In the name of God Amen This thirteenth Day of March One Thousand seven hundred and ninety eight. I Johannis Kells of the Town of Claverack in the County of Columbia and State of New York. Yeoman, being in perfect good health at Present and of a sound disposing mind, memory and Understanding, Thanks to the almighty for the same, do make publish and dicta the Following Instrument to be my last will and Testament in the manner following- First of all I recommend my soul into the hands of Almighty God and my body to the Earth to be buried in a decent and Christian like manner at the discretion of my Beloved wife and children. My Temporal Estate I dispose of in the following manner right after payment of my honest debts if any and funeral charges. I do give devise and bequeath unto my sons Hendrich and Johannis all my Real Estate or Farm whereon I now do live together with house, out houses, barn, orchards, arable lands, Meadows, and all the other appurtenances thereunto belongi! ng or any wise appertaining also for the run of the said Farm. One quarter share of the saw Mill with its appurtenances as also room or place to Lodge, deposit or store the logs for the use of said Farm with free ingress, egress and regress in to and from the said saw mill they supporting the said saw Mill with their proportionable and necessary quarter share of expenses and repair. To have and to hold the said Real Estate or Farm and the said Quarter share of the said saw mill under the provision herein after mentioned. ???? my said sons, Hendrick and Johannis, their heirs and assigns, forever - In consideration they ??? ??? ???? Hendrick and Johannis their Heirs or agents shall yearly and every year pay or cause to be paid ??? widow Elizabeth or her ???? the one third part of the produce and income of the said hereby divided and ???? Real Estate or Farm is by her thereunto requested any part or the whole also the use and occupation the one third part of the dwelling hou! se, barn and out houses on the said Farm during her natural life. Likewise I do ordain and it is my positive will that my said sons Hendrick and Johannis their heirs and assigns as and for a further consideration for the within divided and my quartered premises shall pay or cause to be payed the sum of four hundred and fifty pounds ???? to say each of them the sum of two hundred and twenty and twenty five pounds lawful money of the state of New York to be divided among my three sons and two daughters viz. Jacob, Peter, Abraham, Marion and Elizabeth their heirs or assigns share and share alike, ~. To my son Philip and to his heirs and assigns I do give divise and bequeath my other quarter share of the saw mill as also my half share of the grist mill. Together with ten acres of land on both sides of the creek adjoining and around the said mill seats for and in consideration whereof he my said son Philip his heirs or assigns shall pay or cause to be paid the sum of fifty pou! nds the like money aforesaid unto my above named five children, Jacob, Peter, Abraham, Marion, and Elizabeth their heirs and assigns to ????? divided among them share and share alike so that it may be well understood, that out of the above bequeathed four hundred and fifty pounds and the better sum of fifty pounds amounting in the whole to the sum of five hundred pounds the above named five children their heirs and assigns shall ????? may draw and receive of and from the above named Hendrick, Johannis and Philip as is proportioned ???? ????? their heirs and assigns the sum of one hundred pounds lawful money of New York. Each of them ???? their heirs or assigns~. All the farming utensils and appurtenances belonging to waggon, st???, plows, harrows and all other implements, tools or other appurtenances belonging to the farm, also all ???? appurtenances belonging to the barn. I do hereby ordain to be and remain on the farm in later ???? for the use of my sons Hendrick and Jo! hannis their heirs and assigns for Ever ~. To my widow Elizabeth I do give and bequeath a full and compleat feather bedd with all its appurtenances ???? ???? the third part of the household furniture during her natural life ~. All the remaining ???? personal estate not desposed of I do give and bequeath unto all my children their heirs and assigns viz. Hendrick, Johannis, Philip, Peter, Jacob, Abraham, Maria and Elizabeth to be divided ???? them share and share alike ~. And lastly I do nominate and appoint my sons Peter, Johannis and Philip, also my trusty friend and brother in law Christopher Ha????? Panbriefs; be it remembered that on the 16th day of January in the year of our Lord one thousand seven hundred and ninty nine Peter Wiessmor of Claverack in the county of Columbia Esq. Appeared before me Philip L Hoffanan surrogate of the said county and being duly sworn saith that he saw Johann Kells sign and seal the within instrument purporting to be the last will and Testament of the same Johannis and heard him publish and declare the same as and for his last will and Testament ~. That at the time of executing thereof he the said Johannis was of sound and disposing mind and memory to the best of the knowledge and belief of the deponent and that Abraham L ?Fonda? Ros??? Weissmor and the deponent severally subscribed their names as witnesses to the said will in the presence of the testator ~.~. Signature signature Columbia?? The PEOPLE of the state of New York by the grace of God free and independent to all to whom these presents shall come or may concern send greetings KNOW YE that at Livingston in the county of Columbia on the day of the date hereof before Philip L Hoffman Esq. Surrogate of our said county the last will and Testament of Johannis Kells deceased (a copy where of is hereinto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death goods, chattles or credits within this state by means whereof the proving and regestering the said will and the granting administration of all and singular the goods, chattles, and credits and also the auditing allowing and final discharging the account thereof doth belong unto us; the administration of all and singular the goods chattles and credits of the said deceased and any way concerning his will is granted unto Hendrick Kells, Johannis Kells, Philip Kells, and Christop! her Hagedorn the executors in the said will named they being first duly sworn will faithfully to administer the same and to make and exhibit a true and perfect inventory and singular the said goods, chattles and credits and also to render a first and ???? thereof when thereunto required - in testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed witness ???? ?????? surrogate of our said county at Livingston aforesaid the 16th day of January ???? our Lord one thousand seven hundred ninty nine and of our independence twenty ????
