3. Hello, Can't put my hands on my copy of the court case when Franklin Goode & Rebecca Mode were in court on bastary charges, but do remember she won. Mr. Goode & some of his friends gave testimony that Rebecca was a lady of ill repute & had had relations with other men. Nancy Powell, William's wife was a witness for Rebecca. Rebecca won the case. I'll search this black hole I call an office & if I find the copies will be happy to share. I, too am interested in knowing the identity of Nancy's parents. 1. [NCRUTHER-L] 1810 Census
2. Hello, I was wondering if anyone knew if there was any pattern to the 1810 census? It is in semi-alphabetical order. Are all of the letters (i.e. "W") separated by district? For example did they list the "W"s in district one first, then district two, district three and so forth? I noticed that it appears that in the Ws there are some folks listed twice, as if the enumerator went back to the neighborhood to catch those he may have missed and wrote down everyone again. I thought if I could figure out a pattern perhaps I could figure out who my ancestors were living closest to. Thanks, Melody

1. [NCRUTHER-L] Rutherford County Court Records
2. I have been spending time going thru court records from 1799-1817. I wanted to post some of the information I found in case it might help someone, and also to ask questions about some of the people I found. These are not word for word, but can look up the exact wording if anyone is interested. These may not be in chronological order, I went back and forth between years. October 1801 Bill Metcalf charged with disorderly conduct in Bill's Creek Congregation. July 1810 Esther Smith, age nine years, daughter of Micajah Smith to be bound to Benjamin McSwain. James Withrow to take the deposition of Will Burnett in his suit with William Murray as the said Burnett is about to leave the state. {Note: William Murray was being sued for slander) October 1812 On motion ordered that Sarah Wilkerson aged 12 years, orphan of Polly Wilkerson be bound to Margaret McMurray until she attain the age of eighteen years. January 1813 The court allowed Polly Wilkerson the sum of sixty dollars for the maintenance of a base born child begotten on her body by Christy Mooney to be collected twenty dollars yearly July 1813 On orders that Rebeccah Wilkerson age four years be bound to Abraham Crow until she attain the age of eighteen years. July 1816 On motion ordered by the court that the Sheriff take into possession India Wilkinson a child that was bound to Margaret Etherington now in the possession of Will Jones and return her to the said Margaret Etherington or to James Witherow who is his security. Adam Wilkinson four years old last may is to be bound to Abraham Crow _____________________________________________________- Who were these four Wilkinson/Wilkerson children? What happened to them? What happened to Polly Wilkerson? Any information on any of these individuals would be appreciated. I will continue to post notes as I am able. 1. Re: [NCRUTHER-L] Powell and Mode family
2. Hello, I don't know a lot about Franklin but I can give the information I have. It may be similar to what you already know. I don't know the details of the bastardy trial but it was Rebecca Mode vs. B.F. Goode in 1847. I don't know which child or children this applies to as it was stated that Rebecca was living with William and Nancy and that William has fathered some of her children. I got this from a post on www.genforum.com Information from the 1850 Census of Cleveland County: http://freepages.genealogy.rootsweb.com/~judytalk/1850.htm 127/127 William Powel, 40, M Nancy Powel, 41, F Benjamin Powell, 21, M Martha Powel, 20, F Lucinda Powel, 17, F Isaac L Powel, 15, M Elizabeth Powel, 11, F Susan Powel, 9, F Rebecca Mode, 30, F Martha Mode, 7, F Chrisberry Mode, 5, M Anonymous Mode, 3/12, M (My comment: If these Mode folks seem to be yours, check out the bastardy files for our county, involving Rebecca Mode & neighbor, Franklin Goode. 2. Hello, Does anyone have any information regarding a court case in Rutherford County involving a William Powell and Rebecca Mode? The case involved Rebecca being accused of having relations with William, the husband of her sister Nancy. A bastardy case between Rebecca and Franklin Goode has said to have indicated that Rebecca had children with William. Rebecca and three of her children were living with William and Nancy on the 1850 Census in Cleveland County. Also, does anyone know the names of the parents of Nancy and Rebecca Mode and if Rebecca ever married? Thanks for your help.

