Abbey vs. Horation G. Abbey-sues for divorce. Motion made some weeks ago hs ordered that Horatio pay $50.00 for counsel fee, and alimony at the rate of $4 a week, also that the defendant Mary, have her clothing and access at all time to the children. **************************** Supreme Court-Chambers-before Judge Mitchell - Habeas Corpus-The People ex rel and Mr Prevost vs J. M. Nelly and Ellen Nelly. This was a proceeding to test the right of the defendants to the custody of Honaria Nelly, their daughter aged 12 years. It was alleged by the relator that in October 1850, John Nelly surrendered the care and custody of the girl to the Female Guardian Society of this City, which in May 1850, by indenture of that date, bound her apprentice to the relater for the term of 10 years. About a week ago, he brought her to this city to see her parents, who have since then detained her in their custody, and now claim to have the right to the custody and service of the child. On motion of the counsel for the parents the further hearing was adjourned until Thursday a.m. ********************************************* At a very late hour on Tuesday nite officers Post and Cook were called upon to enter a house in 39th Street, where it appears an inhuman husband by the name of Patrick Smith had violently assualted his wife and another female by the name of Mrs. Mary A. Morley, thus inflicting serious wounds on the head of his better half. When the policemen took the desperate fellow into custody, he threatened to have their hearts blood beffore he would go a step, but by strength and perserverance they forced the assailant of the weaker sex to acompany them to the 9th ward station house, where he wa detained until morning at which time he was transfered to Jefferson Market Police court. *********************************** The funeral of Mr. Lees took place as was announced yesterday at the First baptist Church in Nassau Street. He was a member of the Press and the Order of Old Fellows. *********************** Tuesday afternoon, an inquest held at Mrs. Taylor's boarding house. It appeared in evidence, that in the month of September 1850 Conrads Henkel;s two children, boys, aged 8 years and 12 years were missing. They went form home on Sunday and on the Tuesday following were found drowned in the pond. The father Conrad Henkel files a special act of the Legislature for damages limited to Five thousand dollard for the negligence of the corporation in not fillling up the sunken lots at the foot of 17th street between Avenues A and B. It was told in evidence the boys were accustomed to go in and play on planks and bathe in the pond. And if these boys did so, no action could be maintained for their loss as if they were walking any want of care or inattention to safety on their own part. The court refused to try the second case until the jury has passed upon the first and the jury after a short time, found for the defendants. ********************************* Supreme Court. He was walking on the track, when the cars came up, jaming him between the cars and platform. He leaves a wife and family. ******************** Philadelphia, Thursday October 16, 1851 A letter from Burlington, New Jersey dictated by Joshua Shaw, the admired landscape painter detailing an unfortunate accident which occurred to him a few days ago. He was on a gunning execursion with a friend, and while in the bushes, received the contents of a fowling piece in his face. Two shots entered his right eye, and his other was badly injured. Diver Article Text: Buffalo, Thursday October 16, 1851, A shocking occurence happened yesterday on the Buffalo and rochester railroad in Lancaster, about 13 miles from this city. The engineer of the express train due here at 9:00 a.m. soon after leaving the town line station, saw a man ahead on the track, coming towards the train, who evidently as if he wished to reach a favorable place to turn off the track; failing in this, he stepped aside, but unfortunately, too late, the end of the bumper of the locomotive struck him in the side, breaking several ribs and killing him instantly. Upon stopping the train, it proved to be Mr Pardon PECKMAN, a revolutionary soldier and pensioner, a highly esteemed citizen, aged 88 years, the oldest inhabitant in the town and on of the first settlers in the county. Mr. PECKMAN was born in Rhode Island, and resided afterwards in Bethel Vermont; from there he emigratd to Western New York in the year 1808. *********************** Yesterday afternoon, Joseph A. Diver lived at 224 Vickar Street was found ded in his bedin his house since his return from Mexico. He came to his death by swallowing a dose of poisonous drug prusaic acid. He was 25 years old. At one time was Alderman of the fourth Ward; after which he joined the "Tenth Regiment" and went to Mexico during the war, but returned