That he entered the service of the United States under the following named officers and served as herein stated, to wit: 1st tour: I entered the service in the war of the revolution in the state of North Carolina, Wilkes County, the year that Charleston was taken. I entered as a volunteer under William Lenoir, Captain, at Wilkes Court House, North Carolina. Colonel Cleveland commanded us; rendezvoused at Wilkes courthouse & marched to Ramsour's Mill; from thence we marched down to the Adkin [sic, Yadkin] [River]. I continued until I served out my tour and then was discharged (though not in writing) and went home. 2nd tour: was from the same County, my Captain was Paul Patrick, Colonel Armstrong was our commander [missing text] I was in the battle at fishing Creek. 3rd tour: volunteered from the same state and county, David Vias was our Captain, Colonel Cleveland commanded - Lewis, as well as I remember, was our Major; we marched to King's Mountain where the Battle was fought. We then went to the Moravian Towns & carried the prisoners and was there discharged (but took no written discharge and have no documentary evidence of any of my services.) 4th tour: I entered as a substitute for William Cochran; we rendezvoused at Major Lewis's and marched to the old trading ford on the Yadkin River near Salisbury North Carolina at which place we were discharged. My Captain was John Cleveland, my Colonel was Benjamin Herndon. 5th tour: I entered the service as a drafted man under Captain John Morgan (three months tour) but did not serve out the whole time; was told to go home and ordered to hold myself in readiness when called upon. I was born in Virginia, the 17 February 1763, Orange County. I have a record of my age which was kept by my father and now in my possession. I was living in Wilkes County North Carolina when called into service every time; shortly after the war closed, I moved state of Georgia, Wilkes County, but now Elbert, Elbert being formed from a part of Wilkes, and have resided there ever since (except a short time I resided in South Carolina). All my neighbors can testify as to my character for veracity & George Cook, Counselor at Law and many others as to the general belief & reputation of my having been a soldier of the revolution as herein stated. As to the particular dates of entering the service at different times & the dates or times when discharged, this applicant cannot distinctly recollect, but he served as herein stated. And he hereby relinquishes every claim whatever to a pension or annuity except the present, and declares that his name is not on the pension roll of the agency of any state. Holloman State of Georgia, Elbert County: On this nineteenth day September in the year of our Lord one thousand eight hundred and thirty three personally appeared in Open Court, before his Honor William H. Crawford Judge of the Superior Court now sitting, in and for Elbert County State of Georgia Benjamin Brown a resident of Elbert County and State of Georgia aged seventy years and a few months, who being first duly sworn according to law, doth, on his oath, make the following declaration, in order to obtain the benefit of the Act of Congress passed June 7th 1832. That he entered into the service of the United States under the following named officers, and served at different periods as herein stated: That he volunteered into the service of the United States for three months in the County of Wilkes State of North Carolina, then the place of his residence on the ___ day of ___ in the year one thousand seven hundred and eighty, under Captain William Lenoar [sic, William Lenoir], Commanded by Colonel Cleveland, rendezvoused at Wilkes Court House in the State of North Carolina marched from there to Ramsour's Mills, from thence down the Yadkin River in the State of North Carolina, where he was discharged after having served three months as a private in the United States Service, that he served with no other troups except the Militia during this tour of duty, and that he does not recollect the day and month when he was discharged. That also he substituted into the service of the United States for three months as a private for one John Wall in the county of Wilkes State of North Carolina, then the place of his residence, on the __- day of ___ in the year one thousand seven hundred and eighty, under Captain Paul Patrick, sometimes commanded by Colonel Armstrong and at other times by Colonel Isaacs, marched from Wilkes County to Fishing Creek in the State of South Carolina, and there was attacked by the British Commanded by Colonel Tarleton, (the American Troops was under the immediate command of General Sumpter [sic, Thomas Sumter]) in the month of August Seventeen hundred and eighty, the whole of the detachment was either killed, captured or dispersed, Went from thence to Hillsborough North Carolina where he was discharged in the year seventeen hundred and eighty but does not recollect the day or month, after having served three months in the service of the United States, and that he does not recollect that he served with any other Troops except the Militia during this tour of duty. That he also Volunteered as a private for three months into the service of the United States, in the County of Wilkes, State of North Carolina then the place of his residence, on the ___day of ___ Seventeen hundred and eighty under Captain David Vias in a Regiment commanded by Colonel