3. Upon the death of my said daughter Emma Eliza Coolby if she shall leave a child or children her surviving, I give devise and bequeath such portion of my said estate as shall then remain to said child or children share and share alike, provided all of said children are then of the age of twenty one years; but if any such child or children shall not then be twenty one years of age my said executors shlal keep said estate invested at interest until the youngest living child shall become of age whereupon the same shall be divided among them and in case any of said children die before said division shall be made leaving a child or children surviving the child or children of the one or ones is dying shall take the share or portion which its or their parent or parents would have been entitled if living. Item 4. And if the said Emma Eliza Colby shall die leaving no child or children her surviving then and in that case I give devise and bequeath such remaining portion of my estate to the children of my brother James Lines who now resisdes in England share and share alike. Item 5. I appoint my friend william H. Baker and Charles T. Kilborne both of the City of Lockport aforesaid executors of this my will and I hereby revoke all former wills by me made.
