Susan, I work in Medical Records at our local hospital and we are responsible for birth certificates. NYS requires a birth certificate for a baby who is alive at birth. Thus is the baby died shortly after birth, i.e. 1 hour old, we would complete a birth certificate. If the baby was stillborn, there is no birth certificate completed. In this case, I believe the physician must file a record of death, though it might be slightly different than a regular death certificate. Hope this helps.
