My gg-grandmother's father, Peter Sieversten Joye, (b. 1803) was the captain of a ship with a name that looks like (from the faded writing in a family Bible) the "Rey Pegassus". Petition of Anna EVANS of Caswell Co., NC, sheweth that her husband, Zachariah EVANS, because of debt and inability to satisfy his creditors, departed some years ago to the western parts of the country and left his family (wife and five children) in a low circumstance. The return of said husband is uncertain, and she prays for a law to secure to herself and children what may be acquired by their own labor and industry. Attested to by the signatures of twelve subscribers. In House and Senate, Nov. 1800, and passed. Referred to a committee to consolidate similar actions into one bill. She became very discontented with him after the marriage and oftentimes absented herself from his bed and board for months at a time. She "also frequented the Company of wicked and Adulterous men and was so open and publick in her Lewd and Abominable actions that many Sponcible persons knew of a certainty that it was so; Finally took up with a Thomas ROLINSON . . . then She Removed to the town of Washington and so from place to place Continuing in the Same Detestable practices Till this time . . . Your petitioner has remained in lonesome, melancholy circumstances for more than two years. He prays for a dissolution of the marriage. "She also joins me so far as to the prayer of the petition being granted." Attested to by the signatures of four subscribers. Petitioner Rebekah (x) FARROW also signs. Since that time, he has not seen nor heard of his aforesaid wife except that she is living with another man and has a family of children. The petitioner applied to the North Carolina Assembly at the November 1795 session but failed to obtain relief. He considers his circumstances to be a hardship and worries "that his hard earned labour should perhaps at some unforeseen period be subject to the caprice of an abandoned woman and her offspring."     2. 48. __ Joshua See Bond V. BROWN. 49. BYRUM James. Petition of James BYRUM of Bertie Co., NC, states that he married Amelia KEEN of said county of Bertie in August 1791. He discovered too late that he was united with one whose violence of temper and inconstancy in bed rendered it barely possible for him to endure her ways. He lived with her four years and hoped for some change, but she removed herself to the State of Tennessee and has remained there ever since. During the petitioner’s cohabitation with the said Amelia, one child was born to them which your petitioner means to provide for in the best manner. He has been informed that the said Amelia long since her residence in Tennessee has been delivered of another child, and he is bound by law to support as well the children born to his wife as long as the marriage continues. Petition of Zachariah CANDLER of Buncombe Co., NC, attested to by 17 subscribers signatures, prays for a divorce from his wife, Rhoday, dated 15 Oct. 1800. Said Zachariah and wife were resident in Buncombe County for eight years past. He is still a resident, but his wife Rhoday departed from her said husband nearly five years previous to the said date and has not returned. From other evidence- we have been creaditly informed that the afore said Rhoday has been Marryed to another Man and has one child by him and we do believe that if any man on Earth is intitled to a Devorsment from his wife that the aforesaid CANDLER is justly intitled to one from his wife Rhoday . . .“ In Senate, 21 Nov. 1800, and referred to Committee. Petition of Sarah COKELEY, generally called Sarah HAWLEY, sheweth that in the Year 1780, your petitioner intermarried on the Island of St. Martins with a certain Benjamin COAKLEY with whom she lived in the habits of matrimony till sometime in the Year 1786. This union became intolerable, and the two partners agreed to separate. Said Benjamin delivered to your petitioner his written obligation, bearing date of 17 June 1788, in the sun of £5,000 conditioned for his never thereafter intermeddling with or disturbing your Petitioner either on her person or her property. Your petitioner having then been but a short time resident in the State of North Carolina and being to a great measure ignorant of its laws, your petitioner erroneously considered that said Benjamins written obligation amounted to a dissolution of the bonds of matrimony between said Benjamin and herself, and in the Year 1788, intermarried with William HAWLEY of Newbern. Your petitioner lived with said William in a state of great conjugal happiness (having had by him several children) till the Fall of 1799, when the yellow fever raged with great violence in the Town of Newborn, and said William died intestate, leaving considerable property both real and personal. However, in consequence of her not being legally divorced from the said Benjamin COAKLEY (her first husband), she and her said children have been considered as having no claim upon the estate of said William. I doubt a child this young would be bound out if the mother was still living and could care for her, but in this case both parents and most of the other children died in an epidemic, leaving only this child and an older brother who was also apprenticed at the time. O'siyo o'ginali(hello my friends), I am seeking information on the Cherokee Lighthorse, a regulators organiztion(sheriffs)established by the Cherokee Tribal Council abt 1808 in the Old Cherokee Lands of NC. I have been informed that a "Gary McCarthy" wrote a book of two volumes entitled either"The Cherokee Lighthorse" or "The Horsemen", but it is out of print and I cannot locate any copies. A sworn affidavit given by a member of a prominent Cherokee family in the 1880's states that my grgrgrandfather(a Captain) and his brother, served in such a unit in NC before the Treaty of 1828 and I would like to have additional coaberation of the informatiion.     3. thanks, Dawn -- I'll try the sites you've recommended. I spent a few hours at the Library of Congress last night (I live in Washington, DC) but wasn't able to pin down the "Mary & Mariane." It seems there's just not as much in print about colonial North Carolina as there is about Virginia and South Carolina. I did discover that colonization of North Carolina -- especially the Cape Fear region -- boomed in the mid-1720s, with lots of new towns being founded and colonists coming from England. So I suspect the 1722 tankard is associated with an event in that area, at that period. There was a new royal governor of NC, George Burrington, appointed in 1723 who left London at the end of that year to come to America, specifically with the mission to expand the colony. Perhaps the tankard was a gift to him - it was certainly a gift fit for a governor. But I haven't found any association yet between him and the "Mary & Mariane." Perhaps someone in the Cape Fear area could suggest further avenues to explore. Is there any sort of historical society or local history expert down there whom I might ask? If anyone knows, I'd be grateful. But his parents (names unknown) were both from NC, as was his wife and what appears to be an allied family, PIERCE*PEARCE (which is my line). Why was he granted 200 acres? Did he remain in NC? Are there any CHEROKEE from Johnston CO? (I am not sure where Johnston County is located). My PIERCE*PEARCE line is presumed to be of Cherokee origin, although I am leaving all options open, researching it both with the presumption that they were and were not Cherokee. So I am very curious about GREEN'S PATH. Yes, more information would be wonderful, as I have had so much difficulty tracking my lines from TN back to NC.
