Bayer was arrested at the scene. In court today, Kirkpatrick, who is suing for $5,000 (close to 100.000 in todays currency) testifies she was walking along First Street when she was seized by the throat and thrown to the ground.. Her account is corroborated by relatives and policemen who witnessed the incident. Bayers attorney , William J. Roche, contends his client was actually a good samaritan, intervening to prevent Kirkpatrick from throwing rocks at a delivery wagon trying to unload at the factory.
