Hello Sharon and Listers: I agree with the cross posting as my NICHOLLS research is at a complete standstill. Yesterday I wasnt able to get online at all and by midnight I figured out what was the problem - all the last minute tax filers doing it electronically! I was somewhat irritated as I pay for the service and not to be able to access is the pits!! Today I got the following from another Researcher and did indeed laugh and felt it was a good one to share with you all! THE THIRTEEN COMMANDMENTS FOR NAMES: (1) Thou shalt only name your male children: James, John, Joseph, Jonathan, Richard, Thomas or William (2) Thou shalt only name your female children: Elizabeth, Mary, Martha, Sarah or Virginia (3) Thou shalt leave NO trace of your female children. (4) Thou shalt, after naming your children from the above lists, call them by strange nicknames such as: Ike, Eli, Polly, Dolly, Sukey.---making them as difficult to trace as possible. (5) Thou shalt NOT use any middle names on any legal documents or census reports, and use only initials on all legal documents. (6)Thou shalt learn to sign all documents illegibly so that your surname can be spelled, or misspelled, in various ways: Hicks, Hicks, Hix, Hixe, Hucks, Kicks (7) Thou shalt, after no more than 3 generations, make sure that all family records are lost, misplaced, burned in a court house fire, or buried so that NO future trace of them can be found. (8) Thou shalt propagate misleading legends, rumors, & vague innuendo regarding your place origination. (A) you may have come from : England, Ireland, Scotland, Wales....or Iran. (B) you may have American Indian ancestry of the______tribe...... (c) You may have descended from one of three brothers that came over on a ship from______ (9) Thou shalt leave NO cemetery records, or headstones with legible names. (10) Thou shalt leave NO family Bible with records of birth, marriages, or deaths. (11) Thou shalt ALWAYS flip thy name around. If born James Albert, thou must make all the rest of thy records in the names of Albert, AJ, JA, AL, Bert, Bart, or Alfred. (12) Thou must also flip thy parent's names when making reference to them, although "Unknown" or a blank is an acceptable alternative. Although not my line, I have gathered a lot of information about Benajah Nicholls, Esq. and his ancestors and descendants. Benajah Nicholls was the son of Humphrey Nicholls of Bertie Co NC and Humphrey's second wife, Sarah Lockhart Nicolls [not Nicholls] Williams (her 3rd marriage was to Benajah). Benajah was prominent in the early part of the 19th Century in Bertie Co NC. He left a Will, Estate Papers, and his Personal Papers with over 900 items in them. These items included letters to and from family, business partners, clients of his law practice etc. He had children by his first Wife, an Ashburn, and step-children by his second Wife. He married second, Margaret Capehart, widow of Michael Capehart, from a wealthy Bertie Co family. Benajah's step-son was Frederick M. Capehart who removed to Murfreesboro TN and was active in evangelism of some sort. He had an extensive correspondence with his "father," Benajah Nicholls, about the success of his evangelism. Frederick Capehart lived in a home owned by his mother, Margaret Capehart Nicholls, and had other property in Murfreesboro to manage that his mother owned. Benajah also had some correspondence with his in-laws, the Ashburns of Bertie Co NC and of VA. I am having a hard time finding anyone who is interested in Benajah Nicholls or his kin. The deceased was born May 26, 1867 at Phoenix, MI, the daughter of Mr. and Mrs. Andrew Nicholls. She came with her parents to Stephen in 1883, where she was married in 1887 to Christopher Henry Fay, who preceded her in death some years ago. She is survived by four children: Mrs. William Roach, Saskatoon, Saskatchewan, Canada; Lawrence and Lydia Fay and Mrs. Otto Benson, all of Stephen. There are also one sister and four brothers surviving: Mrs. William Chamberlain, Norway, MI; W. H. Nicholls, Spearfish, SD; Thomas Nicholls, Santa Rosa, FL; and John Nicholls, Argyle, MN. Mary Jane died 1-22-1874 at the Cliff Mine in Keweenaw Co., MI. She is buried in Evergreen Cemetery in Eagle River. Andrew was a widower with at least 5 children. Andrew possibly married Ann Warmington, age 40, on Oct. 2, 1875 at Phoenix, MI. Edward and Elizabeth Warmington were witnesses. (I don't know if this marriage record is "our" Andrew). Andrew married Mary Jane (Richards?) about 1876-1879. She was a widow and was born in England. She had a brother who was a Methodist minister, Rev. Richards. He was working in Nebraska about 1900. Andrew and Mary Jane had two children. They moved to Marshall County, MN about 1883.

Benajah Nicholls left an extensive collection of Private Papers in Bertie Co NC. They are now in the NC Archives and are in four small file boxes. These file boxes protect about 20 file folders. 2 or 3 file folders per box have a 100 items or more while the remainder of the folders have smaller numbers of items. Benajah was very literate as were several of his contemporaries and kin, such as Baldy Ashburn. Benajah Nicholls, Esq was a Court and County official and maintained an extensive private law practice. He kept up correspondence with kin and friends over a 30 year period and was the administrator of several large Estates. The Nicholls family was extensive in Bertie Co NC in the latter part of the 18th Century and the first part of the 19th Century. I am interested in contacting descendents of the Bertie Co NC Nicholls; however, the Nicholls are not my line!! This is a small research project only! I will post any material that I write up to the Bertie Co or other relevant Gen-web sites. I do not wish to be rude but I am not interested in what WFT, LDS, etc. files have to say about the Nicholls from Bertie Co NC, and I am not able to do look-ups in this mass of material so please do not ask. What I would like to do now is to exchange information with serious Bertie Co NC and Nicholls researchers who already have some reliable family or research information (not WFT and LDS material though). Francis' father was James Nicholls born Cornwall 1838, who was one of 10 children. At 43 years of age, James was a solicitors managing clerk in Cornwall. He was married to Mary Robarts Nicholls. Mine's also a vague one! My grandmother is Joan Daphne Sparks, nee Nicholls born 1923. Her Dad was Jack possibly aka Johnathon Nicholls. He married Agnes Chapman b 1897 and my grandmother is their only child. They divorced when she was young (10??) and he then went back to Eastbourne, Sussex apparently his home town where he is supposed to have remarried and had more children.
