If a person died intestate or did not state how his estate was to be disposed of after his death, the property ownership would be passed on in totol; undivided to all of his heirs. If no one called for the sale of the property to gain their share, it could remain that way for generations. In those days land was like money in the bank, other properties could be purchased with that as collateral, even when it was not mentioned in a deed. A paper discussing that aspect could be a separate agreement altogether. Keep looking on down the line in the family and checking deeds; if it has been divided you may still find it, even if it is in this century. Also check on the power of attorney records for the county; if he decided to dispose of the land once he moved to Tennessee, he would have had someone to represent his interest at the local level, especially if he were not able to make the trip himself. Has anyone found in your research when Phillip Walker disposed his land in Orange Co, NC. I have found been able to find that he bought land but not when or how he disposed/sold it. I appreciate any help! Where did they live and when: Apparently Phillip Walker, Sr. lived in Pennsylvania 12 October 1780 when Phillip Jr. was born, but moved to Orange County, NC in the 1790-1810. The earliest deed record I have found for Phillip Walker in Orange County, NC is 1788, with three additional tracts purchased in 1795, 1800 and in 1805. 22 Feb 1788, Phillip Walker bought 209 acres from Swethen Stalcup on the waters of Jordan Creek and this land cornered with William Love and joins Jacob Scott and Jacob Cantril.. The deed was witnessed by William Love and Connally Walker (his son). This deed was proved May 1802 by Connally Walker. 30 Apr 1795, Phillip Walker bought 32 acres from James Murray on the south side of Jordan Creek and this deed was witnessed by Connally Walker and William Walker. This deed was proved May 1802 by William Walker and delivered to P. Walker. 20 Feb 1800, Phillip Walker bought 163 acres from Thomas Williams on the waters of Jordan Creek and the land adjoins Samuel Ector, John Brown, Joseph Cantril and Phillip Walker. The deed was witnessed by John Brown, William Walker and Connally Walker. The deed was proved May 1802 by William Walker and delivered to P. Walker. 22 Nov 1805 Phillip Walker bought 140 acres from Zebulon Cantrell which joined the William Love line (William Love live on Jordan Creek as noted by 209 acre tract bought by Phillip 22 Feb 1788). This deed was witnessed by John Walker, Phillip Walker (Note this must have been Phillip, Jr) and Alexander Walker. The deed was proved in the May Term 1808 and delivered to P. Walker. Other references: 1794 Phillip Walkers property line was called for in a deed to Joseph Cantrile from Mary Scott for 150 acres on Jordan Creek. 25 Nov 1796 Phillip Walkers line was called for in a deed to Isaac Cantrell from Joseph Cantrell for 150 acres on Jordan Creek 19 Jun 1798 Phillip Walkers property line was called for in a deed to Joseph McCulley from John Tate for 250 acres on both sides of Watsons Creek, a branch of Stoney Creek. This cemetery is near the Guilford/Rockingham Co. line . It has been abandoned for over 130 years. Surrounded by a circle of cedar trees, overgrown with honeysuckle, periwinkle and briers. Many sunken graves, some with huge trees growing out of them. I first visited this cemetery in the summer of 1989, at that time of year it was almost impossible to get into because of undergrowth.. James Whitsett born in Orange County, NC, died in Rockingham County, NC was my 3rd great-grandfather, I descend thru his daughter Permelia (Emily) Whitsett Wall. The cemetery is located one mile southwest of Midway on the McNutt Farm on State Road 1002. Eight graves are marked with fieldrock but many unmarked graves there. I am researching our family tree and need help in finding those who came before. John and Sallie Tester were from in or around Johnson City Tn. They had children, Wilbur Wiley (b. 1864) Andy, Daniel, Tom, David, Sarah, and Nancy. Wilbur married Nancy Emily Dunford in Smyth Co. Va. in 1888 and had children John Wesley Daniel, Ezra James, Wiley, Andrew, Carrie, Sally, Ida, and Emma. The 4 sisters lived most of their lives in Marion, Va. --- Our Testers invented what was called the "Tester Bed" , a sort of canopy bed. Sounds to me like my early ancestors were furniture makers or carpenters. It was also told that the first Testers came from Wales or England and were Wheel-Wrights. Not much to go on I'm afraid but that's all I have. Tidbits of history.... The Roney House Built in 1903 , the A.K. Roney house sits on the corner of what are now Wilkins St. and Roxboro Road. It was a present for Amos Kendall and Elizabeth Vincent Roney from their nephews, Ben and Buck Duke. The Dukes were frequent guests at the Roneys. A.K. and Lizzie's own two children died in 1892, and they adopted a son, George in 1895. In