He appears at the house while his wife is out on an errand and asks his step daughter, Emma, to get his wife back to the house for her child support money. When Mrs Foley returns he asks her to accompany him to the stone bridge on Hollow Road, she refuses and he pulls a revolver and shoots his wife in the head and then in the finger as she raises her hand. His stepdaughter, Emma Quest runs for her bedroom as he turns the gun toward her, the shot misses as she crashes thru her bedroom window and lands in the back yard. She rushes around the front and gets some neighbors, when they enter the house they find Thomas on the floor ,he having shot himself in the temple. The neighbors speak very highly of Mrs Foley to the Record reporter, and the hospital statement states that she cannot recover.