1. [NCRUTHER-L] obituary, Elder Joseph Suttle, 1861
2. Lynn E.Wesson
3. Transcribed from the Mountain Eagle, Shelby, NC, 6/12/1861 [on microfilm at the State Library in Raleigh, NC]. Note: punctuation and spelling as in article. -------------------------------------------------------------------- FOR THE MOUNTAIN EAGLE. Died, at his residence four miles Northwest of Shelby, in Cleaveland County, North Carolina, on Sunday morning 26th of May 1861, of flux, Elder JOSEPH SUTTLE, in his 35th year. He was a son of a pious and praying mother, who impressed on his mind while he was young the importance of an early preparation for death. She often retired with him in secret and prayed to God for the awakening influences of his holy spirit, to rest upon him; the good Lord heard her supplications in behalf of her son, and before he had reached his 20th year he felt the force of Gods spirit upon his heart, was humbled under the divine power and soon became the happy subject of converting grace. He joined the church was baptised and soon felt impressions that he ought to preach th unsearchable riches of Christ.---He took not his honor to himself but he was called to God as was Aaron. He was engaged in the ministry about thirteen years during which time his labors were abundantly blessed. I would say that he baptised not less than on thousand persons and probably many over that number. His manner of preaching was very forcible; he generally felt what he said which caused those hearing him to feel the force of the important truths which he declared. Many claim him as a spiritual father, he spent much of his time both day and night in preaching Christ and the resurrection. The writer has spent weeks and months with him in revival meetings and a more devoted Christian minister he has never known. Elder JOSEPH SUTTLE spent much time in secret prayer, his public and private walk was loud preaching, not proud but humble, kind to all the poor as well as the rich, the black, as the white. According to the circle of his acquanintance, few ministers had so many devoted friends as he; hence he was regarded by the multitudes who sought his public or his private presence as a kind of universal property, whom all parties had a right to enjoy, and none to monopolize; kind was he at home, using every effort to make his visitors, (during their stay) comfortable.---The loss of so good a man is felt by the churches of his acquaintance. Many mourn on account of him, none so much as that affectionate wife, and those lovely children, four in number. Their best earthly friend is torn away from them by the reckless hand of death. Sister SUTTLE was at all times ready to make for her husband, the necessary preparation to enable him to attend to his Ministerial duties, which he did promptly, that part of her work is done. We sympathize with the bereaved family, we sorrow not as those who have no hope. He told the writer a short time before his death he had viewed the grave as a resting place.---Henceforth he rests from his labors and we trust his works will follow him. Elder SUTTLE was not a Supralapsarian who held that God without any regard to the good or evil works of men, has resolved by an eternal decree antecedently to any knowledge of the fall of Adam and independent of it, to save some and reject others, or in other words that God intended to Glorify his Justice in the condemnation of some as well as his mercy in the Salvation of others; and for that purpose decreed that Adam should fall. He was not an Armenian in the strictest sense of the term, he believed in a full atonement, and all that would seek according to the plain teachings of the Bible might attain eternal life. B. B. June 10th, 1861 N.B.---Biblical Recorder will please copy the above. ---------------------------------------------------------------------------- Transcriber's note: Many of you may have seen Joseph Suttle listed as the minister who married some of your ancestors in the Cleveland/Rutherford/Lincoln area in 1850s. 1. [NCRUTHER-L] From Russia
2. Hi, I am new to all of this, so I may sound a bit raw. Please excuse me. I am originally from St. Louis, Mo. My name is Dave Francis. I am living in Russia right now, where I teach English at the University here. I have begun to trace my family tree, and have found out that we were in North Carolina at one time. Apparently, in 1798 a Gideon Francis was born. His father was Edward Francis. That is about all the info I have right now. Gideon did have two brothers. They were John and Caleb. There may have been sisters, or even more brothers, but that is all I have so far. Any help would be greatly appreciated. 1. [NCRUTHER-L] Executions 1608-1987
2. Got this on another list. Most interesting.......... These records begin in VA in 1608, with the execution of George Kendall for "spying/espionage" and go to 1987. To say that the early records are fascinating is an understatement (you just don't run into many executions for piracy or witchcraft anymore). But they have value for family researchers, too. Even if you don't have reason to suspect that any of your ancestors were "outlaws," there are records of executions for espionage & treason, especially important during the American Revolution and the Civil War, and there are many records of executions for "slave revolts," which might be helpful to African-American researchers. Be patient, it takes a few minutes to download and you'll need a reader, such as an Acrobat. http://www.deathpenaltyinfo.org/ESPYdate.pdf

2. Bob Ross
3. Does anyone know who any of the children of Moses Ross and Mary Spurling were? I have seen it written that it is believed there were no children, but the Census for 1810 and 1820 shows children that could only be from that Union and not from the marriage to Rachel Bookout. Does anyone have a copy of the Moses Ross will? Is the reunion still held every year the last day of September?