the early 1920's, A.K, received a large inheritance from the Duke estate, part of which he donated to Elon College. Lizzie died in 1924 and A.K. in 1926, and soon, thereafter George lost the house because of some debts. In the thirties, the house became the property of the county school board. It was used to house and train teachers and became known as the Teachery or Teacherage. Colleen Agnew lived there with Principal Barker and his wife when she came to town to teach. To all: My Orange CO NC lines that are known to me are CATE/S - HORN- McGEE. I really would appreciate any assistance on them. CATE/S - I am descended from William Cates who m. Frances McGee 12 of June 1797. Th bm was Henry Hunt. I have no other information on the McGee line other than Frances was b. abt 1780. William Cates was b abt 1776 in OJ CO but I have been unable to determine who his parents were. Some think his father was Benjamin Cate m. Mary _ and others think it was Lazarus m. Margaret __. It was suggested that I obtain copies of the marriage bond of Wm and Frances and compare Wm's mark with the mark a Wm made on Benjamin's will of 1798, to see if it would show that the Wms were one and the same. The marks did not appear to be similar to me and they were made just a few months apart. Perhaps there is someone out there that is researching the above Wm and Frances that may have more data than I have. Norwood Cates was the son of Wm and Frances. He was b abt 1815 in OJ CO. He married Elizabeth Adeline HORN on 21 May 1841 in Oj CO NC. The bm were David Whitaker and Moses Leathers, Jr. In 1858 David Whitaker was given the Power of Atty to represent Norwood in the settlement of his father's estate in Oj CO. (Norwood was then a resident of Rutherford CO TN). I have not been able to find any HORN family to associate my Elizabeth Adeline HORN with. HORN - the only possible Horns that I have found that might have been related to Elizabeth Adeline was the following: James F. Horn m. Elizabeth Whiteker 14 Oct 1845 Oj CO with Norwood's brother, Lazarus Cates as the bm. ( I think James might have been her brother). Then there was James HORN who m. Elizabeth REDDING 4 Apr 1810 with Stephen Redding as the bm. Due to the names James and Elizabeth I think this could be the parents of the James who m. in 1845 and my Elizabeth Adeline. I would like contact with anyone researching the HORN family. In the mail today, I received a photocopy of the book "Cook History and Genealogy" by Earl Cook (1941), and inside there is a copy of that deed and will, in it's entirety. It is so helpful to have it in front of me, and there are names included that may help me find out about my Cook ancestors. So thanks again for your ideas and suggestions. Hi Group, Someone sent me a message about the McQuiston family in North Carolina in the past few days, and I lost the message just as I was opening it, due to the problems with AOL. Could whoever sent the message resend it? I have considerable information about the McCuiston family, including the connection with President Andrew Jackson and the Gold that they inherited, which Robert McCuiston gave to President Sam Houston to save the Republic of Texas in 1836. I am a descendant of Jane Ruth who first married Robert McCuiston in about 1754, probably in Pennsylvania or Maryland. They came to old Rowan County, NC about 1753 probably with the Nottingham Colony. Robert McCuiston died about 1760 and Jane Ruth married Major Thomas Blair about 1763 and I am a descendant of their daughter Martha Blair, who married her first cousin, John Blair. This is a story that I grew up hearing in Haw River, NC. During the Revolutionary War General Cornwallis passed near "Trolinger's Ford", as it was then called (present day Haw River), on his way to the Guilford Battleground. He camped overnight near Adam and Henry Jacob's gristmill, taking and destroying all the grain. This made Adam very angry and he told General Cornwallis what he thought of him, whereupon had him tied to a tree, with a bridle bit in his mouth so that he could neither speak nor extricate himself. They left him in this condition and he was found late in the evening and untied by a Mrs Rippy who chanced to come to the mill. At this time, Henry Jacob Trolinger had two young sons, John, born 11 Feb 1759, died 11 Oct 1840, and Henry born 10 March 1762, died 28 Feb 1844, who on hearing of General Cornwallis' treatment of their father, were so enraged that they sent John to a cave in VA. This cave that Henry and his father found and explored on their way to NC from Pennsylvania in 1745, was used to make gun powder to be used in the Revolutionary War. John Trolinger entered and settled on 640 acres of land in Montgomery Co (now Pulaski Co. VA which included the cave. This was a valuable salt peter cave used in the making of fine gun powder and now is located behind the Dublin Cemetery in the backyard of a residence in a housing development.
