Potter of Machias, N.Y. do make, ordain, publish, and declare this my last will and testament in manner and form following, that is to say: First: - I direct the payment of my just debts, if any, and my funeral expenses. Second: - I give, devise, and bequeath to William Potter all my real and personal estate, in trust nevertheless, to receive the rents and profits of my real estate and the interest, use, increase, and income of my personal property and apply said rents, profits, interest, use, and income to the use of my husband Isaac Potter during his natural life for his support, living, and maintenance. Third: - Upon the death of my said husband, I give, devise, and bequeath to Nettie L. Holbrook and Fred E. Potter and their heirs and assigns forever all of said real and personal property, share and share alike. Likewise, I make, constitute, and appoint William Potter to be executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name and affixed my seal, the twenty first day of March in the year of our Lord one thousand eight hundred and ninety-three. Mary E. Potter The above written instrument was subscribed by the said Mary E. Potter in our presence, and acknowledged by her to each of us; and she at the same time declared the above instrument so subscribed to be her last will and testament and we at her request and in her presence, and in the presence of each other, do here sign as witnesses thereto. In the same matter: On reading and filing due proof of the service of the citation issued in this matter and upon due proof of the execution of the paper propounded as the Last Will and Testament of Mary E. Potter late of the town of Machias in said County, deceased, bearing date the 21st day of March 1893 the petitioner appearing in person by Wm. Joslyn Esq. her atty. and Fred Potter also appearing by Wm. Joslyn his atty., and Isaac Potter heir at law and next of kin appearing in person...it appearing by such proof that the said will was duly executed and the testatrix at the time of the executing the same was of full age for making a will, was of sound mind and memory, and not under restraint and in all respects competent to devise real estate and the probate thereof not having been contested: It is ordered, adjudged, and decreed that the said paper purporting to be the Last Will and Testament of the said Mary E. Potter, deceased, was duly executed to pass real and personal estate, and that the same with proofs thereof be recorded and admitted to probate as Will of real and personal estate. Carey D.
