I received a copy of a guardianship probate for Emery P. Horton from Olmsted Co., MN which names his guardian as Dana P. Horton. I believe both men are half-brothers, and both sons of Charles D. Horton. I also received a probate for Charles D. Horton from Olmsted Co., MN, and it states that he died on 17 Nov. 1856. In addition to the seven children he had with current wife Philetta, the probate named two sons by a former wife (not named), Dana and Reuben. Emery Horton was not named as his child yet I believe Charles Horton fathered Emery as a result of his relationship with Margaret Love. I've found that there was a Dana P. Horton who served in the Union army and died 27 Dec. 1897...could this be the same Dana who was named guardian of Emery Horton? Does someone have Dana's death certificate or obituary to see if it names his parents as Charles Horton and Charlotte Shepardson? I'm wondering why Dana was named guardian if Emery's mother Margaret Love was still living as of the date on the probate, which was 3 Feb. 1873...and Emery had already married in Lake Co., IL on 8 Jan. 1872. As of the 1870 Census, Emery was a single man living in Lake Co., IL with Reuben and Roxy Shepardson, who just happen to be the parents of Charles Horton's first wife, Charlotte.