Cleveland, marched from Wilkes County to Kings Mountain in the State of North Carolina, and on the seventh October seventeen hundred and eighty, attacked the Loyalist commanded by Major Ferguson on the top of the mountain, after the battle marched the prisoners taken at that place, to the Moravian Town in the State of North Carolina where he was discharged after having served three months as a private in the service in the year Seventeen hundred and eighty, the month or day of his discharge he does not distinctly recollect, and that he served during this tour only with the Militia and Volunteers commanded by Colonels Cleveland, Lacy, Campbell, Shelby, Sevier, McDowell, Hathhorn and Hill. That he also substituted into the service of the United States as a private for three months for one William Cochran, in the County of Wilkes State of North Carolina, then the place of his residence on the ___ day of ___ seventeen hundred and eighty one under Captain John Cleveland, commanded by Colonel Benjamin Herndon, rendezvoused at one Major Lewis in the State of North Carolina, marched from thence to the old trading ford on the Yadkin River near Salisbury in the State of North Carolina, where he remained stationed until the expiration of his service and was discharged at that place in the year seventeen hundred and eighty one after having served three months as a private in the service of the United States the day or month when he was discharged he does not at this late date recollect and that during this Tour he served only with his own Regiment. That he also was drafted into the service of the United States as a private for three months, in the County of Wilkes State of North Carolina then the place of his residence, on the ___ day of ___ in the year Seventeen and eighty one, under Captain John Morgan in a Regiment commanded by Major Hartgrove marched from Wilkes County to Hillsborough No. Carolina where he remained two months, then was disbanded and sent home with orders to hold himself in readiness when called on, and that during this Tour of duty he served only with Regiment, making in all at the different periods fourteen months service as a private in the service of the United States during the Revolution, That he has no documentary evidence, and that he knows of no person, whose testimony he can procure, who can testify to his Service as a soldier of the Revolution. That he was born in Orange County State of Virginia on the seventeenth day of February in the year of our Lord one thousand Seven hundred and sixty three, and has a record of his age now in his possession which was kept by his Father, that when called into Service he lived in Wilkes County State of North Carolina, and that he lived in Wilkes County State of North Carolina a short time after the Revolutionary War, then removed to Wilkes County State of Georgia, now Elbert County, formed out of Wilkes County, and has resided there ever since, and now resides there. That he entered the service the first tour as a Volunteer, the second tour he substituted for one Jonathan Wall, the third tour he Volunteered into service, the fourth tour he substituted for one William Cochran, the fifth tour he was drafted into the service of the United States, That he served with no Regular officers, or Continental Regiments only with the Militia Regiments which has been before stated in this declaration, the general circumstances has already been before stated in the foregoing declaration, That he received no written discharges for any of his services during the Revolutionary War, they were all verbal, or disbanded from service. He states that the names of the persons to whom he is known in his present neighborhood, and who can testify to his character for veracity, and their belief of his services as a soldier of the Revolution are the Honorable Wiley Thompson late a member of Congress, George Cook, Leroy Upshaw, Benajah Houston, George Wyche, and General James M. Tait. He hereby relinquishes every claim whatever to a pension or annuity except the present, and delcares that his name is not on the pension Roll of the Agency of any State, Sworn to, and Subscribed the day and year aforesaid (SIGNED) Benj Brown In open court, Benajah Houston, Clerk S.C.E.C. (Superior Court Elbert County) We Peter P. Butler a Clergyman, residing in Elbert County State of Georgia, and Benajah Houston residing in the same place, hereby certify that we are well acquainted with Benjamin Brown who has subscribed and sworn to the above declaration, that we believe him to be seventy years of age; that he is reputed and believed in the neighborhood where he resides to have been a soldier of the Revolution, and that We concur in that opinion. Sworn to, and subscribed, the day and year aforesaid (SIGNED) Peter P. Buter; Benajah Houston Test: Benajah Houston, clerk, in Open Court And the said Court do hereby declare his opinion, after the investigation of the matter, and after putting the interrogatories prescribed by the War Department, that the above named applicant was a Revolutionary Soldier, and served as he states, And the Court further certifies, that it appears to them that Peter P. Butler who has signed the preceding certificate is a clergyman, resident in Elbert County and State of Georgia, and that Benajah Houston who has also signed the same, is a resident, in the same place, and is a creditable person, and that their statement is entitled to credit.
