It appeared in evidence, that in the month of September 1850 Conrads Henkel;s two children, boys, aged 8 years and 12 years were missing. They went form home on Sunday and on the Tuesday following were found drowned in the pond. The father Conrad Henkel files a special act of the Legislature for damages limited to Five thousand dollard for the negligence of the corporation in not fillling up the sunken lots at the foot of 17th street between Avenues A and B. It was told in evidence the boys were accustomed to go in and play on planks and bathe in the pond. And if these boys did so, no action could be maintained for their loss as if they were walking any want of care or inattention to safety on their own part. The court refused to try the second case until the jury has passed upon the first and the jury after a short time, found for the defendants. ********************************* Supreme Court.