again, and recently became quite insane, which partially account for his committing the rash act. **********************8 Mrs Williams of 212 Fulton Street had a child about 4 years old run over by a horse. The bride presented a lovely appearance, being gowned in an elegant creation of white charmeuse with lace. She wore a white picture hat and carried a shower bouquet of bride roses. Miss Anna Clifford, sister of the bride, as maid of honor, was becomingly gowned in blue charmeus. Her bouquet was made of pink roses. Mr.James Feeley, brother of the groom, acted as best man. The ushers were Mr.George Kegney of Buffalo, a distant cousin of the groom; Mr.Franklin H.Fogal,Mr.Charles H.Reynolds and Mr.Alexander Cummings. Following the ceremony a wedding breakfast was served at the home of the bride's parents, Mr.and Mrs.James Clifford, 126 Lock St., to twenty-four guests including only the immediate relatives and the bridal party. The bride's table at which twelve were seated, was centered with a mound of pink roses and pink asters. Mr.and Mrs.Feeley left on a trip to Old Point Comfort,Va.,after which they will be at home in Niagara Street. Besides her husband she is survived by two sons, Kenneth and Jack Cole, her parents, Mr.and Mrs. Julius Umschlag and one brother, Albert Umschlag, of Lockport. Van Wagner. Davis is a widower and has three children. *********************** Boston, Massachuttes.....Hiram Wilcom was killed on Saturday in Fitchburg by the bursting of a grindstone in Crossman's Scythe Manufactory. ****************************** Mary Connors kidnapped the 9 year old daughter of Richard Crummin who resides in the village of Ottawa, Illinois. The child was left in Ireland by her parents when the emigrated to this country and in the month of June 1850, mr Crummin enclosed an amoount of money sufficient to pay his daughter's passage across the ocean, and dispatched the same to a relative in newland, Tipporary County, Ireland, with instructions to send the chid to this country incharge of this Miss Connors, who it was understood was coming out to America. They made all the arrangements and she sailed with the girl in the packet ship Probust which arrived at this port on July 29, 1850, since which time, Mr. Crummin has heard nothing of his daughter, and with a view of asceertaining her whereabouts. ******************************** The sentence of Michael Mulvey (Mulrey) who was convicted of murder at the last term of the court of Oyer and Terminer for shooting a German named Charles Beekman in an oyster saloon on the corner of Orange and Chatham Streets, some months ago, has been commuted by Gov. Hunt into imprisonment in the Sing Sing prison for life. The 21st of noverber was the day fixed for his execution. On Monday next the unfortunate man will be taken to prison. ********************* Yesterday morning Dr. Seth Geer, Coroner, was call to 315 Bowery to see David Bell who killed himself by a poisonous drug. Mr. Mary Bell,is the wife of David Bell. He sold segars at the above premises was born in New York 34 years ago. ************************ At an early hour yesterday morning a very respectable German by the name of Joseph Meyer living at the corner of 13th and Avenue A, made an attempt to kill himself by raising up the front window sash of he 3rd story of his house, and leapping out upon the pavement. His fall ws broken by striking against the awning which providentialy saved his life but as he was terribly injured abut the skull and back he may yet die. ********************************* On Saturday evening about 5 p.m. an Michael cain, and emigrant who just reached this country from theold world, met with a sad and fatal accident. Lockwood and after a brief courtship they becam attached to each other and on the evening of the 6th of December 1949 they were united in the holy bonds of matrimony by Reverand Mr. Palmer a methodist clergyman of that village. A few months elapsed and the happy twain removed to New York City. But in the course of the year following their removal to new York it is alleged her husband proved false to her, and placed his affections upon another fair damsel, who his did not marry but still resided under the same roof with her and passed her as his wife. When these facts came to the knowledge of his legal wife she became enraged and being ignorant of the stat laws, at once resoled to marry again; and in order to carry out her desire she sought an introduction to a young fellow named William Monroe, who she soon captivated and in a few days they were duly married at the Presbyterian Church of Reverand edward E. Ellison was a boatswain's mate in Commodore Perry's ship on Lake erie and pulled an oar in the boat which carr9ed Commodore Perry from the Lawrence to the Niagra. He was also with Commodore McDonough on Lake Champlain and has been 40 years in the service.
