    3. Jan, When this happened to me (someone copied my web pages verbatim), I sent a polite but clear email requesting the offending pages be taken down. That worked for me. So you might give that a try first before resorting to lawyers, and maybe you'll have the same result. Don't expect an apology though. I didn't get any written reply, polite or otherwise, from the fellow. The pages just quietly disappeared a couple days later. Good luck. --- Brian J.     3. Jan -- Based on a useful website at Cornell http://www.copyright.cornell.edu/training/Hirtle_Public_Domain.htm it surely looks like your material would be protected by copyright. This would be the case whether you bothered to put a (c) on your site or not, as far as I can tell. The biggest issue that might potentially be raised, I guess, is whether you have contributed something of intellectual or creative value to the listing. It seems like the rule is that if you have "just" copied public records and published them, copyright protection is not likely to do much for you. (I do recognize that "just" copying public records is a much bigger deal that it sounds like -- hence the quote marks.) I'm not a lawyer, but you might want to start by contacting the owner of the website in question (you can do a "whois" to find out whom to contact) and saying that you think they have violated your copyright. That might be sufficient to get them to take your material off-line (assuming that's what your objective is) or at least credit you as the source. The next step, I think, would be to try to decide how much in terms of dollars this is worth to you. If you can put a value on it that exceeds, say $500, out of pocket expense for you to perfect your title to this work and keep it off the website in question, then you might want to talk to a lawyer -- particularly if the website owner tells you to buzz off. However, pursuing this sort of thing can get very expensive very fast, so it probably makes sense to set a dollar limit on what you're willing to spend to recover your work. Share that number with your lawyer. As somebody who republishes local history himself -- but is always EXTREMELY careful about copyrights -- I think your issue is definitely worth considering. There are way too many rip-off artists in this "industry". "Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed." From: http://www.copyright.gov/help/faq/ To me, this says that you cannot copyright the fact that John Smith's death notice appeared in a Buffalo newspaper on a certain date, even if no one put that fact online before you. Everyone may cite published information (death notices qualify) without violating copyright law. But you might be able to copyright the way you organized and presented your compilation of newspaper citations. From what I saw, the offending website did not duplicate your design, layout, or arrangement of citations. Unfortunately, you might be in the same position as phone book publishers: http://www.esa.int/SPECIALS/Intellectual_Property_Rights/SEMHM2M26WD_0.html Neverthless, I can sympathize. I had one of my pages at Buffalo Roots plagiarized back in the '90s. The offender had duplicated all my links (which is permitted--on the web, anyone can link to anyone else), but duplicated them in the same order in the same categories I'd developed, with all of my original annotations, word for word (which is not permitted).     3. Hi Jan, Don't you hate it when you have done all the hard work and someone thinks you did such a great job that they want to share it with the world? :-) Yeah, it stinks. I had an ISP (can you believe it!!) wanting to use my work on his web site because it would save him time--I not only told him no way (he had some suggestive stuff on his site) but I switched ISPs! That being said...I went to www.godaddy.com and typed in the domain name and then followed the links to find out "Who Is" Below is the information. My recommendation is to contact the company and the person who is listed as registrant and find out why this information is being published on their web site and how they obtained it. It also appears that they may be selling information from the web site. If you do not receive a response to your email, there is a phone number listed. Since you have stated that none of your info can be used, I would think that's sufficient for anyone to be able to understand. However, that doesn't mean someone won't try to use your info if they figure you're not going to check up on them.     3. My sister and I are looking for Julius R. Reuman. In 1930 he lived on Euclid Ave. in Buffalo. We had the census for 1900 and 1910 and he had a different wife at that time. We are looking for the 1920 census. Is it available in Ancestry.com? That is what my sister had and she can't find it. any idea?     3. Hi~ In the 1920 census on ancestry, he is indexed as Julius R. Kenman. So, if your sister does a search with that name, he should come up. He's living in Cheektowaga, Erie, NY.     3. Thank you everybody for all of your help and suggestions, I will follow up on all of them. I believe the Lloyd S. Hawkins listed below is my father, at that time he would have been maried to a Mary or Margaret (Masters) who's maried name now is shearer. They had 4 daughters who would be in their 50's to 60's. The only other information I have is that Mildred (Shererd) Hawkins was a school teacher in the Kenmore area and Lloyd S Hawkins graduated Kenmore HS in 1942 and attended the University of Buffalo and Syracuse University before and after WWII. Lloyd S Hawkins moved to Westerville Ohio about 1967 which was after his father Lloyd A Hawkins died in Buffalo . <<<Lloyd Hawkins who died possibly in 1967 which is all I have on him and Mildred (Shererd) Hawkins who died around July 4 1974. They had former addresses of 169 Kenmore Ave in Kenmore and 233 Parkside in Buffalo. These addresses were good around WWII.>>> As of the 1954/5 Buffalo phone book, there were no Hawkins listed at either of those addresses. There was one Lloyd in Buffalo, and dozens of other Hawkins in Buffalo. The only two Hawkins in the Tonawanda area were the following. Hawkins, Lloyd S. - 394 Hoyt St., Buffalo - ELmwood-6784 Hawkins, Albert R. - 344 Ward Rd., N. Tonawanda - LUdlow-2044 Hawkins, Richd - 951 Erie Ave., N.
